JACKSON COUNTY, W.Va. (WOWK) — Charges against Morgan Morrow, the West Virginia woman who was arrested in January for alleged terroristic threats linked to a social media post about President Donald Trump and a sniper, have been dismissed.
After probable cause was found in February, the prosecuting attorney in Jackson County filed a motion to dismiss without prejudice on April 16.
In the motion, the prosecutor said that Morrow was not properly read her Miranda rights during the interrogation.
“The prosecutor has made the judgment call that the statement that was given during the investigation by the defendant was not properly administered under our Miranda Rights,” said John Mitchell Jr., a Charleston criminal defense attorney.
A dismissal without prejudice does mean charges can be filed again, and there’s no statute of limitations on felonies in the state of West Virginia, but the county prosecutor could be stuck without the interrogation footage should he choose to proceed.
“The case has been dismissed. We believe Miss Morrow never should have been charged at all, and we’re glad this is over,” Morrow’s defense attorney Mark Atkinson told Nexstar’s WOWK.
According to the initial criminal complaint, investigators said Morrow posted the alleged threatening TikTok message at the Jackson County Public Library, where she worked as an assistant.
Morrow was detained at her home and later interrogated.
