{"id":52999,"date":"2026-01-24T01:29:00","date_gmt":"2026-01-24T07:29:00","guid":{"rendered":"https:\/\/ustower.net\/?p=52999"},"modified":"2026-01-24T06:32:04","modified_gmt":"2026-01-24T12:32:04","slug":"virginia-democrats-frustrate-law-enforcement-with-bill-axing-prison-time-for-violent-crime-expert-warns","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=52999","title":{"rendered":"Virginia Democrats frustrate law enforcement with bill axing prison time for violent crime, expert warns"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">A new bill proposed by Democrats in the&nbsp;<a href=\"https:\/\/www.foxnews.com\/category\/us\/us-regions\/southeast\/virginia\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia state legislature<\/a>&nbsp;is raising concerns regarding the removal of minimum prison sentences for various violent felony crimes.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Within days of Democratic Gov.&nbsp;<a href=\"https:\/\/www.foxnews.com\/category\/person\/abigail-spanberger\" target=\"_blank\" rel=\"noreferrer noopener\">Abigail Spanberger<\/a>&nbsp;being sworn in, members of her party introduced a flurry of amendments looking to end mandatory minimum sentences for various crimes within the state.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">According to Jason Miyares, the former Republican attorney general,&nbsp;<a href=\"https:\/\/www.foxnews.com\/category\/politics\/house-of-representatives\/legislation\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 863<\/a>&nbsp;includes proposals to effectively eliminate minimum sentencing for manslaughter, rape, possession and distribution of child pornography, assaulting a law enforcement officer and other repeat violent felonies.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Virginia Gov. Abigail Spanberger pauses as House Speaker Don Scott, D-Portsmouth, looks on during inaugural ceremonies at the Capitol in Richmond Va., Saturday, Jan. 17, 2026.&nbsp;(Steve Helber\/AP Photo)<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Additionally, Democrats are also looking to remove the mandatory five-day minimum sentence for certain first-time DUI offenders.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;<a href=\"https:\/\/www.foxnews.com\/category\/politics\/state-and-local\/legislation\" target=\"_blank\" rel=\"noreferrer noopener\">HB 863<\/a>&nbsp;is a common-sense proposal that eliminates the requirement for one-size-fits-all minimum sentences for certain crimes,&#8221; Delegate Rae Cousins, who sponsored the bill, said,&nbsp;<a href=\"https:\/\/wjla.com\/news\/local\/virginia-state-legislature-richmond-mandatory-minimum-sentences-offense-dui-felony-assault-intellection-disability-mental-illness-accountability-jail-prison-crime-safety-driving-drinking-commonwealth\" target=\"_blank\" rel=\"noreferrer noopener\"><u>according to<\/u><\/a>&nbsp;ABC 7.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;This change would give the&nbsp;<a href=\"https:\/\/www.foxnews.com\/category\/politics\/judiciary\" target=\"_blank\" rel=\"noreferrer noopener\">experienced judges<\/a>&nbsp;in our communities more discretion to make decisions based on the unique facts of each case. As the General Assembly session continues, I look forward to working with my colleagues to pass this legislation and promote fairer outcomes in our justice system.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">If passed, HB 863 would eliminate minimum sentencing for manslaughter, rape, possession and distribution of child pornography, assaulting a law enforcement officer and other repeat violent felonies.&nbsp;(iStock)<\/p>\n\n\n\n<p class=\"has-medium-font-size\">However,&nbsp;<a href=\"https:\/\/www.foxnews.com\/category\/us\/crime\/police-and-law-enforcement\" target=\"_blank\" rel=\"noreferrer noopener\">law enforcement experts<\/a>&nbsp;are pushing back against the bill while expressing concerns about how the possibility of more lenient sentencing could impact victims of violent crimes.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;From a law enforcement standpoint, I think police generally want offenders to be held accountable, and frustration among law enforcement officers grows when individuals are released quickly and subsequently re-offend \u2013 and even more so if it involved a violent felony,&#8221; law enforcement expert Josh Ederheimer told Fox News Digital. Katz\/The Virginian-Pilot via AP)<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Ederheimer, an assistant professor at the University of Virginia&#8217;s Center for Public Safety and Justice and a retired law enforcement officer, went on to explain that police typically understand unique circumstances that can point to a defendant receiving a lesser sentence, but frustration still exists surrounding more serious crimes.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;For violent felonies, however, the biggest practical concern is that the defendant will re-offend, and that the public is not alerted or aware that the defendant has returned to the community. However, it does not impact maximum penalties in such cases.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Ederheimer further explained that the bill could have a negative impact on victims and their families regarding accountability for violent offenders.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;I think that the police and public alike have expectations that convicted criminals will be held accountable, and that full sentences should be served,&#8221; Ederheimer said. &#8220;Mandatory minimums assure victims \u2013 and the community \u2013 that a convicted person will serve their sentence.&#8221;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Virginia state police officers stand in the parking lot after a mass shooting at a Walmart in Chesapeake, Virginia, U.S. November 23, 2022.&nbsp;(REUTERS\/Jay Paul)<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;It is the circumstance when convicted felons are released early that victims may feel a sense of betrayal or that justice was not served.
