{"id":51548,"date":"2025-12-22T16:16:00","date_gmt":"2025-12-22T22:16:00","guid":{"rendered":"https:\/\/ustower.net\/?p=51548"},"modified":"2025-12-23T01:18:09","modified_gmt":"2025-12-23T07:18:09","slug":"democratic-states-sue-to-block-trumps-defunding-of-us-consumer-watchdog","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=51548","title":{"rendered":"Democratic states sue to block Trump\u2019s defunding of US consumer watchdog"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">Attorneys general from 21 states and DC argue defunding the Consumer Financial Protection Bureau is unlawful<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A coalition of Democratic-led states filed a lawsuit on Monday seeking to prevent Donald Trump\u2019s administration from defunding the US Consumer Financial Protection Bureau by refusing to request money from the&nbsp;<a href=\"https:\/\/www.theguardian.com\/business\/federal-reserve\">Federal Reserve<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Democratic attorneys general from 21 states and the District of Columbia filed the lawsuit in federal court in Oregon, arguing that the administration\u2019s decision not to seek additional funding for the US consumer watchdog is unlawful and undermines Congress\u2019s authority under the US constitution.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe administration\u2019s actions are a handout to those who drive up costs by cheating hardworking Americans, and I will keep fighting to ensure they follow the law and our constitution,\u201d New York attorney general Letitia James, a Democrat, said in a statement.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The CFPB did not immediately respond to a request for comment. Trump, a Republican, has sought to dismantle the CFPB since returning to office in January and has installed Russell Vought, his budget director, as the acting head of the agency. While efforts to fire most of its employees are tied up in litigation, Vought has effectively halted most CFPB activities.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The agency, which is tasked with protecting consumers in the financial sector, began operations in 2011 under Barack Obama after the 2008 financial crisis. It has since returned more than $21bn improperly taken from consumers, its supporters say.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It receives its funding directly from the Fed, unlike federal agencies for which Congress appropriates money annually. Last month, the CFPB under Vought\u2019s leadership said it could not request more money from the Fed because the Dodd-Frank Act of 2010 requires that funding come from the central bank\u2019s \u201ccombined earnings\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Since the Fed had been operating at a loss since 2022, the&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\">Trump administration<\/a>&nbsp;said no earnings were available. The CFPB in a 10 November court filing said it expected its funds would run out in early 2026. States led by California, Colorado, New Jersey, New York and Oregon said in Monday\u2019s lawsuit that denying funding would prevent the CFPB from meeting a legal obligation to provide them with consumer complaints.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">They said the administration\u2019s actions also violate the constitution\u2019s principle of separation of powers, since Congress created the agency and the process by which it is funded.
