Rep. LaMonica McIver, D-N.J., was indicted Tuesday on federal charges stemming from a confrontation with law enforcement<\/a> at an Immigration and Customs Enforcement detention center in Newark<\/a> last month.<\/p>\n\n\n\n

The interim U.S. attorney for New Jersey, Alina Habba, said on X<\/a> that a federal grand jury indicted McIver on three counts of \u201cforcibly impeding and interfering with federal law enforcement officers.\u201d<\/p>\n\n\n\n

\u201cWhile people are free to express their views for or against particular policies, they must not do so in a manner that endangers law enforcement and the communities those officers serve,\u201d Habba wrote.<\/p>\n\n\n\n

McIver called the legal proceedings \u201ca brazen attempt at political intimidation\u201d and said she will plead not guilty.<\/p>\n\n\n\n

\u201cThe facts of this case will prove I was simply doing my job and will expose these proceedings for what they are: a brazen attempt at political intimidation,” she said in a statement.<\/p>\n\n\n\n

“This indictment is no more justified than the original charges, and is an effort by Trump\u2019s administration to dodge accountability for the chaos ICE caused and scare me out of doing the work I was elected to do.\u201d<\/p>\n\n\n\n

McIver was indicted three weeks after the Justice Department filed charges\u2002<\/a>accusing of assaulting law enforcement at an ICE facility in Newark.<\/p>\n\n\n\n

McIver and two other New Jersey Democrats were visiting the ICE facility in May to conduct an oversight visit when a protest was taking place.<\/p>\n\n\n\n

Department of Homeland Security officials arrested<\/a> Newark Mayor Ras Baraka, at the time a Democratic candidate for governor, on trespassing charges, and a DHS spokesperson said at the time that they had \u201cstormed\u201d the facility.<\/p>\n\n\n\n

Habba\u2019s office later dropped the charges against Baraka, who on Tuesday lost his bid to be the Democratic nominee for governor<\/a>.<\/p>\n\n\n\n

McIver told reporters at the time that she had been \u201cassaulted by multiple ICE agents.\u201d<\/p>\n\n\n\n

The indictment alleges that McIver interjected during Baraka\u2019s arrest, yelling, \u201cHell no! Hell no!\u201d and that she \u201cattempted to thwart\u201d the arrest by putting her arms around Baraka.<\/p>\n\n\n\n

It goes on to say that McIver \u201cslammed her forearm\u201d into an officer and \u201creached out and tried to restrain\u201d the agent by \u201cforcibly grabbing him.\u201d It further alleges that she pushed past a second agent, \u201cusing each of her forearms to visibly strike\u201d him.<\/p>\n\n\n\n

Habba said Tuesday that two of the counts carry maximum penalties of eight years in prison and that the third count carries a one-year penalty.<\/p>\n\n\n\n

McIver\u2019s attorney, Paul Fishman, called the prosecution politically motivated.<\/p>\n\n\n\n

\u201cThe legal process will expose this prosecution for what it truly is \u2014 political retaliation against a dedicated public servant who refuses to shy away from her oversight responsibilities,\u201d he said in a statement. \u201cWe are eager to challenge these allegations head-on in court and fully expect the Congresswoman\u2019s exoneration.\u201d<\/p>\n\n\n\n

Lawmaker reactions Tuesday fell along party lines.<\/p>\n\n\n\n

Rep. Marjorie Taylor Greene, R-Ga., praised the indictment on X,<\/a> saying, \u201cthis is how it\u2019s done!! Way to go @AlinaHabba!!\u201d<\/p>\n\n\n\n

Sen. Andy Kim, D-N.J., meanwhile, called the indictment<\/a> an \u201cattempt at political intimidation,\u201d adding in on X that McIver \u201cand Congress won\u2019t back down from our jobs of oversight and holding this administration accountable.\u201d<\/p>\n\n\n\n
