{"id":52108,"date":"2026-01-03T18:01:00","date_gmt":"2026-01-04T00:01:00","guid":{"rendered":"https:\/\/ustower.net\/?p=52108"},"modified":"2026-01-03T21:44:03","modified_gmt":"2026-01-04T03:44:03","slug":"trumps-judicial-battles-raise-profiles-of-federal-judges","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=52108","title":{"rendered":"Trump\u2019s judicial battles raise profiles of federal judges"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">The Trump administration\u2019s escalating clash with the judiciary over immigration, spending priorities and more is turning previously unknown judges like&nbsp;<a href=\"https:\/\/thehill.com\/people\/james-boasberg\/\"><u>James Boasberg\u2002<\/u><\/a>and Paula&nbsp;Xinis&nbsp;into household names.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The judiciary has been a notable battleground in&nbsp;<a href=\"https:\/\/thehill.com\/people\/donald-trump\/\"><u>President Trump\u2019s\u2002<\/u><\/a>first year back in office, particularly given Congress\u2019s compliance with his vision.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">More than 500 legal challenges have been mounted against Trump\u2019s second-term agenda, making the courts the front line in the president\u2019s effort to reshape much of the country.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">While judges have at times blocked Trump\u2019s progress, they also have attracted the ire of the president and his team.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThey have a&nbsp;robe on, but they are more political or certainly as political as the most liberal governor or D.A.,\u201d Deputy Attorney General Todd Blanche said at a November conference for conservative lawyers.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThere\u2019s a group of judges that are repeat players, and that\u2019s obviously not by happenstance; that\u2019s intentional,\u201d he continued. \u201cAnd it\u2019s a war, man.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It\u2019s&nbsp;not unusual for judges to assume greater public visibility amid consequential court cases.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">When Trump faced four criminal indictments and a slew of civil&nbsp;matters, federal judges like Aileen Cannon&nbsp;and&nbsp;<a href=\"https:\/\/thehill.com\/people\/tanya-chutkan\/\"><u>Tanya Chutkan\u2002<\/u><\/a>\u2014 plus&nbsp;state judges like&nbsp;<a href=\"https:\/\/thehill.com\/people\/juan-merchan\/\"><u>Juan Merchan,<\/u><\/a>&nbsp;Arthur Engoron&nbsp;and&nbsp;Scott McAfee&nbsp;\u2014&nbsp;were&nbsp;both&nbsp;vilified and&nbsp;celebrated&nbsp;for their roles in the cases.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Boasberg, the U.S. District Court for the District of Columbia\u2019s chief judge, has&nbsp;faced more scrutiny than most&nbsp;since Trump\u2019s return to power.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">An appointee of&nbsp;former President&nbsp;<a href=\"https:\/\/thehill.com\/people\/obama\/\"><u>Obama,<\/u><\/a>&nbsp;Boasberg&nbsp;took center stage&nbsp;in March&nbsp;when&nbsp;he was assigned to&nbsp;oversee a lawsuit challenging&nbsp;Trump\u2019s invocation of&nbsp;the Alien Enemies Act.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The judge&nbsp;swiftly barred&nbsp;Trump&nbsp;from deporting alleged Venezuelan gang members to a notorious&nbsp;megaprison&nbsp;in El Salvador under the wartime law and verbally directed&nbsp;officials&nbsp;to&nbsp;halt or turn around any planes carrying noncitizens covered by the order.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">At a&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5199572-judge-lashes-out-at-trump-admin-over-deportation-flights\/\"><u>pivotal hearing days later<\/u><\/a>&nbsp;after some flights continued,&nbsp;Justice Department&nbsp;lawyers&nbsp;refused to answer certain questions and&nbsp;claimed&nbsp;Boasberg\u2019s&nbsp;oral command&nbsp;wasn\u2019t&nbsp;binding because&nbsp;a&nbsp;later&nbsp;written order&nbsp;failed to&nbsp;mention already-airborne flights.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It all prompted Trump to&nbsp;call for&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/administration\/5200382-trump-judge-deportation-case-impeachment\/\"><u>Boasberg\u2019s\u2002impeachment<\/u><\/a>,&nbsp;which in turn&nbsp;evoked&nbsp;a&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5200768-john-roberts-trump-judge-impeachment\/\"><u>rare public statement<\/u><\/a>&nbsp;from&nbsp;Chief Justice&nbsp;<a href=\"https:\/\/thehill.com\/people\/john-roberts\/\"><u>John Roberts,<\/u><\/a>&nbsp;who said impeachment is \u201cnot an appropriate response to disagreement\u201d over court decisions.