{"id":50778,"date":"2025-12-04T18:10:00","date_gmt":"2025-12-05T00:10:00","guid":{"rendered":"https:\/\/ustower.net\/?p=50778"},"modified":"2025-12-04T21:12:36","modified_gmt":"2025-12-05T03:12:36","slug":"doj-fails-to-secure-new-james-indictment-from-grand-jury","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=50778","title":{"rendered":"DOJ fails to secure new James indictment from grand jury"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">The Justice Department has failed to secure a new&nbsp;indictment&nbsp;against New York Attorney General&nbsp;<a href=\"https:\/\/thehill.com\/people\/letitia-james\/\"><u>Letitia James\u2002<\/u><\/a>(D) after its&nbsp;initial&nbsp;case against her was dismissed, a blunder for prosecutors who have trained their sights on the adversary of President Trump.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Justice Department officials&nbsp;sought&nbsp;to&nbsp;proceed&nbsp;with a fresh case against James, despite vowing at first to appeal the dismissal, after a judge found the appointment of Lindsey Halligan as acting U.S. attorney was unlawful.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But the panel of grand jurors returned a no bill on&nbsp;the charges pursued by prosecutors.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Spokespeople for the Justice Department and U.S. attorney\u2019s office for the Eastern District of Virginia declined to comment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/thehill.com\/people\/abbe-lowell\/\"><u>Abbe Lowell,<\/u><\/a>&nbsp;an attorney for James, said in a statement that the grand jury\u2019s refusal to reindict her is a \u201cdecisive rejection of a case that should never have existed in the first place.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cA federal court threw this case out after&nbsp;<a href=\"https:\/\/thehill.com\/people\/donald-trump\/\"><u>President Trump\u2002<\/u><\/a>illegally installed a U.S. Attorney to file baseless charges against Attorney General James that career prosecutors refused to bring. This should be the end of this case,\u201d Lowell said. \u201cIf they continue, undeterred by&nbsp;a court ruling and a grand jury\u2019s rejection of the charges, it will be a shocking assault on the rule of law and a devastating blow to the integrity of our justice system.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Halligan was the only prosecutor to present the&nbsp;initial&nbsp;case against James to a grand jury.&nbsp;<a href=\"https:\/\/www.wsj.com\/us-news\/law\/grand-jury-declines-to-indict-letitia-james-again-4cea7c40?gaa_at=eafs&amp;gaa_n=AWEtsqfdYBsPAJGQhTruZ85F0_dbN_5ZK3XsyTQFB2nXKwv-xadeefAyjoFsQ2i-RfI=&amp;gaa_ts=69321ae2&amp;gaa_sig=xSTguFFELcEOpp4G53ex_ZW3sXdY3g2V1hd8UF71leU0F1_YswjrLF_PDjU_v-tXyLjalHllmmdDf_5sYwrsJw==\"><u>Several\u2002outlets\u2002have reported<\/u><\/a>&nbsp;that, this time around, other&nbsp;<a href=\"https:\/\/www.ms.now\/news\/grand-jury-fails-to-re-indict-letitia-james\"><u>prosecutors were pulled in<\/u><\/a>&nbsp;to lay out the allegations against James, including one from Missouri. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The&nbsp;previous&nbsp;two-count&nbsp;indictment&nbsp;against James&nbsp;centered&nbsp;on her plans for a Virginia home and whether she lied about them, allowing her to obtain favorable loan terms that prosecutors&nbsp;claim&nbsp;would have saved her&nbsp;nearly $19,000&nbsp;over the life of the loan. She faced&nbsp;bank fraud&nbsp;and&nbsp;false&nbsp;statements&nbsp;charges.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">James has denied wrongdoing and cast herself as a target of selective and vindictive prosecution at the president\u2019s behest.&nbsp;&nbsp;James responded to the rejection by reiterating her stance that the charges against her are \u201cbaseless.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cIt is time for this unchecked weaponization of our justice system to stop,\u201d she said in a statement that expressed gratitude to the grand jury.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">She came into Trump\u2019s crosshairs after taking on his business empire in Manhattan, alleging in a 2022 lawsuit against him and the Trump Organization that he inflated his net worth for tax and insurance benefits.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A New York judge found Trump liable for fraud, and the president was hit with a penalty that ballooned to more than $500 million, including interest, before an appeals court&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5464605-trump-civil-fraud-takeaways\/\"><u>wiped it out<\/u><\/a>&nbsp;in August. Both James and Trump have appealed to the state\u2019s highest court.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">After career prosecutors in the Eastern District of Virginia declined to pursue charges against James and former FBI Director&nbsp;<a href=\"https:\/\/thehill.com\/people\/james-comey\/\"><u>James Comey,<\/u><\/a>&nbsp;another Trump foe, the president pressured Attorney General&nbsp;<a href=\"https:\/\/thehill.com\/people\/pam-bondi\/\"><u>Pam Bondi\u2002<\/u><\/a>to take legal action against his adversaries and suggested Halligan for the job.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A White House aide with no prosecutorial&nbsp;experience,&nbsp;Halligan was named to the office\u2019s top post. U.S. District Judge Cameron Currie ruled last week that she was never eligible for the job because Bondi\u2019s authority to install an interim U.S. attorney had expired, ending the cases against James and Comey.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Trump\u2019s White House claimed after the&nbsp;dismissals&nbsp;that the decision&nbsp;sought&nbsp;to shield the defendants from accountability, insisting the facts of their indictments had not changed.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">However, the judge left the door open for prosecutors to seek charges again by dismissing the cases in a manner that sometimes allows a do-over.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Justice Department is also reportedly mulling whether to&nbsp;try to&nbsp;reindict Comey, whose case was dismissed at the same time as James\u2019s.
