{"id":44227,"date":"2025-07-01T16:59:00","date_gmt":"2025-07-01T21:59:00","guid":{"rendered":"https:\/\/ustower.net\/?p=44227"},"modified":"2025-07-01T22:26:41","modified_gmt":"2025-07-02T03:26:41","slug":"judge-rejects-apples-bid-to-dismiss-doj-antitrust-case","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=44227","title":{"rendered":"Judge rejects Apple\u2019s bid to dismiss DOJ antitrust case"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">A federal judge on Monday rejected Apple\u2019s request to dismiss the Department of Justice\u2019s (DOJ) antitrust case against the iPhone maker in an early win for the agency.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">U.S. District Judge Julien Xavier Neals denied the effort by the tech giant to throw out the case, which accuses Apple of monopolizing the smartphone market by creating barriers to move outside of its ecosystem.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Apple argued the DOJ failed to properly allege its monopolization claims, while asserting the states that joined the case lack standing.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Neals sided with the government on both issues, finding the DOJ has properly laid out two markets over which Apple has and seeks to maintain monopoly power \u2014 the broader smartphone market and a narrower performance smartphone market that excludes lower-end phones. He also found the states have standing to sue.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The judge acknowledged Apple\u2019s argument that Google and Samsung remain \u201cpowerful competitors,\u201d not entirely dismissing them but suggesting \u201cthese are arguments that are better suited for the summary judgment stage.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWe believe this lawsuit is wrong on the facts and the law, and we will continue to vigorously fight it in court,\u201d an Apple spokesperson said in a statement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The DOJ declined to comment on the ruling.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The agency initially sued Apple in March 2024 alongside 16 states.