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Boasberg&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5251829-boasberg-trump-contempt\/\"><u>has\u2002since\u2002accused<\/u><\/a>&nbsp;the Trump administration of willfully violating his ruling and moved toward contempt charges.&nbsp;An&nbsp;appeals court halted the proceedings for&nbsp;months, but&nbsp;they&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/administration\/5613841-trump-deportation-flights-contempt\/\"><u>sprung back to life<\/u><\/a>&nbsp;in November&nbsp;\u2014 until Trump&nbsp;sought&nbsp;to block them again&nbsp;last month&nbsp;by&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.278436\/gov.uscourts.dcd.278436.206.0.pdf\"><u>booting\u2002Boasberg<\/u><\/a>&nbsp;from the case.&nbsp;A panel of D.C. Circuit judges&nbsp;is&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5646447-trump-boasberg-deportation-feud\/\"><u>weighing\u2002next steps<\/u><\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Despite being chief judge, Boasberg&nbsp;doesn\u2019t&nbsp;control which judges are assigned to each&nbsp;case; the process is typically randomized.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Boasberg&nbsp;also oversees&nbsp;contentious legal fights like the&nbsp;lawsuit&nbsp;that followed&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/administration\/5216997-donald-trump-james-boasberg-signal-case\/\"><u>\u201cSignalgate,\u201d<\/u><\/a>&nbsp;when&nbsp;top&nbsp;administration&nbsp;officials\u2019&nbsp;war-planning group chat&nbsp;was allegedly leaked&nbsp;to&nbsp;The Atlantic\u2019s top editor,&nbsp;and Rep.&nbsp;<a href=\"https:\/\/thehill.com\/people\/eric-swalwell\/\"><u>Eric Swalwell\u2019s\u2002<\/u><\/a>(D-Calif.)&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5622573-swalwell-fhfa-pulte-trump-schiff-california\/\"><u>lawsuit<\/u><\/a>&nbsp;against the Federal Housing Finance Agency over its criminal referral against him.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The battles have elevated Boasberg\u2019s profile; there are&nbsp;<a href=\"#321P73627892D1V\"><u>T-shirts<\/u><\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.redbubble.com\/i\/sticker\/Judge-Boasberg-for-President-2028-bright-logo-no-background-by-MsMarketFinds\/170012523.EJUG5\"><u>stickers<\/u><\/a>&nbsp;that&nbsp;call&nbsp;for&nbsp;<a href=\"https:\/\/www.ebay.com\/itm\/167419044866\"><u>his\u2002impeachment<\/u><\/a>, while others call for him&nbsp;<a href=\"https:\/\/www.redbubble.com\/i\/t-shirt\/Judge-Boasberg-for-President-2028-bright-logo-no-background-by-MsMarketFinds\/170012523.WFLAH?country_code=US&amp;gclsrc=aw.ds&amp;gad_source=1&amp;gad_campaignid=21024081010&amp;gbraid=0AAAAADuDTRxwTZ_QSK73Ak5pMjRDS-Ml7&amp;gclid=Cj0KCQiA9t3KBhCQARIsAJOcR7zPa561mskTDl6Bx7sEbcbRqSZ7huRsMqpYtq5DUo4qPj7bWHrEo4kaAnicEALw_wcB\"><u>to be\u2002president.<\/u><\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Other D.C. federal judges \u2014 like&nbsp;<a href=\"https:\/\/thehill.com\/people\/beryl-howell\/\"><u>Beryl Howell,<\/u><\/a>&nbsp;the district\u2019s former chief judge, and Ana Reyes \u2014 have faced&nbsp;<a href=\"#:~:text=DOJ's misconduct complaint against federal judge in DC dismissed | AP News\"><u>misconduct\u2002complaints<\/u><\/a>&nbsp;and&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5208083-justice-department-demands-judge-recuse-from-perkins-coie-lawsuit\/\"><u>demands to step aside<\/u><\/a>&nbsp;from the administration.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In Maryland,&nbsp;Xinis&nbsp;was thrust into Trump\u2019s immigration crackdown after she drew the case of&nbsp;Kilmar&nbsp;Abrego Garcia, who was wrongfully deported to El Salvador in March in violation of a 2019 court order barring his deportation&nbsp;over&nbsp;safety concerns.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Xinis&nbsp;ordered immigration officials last month to&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5644176-judge-orders-abrego-garcias-immediate-release-from-ice-custody\/\"><u>immediately release<\/u><\/a>&nbsp;Abrego Garcia&nbsp;and has barred his deportation for now.&nbsp;Her decision on the next steps in Abrego Garcia\u2019s case is pending further briefing.