{"id":51347,"date":"2025-12-17T20:21:00","date_gmt":"2025-12-18T02:21:00","guid":{"rendered":"https:\/\/ustower.net\/?p=51347"},"modified":"2025-12-18T00:26:37","modified_gmt":"2025-12-18T06:26:37","slug":"us-government-admits-negligence-in-helicopter-plane-collision-that-killed-67","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=51347","title":{"rendered":"US government admits negligence in helicopter-plane collision that killed 67"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">Official response to lawsuit filed by victims\u2019 relatives admits FAA and army failures played role in Washington DC crash<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The US government admitted Wednesday that the Federal Aviation Administration and the army played a role in causing&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/29\/aircraft-crash-ronald-reagan-airport-virginia\">the collision in January<\/a>&nbsp;between an airliner and a Black Hawk helicopter near the nation\u2019s capital, killing 67 people in the deadliest crash on American soil in more than two decades.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The official response to the first lawsuit filed by one of the victims\u2019 families said that the government is liable in the crash partly because the air traffic controller violated procedures about when to rely on pilots to maintain visual separation that night. Plus, the filing said, the army helicopter pilots\u2019 \u201cfailure to maintain vigilance so as to see and avoid\u201d the airline jet makes the government liable.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But the filing suggested that others, including the pilots of the jet and the airlines, may also have played a role. The lawsuit also blamed American Airlines and its regional partner, PSA Airlines, for roles in the crash, but those airlines have filed motions to dismiss.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">At least 28 bodies were pulled from the icy waters of the Potomac River after the helicopter apparently flew into the path of the American Airlines regional jet while it was landing at Ronald Reagan airport in northern&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/virginia\">Virginia<\/a>, just across the river from Washington, DC, officials said. The plane carried 60 passengers and four crew members, and three soldiers were aboard the helicopter.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Robert Clifford, one of the attorneys for the family of victim Casey Crafton, said the government admitted \u201cthe Army\u2019s responsibility for the needless loss of life\u201d and the FAA\u2019s failure to follow air traffic control procedures while \u201crightfully\u201d acknowledging others \u2013 American Airlines and PSA Airlines \u2013 also contributed to the deaths.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The families of the victims \u201cremain deeply saddened and anchored in the grief caused by this tragic loss of life\u201d, he said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The government\u2019s lawyers said in the filing that \u201cthe United States admits that it owed a duty of care to plaintiffs, which it breached, thereby proximately causing the tragic accident\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">An American Airlines spokesman declined to comment on the filing, but in the airlines motion to dismiss, the airline said \u201cplaintiffs\u2019 proper legal recourse is not against American. It is against the United States government \u2026 The court should therefore dismiss American from this lawsuit.\u201d The airline said that since the crash it has focused on supporting the families of the victims.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The National Transportation Safety Board will release its report on the cause of the crash early next year, but investigators have already highlighted a number of factors that contributed, including the helicopter flying 78ft higher (24m) than the 200ft (61m) limit on a route that allowed only scant separation between planes landing on Reagan\u2019s secondary runway and helicopters passing below. Plus, the NTSB said, the FAA failed to recognize the dangers around the busy airport even after 85 near misses in the three years before the crash.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Before the collision, the controller twice asked the helicopter pilots whether they had the jet in sight, and the pilots said they did and asked for visual separation approval so they could use their own eyes to maintain distance. FAA officials acknowledged at the NTSB\u2019s investigative hearings that the controllers at Reagan had become overly reliant on the use of visual separation.
