{"id":47827,"date":"2025-09-24T16:23:00","date_gmt":"2025-09-24T21:23:00","guid":{"rendered":"https:\/\/ustower.net\/?p=47827"},"modified":"2025-09-24T22:27:39","modified_gmt":"2025-09-25T03:27:39","slug":"judge-finds-trump-violated-law-in-firing-inspectors-general-but-allows-dismissal-to-stand","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=47827","title":{"rendered":"Judge finds Trump violated law in firing inspectors general, but allows dismissal to stand"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">A federal judge found that President Trump broke the law in firing a number of inspectors general early in his term, but the judge found she did not have the power to reinstate them to their jobs.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">U.S. District Court Judge Ana Reyes struck a sympathetic tone in the case, which was brought on behalf of eight of the nearly 20 inspectors general Trump has fired.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">But she said while Trump violated a law requiring he give 30 days\u2019 notice to Congress before firing any inspector general, the former watchdogs could not show they\u2019d been irreparably harmed.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cPresident Trump violated the IGA. That much is obvious. And Plaintiffs raise compelling arguments that the violation must be remedied through reinstatement to their positions,\u201d&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.277385\/gov.uscourts.dcd.277385.54.0_2.pdf\"><u>Reyes wrote<\/u><\/a>, referencing the Inspectors General Act.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">However, she said, Trump could simply fire them again by providing the required notice to Congress.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cBut under well-established case law that this Court is bound to follow, Plaintiffs must show irreparable harm. And they cannot,\u201d she wrote.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cEven assuming that the IGA comports with Article II, Plaintiffs\u2019 inability to perform their duties for 30 days is not irreparable harm. Moreover, if the IGs were reinstated, the President could lawfully remove them after 30 days by providing the required notice and rationale to Congress.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Just days after taking office, Trump&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/administration\/5109677-trump-inspectors-general-firings-oversight\/\"><u>fired some 17 inspectors general<\/u><\/a>, with each getting a short note saying the president had the right to do so under his Article II powers \u2014 the portion of the Constitution establishing the presidency.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Reyes\u2019s order resolves a case that has been pending since March, when the inspectors general asked the court to block their firings.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe Court recognizes Plaintiffs\u2019 exceptional service as IGs, marked by decades of distinguished leadership across multiple administrations. They sacrificed much to take on the role of an IG and its many demands\u2014no doubt including substantial time away from family and far larger paychecks available in the private sector,\u201d she wrote.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThey deserved better from their government. They still do. Unfortunately, this Court cannot provide Plaintiffs more.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">While Reyes denied the request for an injunction, she did not yet rule on another request from the fired inspectors general \u2014 whether to give them back pay, instead ordering additional briefings on the subject.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">At another turn, she summarized the argument from the inspectors general, who wrote that it was \u201cdecidedly wrong and decidedly contrary to the public interest\u201d to let protections for those who guard against waste, fraud and abuse be so easily flouted.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cYes, agreed,\u201d Reyes wrote.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5520345-trump-firing-inspectors-general\/\">thehill<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge found that President Trump broke the law in firing a number of inspectors general early in his term, but the judge found she did not have the power to reinstate them to their jobs.