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;Obama-appointed&nbsp;judge has&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5660264-judge-bars-retaliation-abrego\/\"><u>signaled increasing frustration<\/u><\/a>&nbsp;as the&nbsp;government&nbsp;has&nbsp;repeatedly&nbsp;resisted her orders.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In April, after she ordered&nbsp;the government to return Abrego Garcia to the U.S.,&nbsp;Trump aide&nbsp;<a href=\"https:\/\/thehill.com\/people\/stephen-miller\/\"><u>Stephen Miller\u2002<\/u><\/a>claimed&nbsp;Xinis&nbsp;was effectively suggesting the&nbsp;U.S.&nbsp;should \u201ckidnap a citizen of El Salvador and fly him back here.\u201d&nbsp;Other officials criticized her as an activist judge, while putting off Abrego Garcia\u2019s return.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Xinis&nbsp;said at&nbsp;a&nbsp;Dec. 22&nbsp;hearing&nbsp;she was&nbsp;\u201cgrowing beyond impatient\u201d with&nbsp;the government\u2019s&nbsp;repeated misrepresentations,&nbsp;questioning&nbsp;whether&nbsp;Abrego Garcia\u2019s illegal deportation&nbsp;in the first instance&nbsp;undercuts&nbsp;any&nbsp;notion&nbsp;federal officials can&nbsp;be trusted not to do it again.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cWhy should I give the respondents the benefit of the doubt?\u201d&nbsp;she&nbsp;asked.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Xinis&nbsp;is not the only judge in her courthouse stuck in Trump\u2019s crossfire on immigration.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The administration&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5369079-trump-sues-maryland-court-deportation-order\/\"><u>sued\u2002all 15 federal district judges<\/u><\/a>&nbsp;in Maryland&nbsp;in&nbsp;June&nbsp;over&nbsp;the federal court\u2019s&nbsp;standing order slowing down speedy deportation efforts, a striking escalation in its war with the judiciary. Though the lawsuit&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5470641-maryland-deportation-lawsuit-dismissed\/\"><u>was thrown out<\/u><\/a>, the administration has&nbsp;appealed;&nbsp;its opening&nbsp;<a href=\"https:\/\/www.courtlistener.com\/docket\/71223097\/18\/united-states-v-matthew-maddox\/\"><u>brief is due<\/u><\/a>&nbsp;later this month.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Federal judges have not all&nbsp;sat silently as the administration\u2019s attacks on the judiciary&nbsp;have&nbsp;escalated.&nbsp;Some judges have anonymously spoken out in the press&nbsp;\u2014&nbsp;or, rarer, publicly&nbsp;\u2014&nbsp;to confront the assaults&nbsp;on their&nbsp;work\u2019s&nbsp;integrity, especially as threats rise.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In fiscal 2025, there were 564 threats against judges, according to&nbsp;<a href=\"https:\/\/www.usmarshals.gov\/what-we-do\/judicial-security\/protective-investigations-threat-statistics\"><u>U.S. Marshals Service\u2002data<\/u><\/a>. Since fiscal 2026 began in October, there have already been 131 threats.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Judges&nbsp;handling&nbsp;prominent cases involving the Trump administration&nbsp;say&nbsp;they\u2019ve&nbsp;seen threats become even more&nbsp;prevalent.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">U.S. District Judges John McConnell&nbsp;Jr. of the District of Rhode Island and John Coughenour of the Western District of Washington&nbsp;remarked at a virtual event&nbsp;earlier this year that harassment campaigns&nbsp;followed their assignments&nbsp;to major cases&nbsp;involving the&nbsp;president\u2019s priorities.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">McConnell in January 2025 blocked the&nbsp;administration\u2019s&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5119651-judge-blocks-trump-federal-funding-freeze\/\"><u>federal aid freeze<\/u><\/a>&nbsp;and&nbsp;said at the July event that his court had received more than 400 \u201cvile, threatening, horrible\u201d voicemails since then \u2014&nbsp;including one wishing for his&nbsp;imprisonment and assassination.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">He\u2019s&nbsp;since overseen&nbsp;challenges to the Trump administration\u2019s&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5583581-court-ruling-snap-emergency-funds\/\"><u>bid to\u2002block<\/u><\/a>&nbsp;full Supplemental Nutrition Assistance Program&nbsp;benefits during the&nbsp;government shutdown&nbsp;and&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5232494-judge-fema-grants-trump-blue-states\/\"><u>efforts\u2002to\u2002withhold<\/u><\/a>&nbsp;millions of dollars&nbsp;in&nbsp;Federal Emergency Management Agency&nbsp;grants from&nbsp;Democratic-led states.