{"id":45402,"date":"2025-07-29T03:53:44","date_gmt":"2025-07-29T08:53:44","guid":{"rendered":"https:\/\/ustower.net\/?p=45402"},"modified":"2025-07-29T03:54:00","modified_gmt":"2025-07-29T08:54:00","slug":"justice-department-files-misconduct-complaint-against-judge-in-key-deportations-case","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=45402","title":{"rendered":"Justice Department files misconduct complaint against judge in key deportations case"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">WASHINGTON \u2014 The&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\">Justice Department<\/a>&nbsp;filed a complaint Monday alleging misconduct by a federal judge overseeing several cases involving the Trump administration, including a challenge to the legality of&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/judge-finds-probable-cause-hold-trump-administration-contempt-deportat-rcna201569\">deportation flights to El Salvador<\/a>&nbsp;in March.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The complaint against James Boasberg, the chief U.S. district judge in Washington, D.C., which was filed by Attorney General Pam Bondi&#8217;s chief of staff, Chad Mizelle, alleges that Boasberg made improper comments during a judicial conference in March.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cWhile there,\u201d Mizelle wrote, \u201cJudge\u202fBoasberg attempted to improperly influence Chief Justice Roberts and roughly two dozen other federal judges by straying from the traditional topics to express his belief that the Trump Administration would &#8216;disregard rulings of federal courts&#8217; and trigger &#8216;a constitutional crisis.'&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">NBC News hasn\u2019t verified the remarks, which Mizelle said Boasberg made on March 11. The conference wasn\u2019t open to the public.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAlthough his comments would be inappropriate even if they had some basis, they were even worse because Judge Boasberg had no basis,\u201d Mizelle added in his five-page letter to Chief Judge Sri Srinivasan of the U.S. Circuit of Court of Appeals in Washington.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Mizelle went on to say in the complaint that the Trump administration has complied with \u201call\u201d court orders and that Boasberg didn\u2019t identify any violations of court orders to justify what Mizelle called \u201chis unprecedented predictions.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Boasberg didn\u2019t immediately respond to a request for comment Monday night.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Bondi&nbsp;<a href=\"https:\/\/x.com\/agpambondi\/status\/1949974166205034753?s=46\">wrote on X<\/a>, \u201cToday at my direction, @TheJusticeDept filed a misconduct complaint against U.S. District Court Chief Judge James Boasberg for making improper public comments about President Trump and his Administration.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThese comments have undermined the integrity of the judiciary, and we will not stand for that,\u201d she added.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Boasberg is assigned to several notable cases involving the Trump administration, none more high-profile than the Alien Enemies Act case, which was filed in mid-March when three deportation flights took off from the United States en route to El Salvador. During an emergency hearing at the time, Boasberg ordered that any planes that were midair and bound for El Salvador return to the United States after Trump\u2019s executive order invoking the Alien Enemies Act for deportations was made public.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">He later found cause to initiate contempt proceedings to determine whether the Trump administration was in willful violation of court orders. An appeals court has paused the process, however.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cHaving assumed President Trump would defy court orders, Judge Boasberg issued a [temporary restraining order] and threatened sanctions\u2014all on a false premise,&#8221; the complaint says, noting that Boasberg spoke at the conference days before he ruled from the bench in the deportations case. &#8220;Such conduct violates litigants\u2019 trust in an impartial judiciary and falls below the standards that safeguard the integrity of the judiciary and public confidence in that integrity.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Mizelle asked Srinivasan to refer the matter to a special investigative committee to determine whether Boasberg\u2019s conduct constituted \u201cconduct prejudicial to the effective and expeditious administration of the business of the courts.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">He also asked that Boasberg\u2019s Alien Enemies Act case be reassigned to another judge while the investigation proceeds and that disciplinary action be imposed, including a public reprimand and referral to the Judicial Conference for consideration of impeachment\u001erelated recommendations, if the committee finds willful misconduct.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/justice-department-misconduct-complaint-judge-james-boasberg-rcna221642\">Nbcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>WASHINGTON \u2014 The&nbsp;Justice Department&nbsp;filed a complaint Monday alleging misconduct by a federal judge overseeing several cases involving the Trump administration, including a challenge to the legality of&nbsp;deportation flights to El Salvador&nbsp;in March.
