Former White House lawyer Ty Cobb\u2002<\/u><\/a>on Monday said the Justice Department\u2019s (DOJ) case against<\/u><\/a> former FBI Director James Comey\u2002<\/u><\/a>is \u201cdead\u201d due to missteps<\/u><\/a> made by Lindsey Halligan, U.S. Attorney for the Eastern District of Virginia, throughout the indictment<\/u><\/a>. <\/p>\n\n\n\n

\u201cI think it\u2019s dead for two reasons,\u201c Cobb said in an appearance on CNN. \u201cFirst, I think it\u2019s because of the illegal appointment that is before another judge, Judge Curry. But Magistrate Judge [William] Fitzpatrick\u2019s opinion today will be taught in law schools for 50 years as the epitome of prosecutorial misconduct.\u201c<\/p>\n\n\n\n

Fitzpatrick raised concerns with both the evidence presented by the prosecution<\/u><\/a> and concerns about the DOJ\u2019s attempt to undertake retribution efforts<\/u><\/a> on behalf of President Trump. <\/p>\n\n\n\n

\u201cHaving been requested by the government to review grand jury materials, the Court has identified two statements by the prosecutor to the grand jurors that on their face appear to be fundamental misstatements on the law that could compromise the integrity of the grand jury process,\u201d Fitzpatrick wrote in his 24-page ruling. <\/p>\n\n\n\n

\u201cBoth statements by the prosecutor are in response to questions by grand jurors and are directly related to communications involving Comey,\u201d he added. <\/p>\n\n\n\n

Cobb told CNN\u2019s \u201cErin Burnett\u2002<\/u><\/a>OutFront\u201c that Halligan was to blame<\/u><\/a> \u201cin large part\u201d for the errors. <\/p>\n\n\n\n

\u201cHer time in the grand jury is extraordinary. She told the grand jury, basically, that Comey didn\u2019t have a Fifth Amendment right at trial to refuse to testify,\u201d he told host Erin Burnett. \u201cAnd therefore, he would be able to give his explanation as to the events and counter the government\u2019s evidence, which the judge noted appropriately was burden shifting.\u201d<\/p>\n\n\n\n

\u201cAnd moreover, she told the grand jury in an extraordinary statement not to worry about the record with which they had been presented because the government had better evidence at trial,\u201d he continued. \u201cThat\u2019s like saying, \u2018Please indict this person because we don\u2019t have time to indict innocent people.\u2019 It\u2019s just way, way, way out of bounds.\u201d<\/p>\n\n\n\n

The former special counsel also noted that missteps could be a \u201cbasis\u201d for both Halligan and Attorney General Pam Bondi\u2002<\/u><\/a>to be disbarred. <\/p>\n\n\n\n

A federal grand jury\u2002indicted<\/u><\/a> Comey in September on charges of making a false statement and obstruction of a congressional proceeding in connection with testimony he gave before the Senate in 2020 related to the FBI\u2019s investigation into Russian interference in the 2016 election. He pleaded not guilty<\/u><\/a> last month.<\/p>\n\n\n\n

The former FBI chief has maintained that plea of innocence<\/u><\/a> and said he looks forward to defending himself at trial if that\u2019s what it comes to.<\/p>\n\n\n\n

\u201cMy family and I have known for years there are costs to standing up to Donald Trump. But we couldn\u2019t imagine ourselves living any other way,\u201d Comey said in a video previously posted to Instagram. \u201cWe will not live on our knees, and you shouldn\u2019t either.\u201d<\/p>\n\n\n\n

\u201cSomebody that I love dearly recently said that fear is the tool of a tyrant. And she\u2019s right,\u201d he continued, quoting what his daughter<\/u><\/a> Maurene Comey said after she was fired<\/u><\/a> as a federal prosecutor in July.<\/p>\n\n\n\n

\u201cBut I\u2019m not afraid, and I hope you\u2019re not either. I hope instead you are engaged. You are paying attention, and you will vote like your beloved country depends upon it, which it does,\u201d Comey added.<\/p>\n\n\n\n