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Coughenour, who&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5130744-trump-judge-birthright-order-blocked\/\"><u>indefinitely blocked<\/u><\/a>&nbsp;Trump\u2019s&nbsp;executive&nbsp;order to restrict birthright citizenship in February, recalled&nbsp;being swatted at his home and&nbsp;his family members facing threats.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cIt\u2019s just been stunning to me how much damage has been done to the reputation of our judiciary because some political actors think that they can gain some advantage by attacking the independence of the judiciary and threatening the rule of law,\u201d the judge said.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">U.S. District Judge&nbsp;William Young, who sits on the federal bench in&nbsp;Massachusetts, topped&nbsp;a&nbsp;major ruling&nbsp;finding&nbsp;Trump\u2019s crackdown on pro-Palestinian campus activists unlawful&nbsp;with an&nbsp;anonymous threat&nbsp;he received&nbsp;that read, \u201cTrump has pardons and tanks \u2026 what do you have?\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;judge&nbsp;responded&nbsp;in the ruling&nbsp;that,&nbsp;alone,&nbsp;he has \u201cnothing but my sense of duty,\u201d but together, \u201cWe the People of the United States \u2014 you and me \u2014 have&nbsp;our magnificent Constitution.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Young\u2019s ruling took&nbsp;specific aim at Trump,&nbsp;pegging him&nbsp;as a&nbsp;bully prone to \u201chollow bragging\u201d&nbsp;and&nbsp;pointing to his&nbsp;\u201cretribution\u201d against&nbsp;law firms, higher&nbsp;education&nbsp;and media as&nbsp;proof&nbsp;of the president\u2019s \u201cproblem\u201d with the First Amendment.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">An earlier ruling from Young drew the Supreme Court\u2019s justices into the&nbsp;judiciary\u2019s&nbsp;fight with Trump.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">After Young blocked Trump from cancelling hundreds of millions of dollars in National Institutes of Health grants linked to diversity initiatives, the Supreme Court reversed, making way for the cuts.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Justice&nbsp;Neil Gorsuch, joined by Justice Brett Kavanaugh,&nbsp;accused the district judge of&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5492199-supreme-court-emergency-decisions-trump\/\"><u>seeking to \u201cdefy\u201d<\/u><\/a>&nbsp;an earlier emergency ruling the high court made in another&nbsp;grant cancellation case.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Young apologized&nbsp;from&nbsp;the bench, after which retired Justice&nbsp;Stephen Breyer&nbsp;gave a rare interview to The New York Times rejecting the notion that Young, whose rulings he reviewed as an appeals judge for years, would ever \u201cdeliberately defy\u201d the justices.&nbsp;Roberts remained mum.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-trump-cases-federal-judges-criticize-rcna221775\"><u>rare interviews with NBC News<\/u><\/a>,&nbsp;a dozen&nbsp;anonymous&nbsp;sitting&nbsp;judges&nbsp;appointed by&nbsp;Democratic and Republican presidents alike&nbsp;criticized&nbsp;the&nbsp;Supreme Court&nbsp;and&nbsp;Roberts&nbsp;for doing little to defend the integrity of their work against Trump and his allies\u2019 attacks, as violent threats rise.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The chief justice\u2019s&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/publicinfo\/year-end\/2025year-endreport.pdf\"><u>end-of-year report<\/u><\/a>&nbsp;on the federal judiciary&nbsp;made little mention&nbsp;of the judges\u2019 frustrations.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In the penultimate paragraph of&nbsp;a review&nbsp;more centered on history than current affairs,&nbsp;Roberts&nbsp;suggested looking to&nbsp;former President Coolidge\u2019s words for guidance on a path forward.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The nation\u2019s 30th&nbsp;president urged Americans to turn to the Declaration of Independence and Constitution for \u201csolace and consolation\u201d amid \u201call the clash of conflicting interests\u201d and the \u201cwelter of partisan politics.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cTrue then; true now,\u201d&nbsp;Roberts&nbsp;concluded.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a
