{"id":52902,"date":"2026-01-21T18:57:00","date_gmt":"2026-01-22T00:57:00","guid":{"rendered":"https:\/\/ustower.net\/?p=52902"},"modified":"2026-01-21T21:59:50","modified_gmt":"2026-01-22T03:59:50","slug":"federal-appeals-court-okays-ices-use-of-force-against-protesters","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=52902","title":{"rendered":"Federal appeals court okays ICE&#8217;s use of force against protesters"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">Jan. 21 (UPI) &#8212;&nbsp;Federal law enforcement can use force while enforcing federal immigration laws in Minnesota amid a roundup of those who illegally are in the country, a federal appeals court ruled.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A panel with the Eighth Circuit Court of Appeals in St. Louis on Wednesday issued a one-sentence ruling staying a lower court&#8217;s injunction against the use of force or crowd dispersal munitions, such as tear gas and pepper spray, against protesters who are not engaged in violence, according to<a href=\"https:\/\/www.nytimes.com\/2026\/01\/21\/us\/minnesota-injunction-protest-appeal.html\">\u2002The New York Times<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">U.S. District Court of Minnesota Judge Katherine Menendez on Friday<a href=\"https:\/\/www.upi.com\/Top_News\/US\/2026\/01\/17\/ice-minnesota-ruling\/8691768678870\/\">\u2002imposed the restrictions<\/a>&nbsp;and another preventing Immigration and Customs Enforcement officers and others from making traffic stops of people who are not &#8220;forcibly obstructing or interfering&#8221; with federal officers.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Trump administration appealed the ruling, arguing that it amounted to a &#8220;broad injunction regulating [Department of Homeland Security] officers&#8217; operations&#8221; and &#8220;harms DHS officers&#8217; ability to protect themselves and the public in very dangerous circumstances.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Wednesday&#8217;s appellate court ruling only applies to the use of force and does not regard the merits of the federal government&#8217;s appeal, which is yet to be decided.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The American Civil Liberties Union<a href=\"https:\/\/abcnews.go.com\/US\/live-updates\/minneapolis-ice-shooting-live-updates-doj-investigating-apparent\/?id=129340693\">\u2002filed the federal lawsuit<\/a>&nbsp;on behalf of protesters and after Renee Good was shot and killed while hitting an ICE officer with her vehicle on the morning of Jan. 7.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Good was trying to flee the scene after ICE officers tried to detain her for using her SUV to block ICE vehicles in a Minneapolis neighborhood.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/www.upi.com\/Top_News\/US\/2026\/01\/21\/immigration-force\/3301769040359\/\">upi<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jan. 21 (UPI) &#8212;&nbsp;Federal law enforcement can use force while enforcing federal immigration laws in Minnesota amid a roundup of those who illegally are in the country, a federal appeals court ruled.
