{"id":46103,"date":"2025-08-13T11:05:00","date_gmt":"2025-08-13T16:05:00","guid":{"rendered":"https:\/\/ustower.net\/?p=46103"},"modified":"2025-08-14T04:51:08","modified_gmt":"2025-08-14T09:51:08","slug":"new-york-sues-zelle-says-security-lapses-led-to-1-billion-consumer-fraud-losses","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=46103","title":{"rendered":"New York sues Zelle, says security lapses led to $1 billion consumer fraud losses"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">Summary<\/li>\n\n\n\n<li class=\"has-medium-font-size\">James says Zelle ignored basic anti-fraud safeguards<\/li>\n\n\n\n<li class=\"has-medium-font-size\">BofA, Chase, Wells Fargo, other banks own Zelle parent<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Zelle calls James&#8217; claims meritless, touts safety<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">NEW YORK, Aug 13 (Reuters) &#8211; Zelle was sued on Wednesday by New York Attorney General Letitia James, who said the electronic payment platform&#8217;s refusal to adopt critical safety features enabled fraudsters to steal more than $1 billion from consumers.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The lawsuit in a New York state court in Manhattan followed the U.S. Consumer Financial Protection Bureau&#8217;s decision in March to&nbsp;<a href=\"https:\/\/www.reuters.com\/legal\/us-cfpb-drops-zelle-case-against-jpmorgan-bofa-wells-fargo-2025-03-04\/\"><u>drop a similar case<\/u><\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That agency has ended most enforcement activity following U.S. President&nbsp;<a href=\"https:\/\/www.reuters.com\/world\/us\/donald-trump\/\"><u>Donald Trump&#8217;s<\/u><\/a>&nbsp;return to the White House.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Zelle was launched in 2017, and competes with apps such as PayPal&#8217;s&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/PYPL.O\"><u>(PYPL.O), opens new tab<\/u><\/a>&nbsp;Venmo and Block&#8217;s&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/XYZ.N\"><u>(XYZ.N), opens new tab<\/u><\/a>&nbsp;Cash App.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Its parent, Early Warning Services, is owned by seven large U.S. banks: Bank of America&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/BAC.N\"><u>(BAC.N), opens new tab<\/u><\/a>, Capital One&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/COF.N\"><u>(COF.N), opens new tab<\/u><\/a>, JPMorgan Chase&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/JPM.N\"><u>(JPM.N), opens new tab<\/u><\/a>, PNC&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/PNC.N\"><u>(PNC.N), opens new tab<\/u><\/a>, Truist&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/TFC.N\"><u>(TFC.N), opens new tab<\/u><\/a>, US Bank&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/USB.N\"><u>(USB.N), opens new tab<\/u><\/a>&nbsp;and Wells Fargo&nbsp;<a href=\"https:\/\/www.reuters.com\/markets\/companies\/WFC.N\"><u>(WFC.N), opens new tab<\/u><\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">James said Zelle&#8217;s parent and the banks knew for years that the platform was vulnerable to fraudsters but resisted basic safeguards, with the banks sometimes ignoring customer complaints while Zelle let fraudsters stay on the platform.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The result was &#8220;rampant&#8221; fraud that Zelle sometimes refused to address even after it occurred, despite its assurances it was a safe alternative to cash and checks and &#8220;backed by the banks, so you know it&#8217;s secure,&#8221; the complaint said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In a statement, Zelle said scams start when criminals trick people into sending money, rather than on the platform itself, and holding it liable could lead to higher fees for consumers.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Zelle also said more than 99.95% of transactions it handles are completed without reported fraud, leading the industry.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">&#8220;This lawsuit is a political stunt to generate press, not progress,&#8221; Zelle said. &#8220;The Attorney General should focus on the hard facts, stopping criminal activity and adherence to the law, not overreach and meritless claims.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Early Warning Services is based in Scottsdale, Arizona. The seven banks were not named as defendants.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>PUPPY, UTILITY BILL SCAMS<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">James said typical scams involved hacking into users&#8217; accounts and making unauthorized transfers, convincing users to send money for nonexistent goods and services, and impersonating banks, government offices and utilities.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">According to the complaint, one victim was told his electricity would be shut off unless he paid Con Edison $1,477 via Zelle, to an account named &#8220;Coned Billing.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Another victim said Chase and Zelle wouldn&#8217;t help him after he sent $2,600 in two installments via Zelle to buy a puppy, and realized he had been scammed when the purported seller demanded more money.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">James said it wasn&#8217;t until 2023, after the CFPB and several members of Congress began probes, that Zelle adopted &#8220;basic&#8221; safeguards it had proposed four years earlier.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">While reported fraud losses plummeted, the safeguards were &#8220;too little too late&#8221; for consumers who had lost money, and despite those safeguards Zelle still facilitates &#8220;substantial fraudulent activity,&#8221; the complaint said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">&#8220;No one should be left to fend for themselves after falling victim to a scam,&#8221; James said in a statement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The lawsuit seeks to require Zelle to beef up anti-fraud protections, and pay restitution and damages to defrauded New Yorkers.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">James&nbsp;<a href=\"https:\/\/www.reuters.com\/business\/finance\/new-york-sues-capital-one-cheating-savings-depositors-2025-05-14\/\"><u>sued Capital One<\/u><\/a>&nbsp;in May for allegedly cheating savings depositors out of millions of dollars in interest, and in June&nbsp;<a href=\"https:\/\/www.reuters.com\/sustainability\/boards-policy-regulation\/moneygram-settles-with-new-york-over-money-transfers-after-us-cfpb-quits-case-2025-06-16\/\"><u>settled claims against MoneyGram<\/u><\/a>&nbsp;over remittance transfer lapses.
