{"id":40803,"date":"2025-04-09T19:59:00","date_gmt":"2025-04-10T00:59:00","guid":{"rendered":"https:\/\/ustower.net\/?p=40803"},"modified":"2025-04-09T22:23:22","modified_gmt":"2025-04-10T03:23:22","slug":"house-passes-bill-restricting-district-court-judges-from-issuing-nationwide-injunctions","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=40803","title":{"rendered":"House passes bill restricting district court judges from issuing nationwide injunctions"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">The House on Wednesday passed a bill restricting district court judges from issuing nationwide injunctions in a move that would vastly diminish the ability of courts to block President Trump\u2019s policies.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Dubbed the No Rogue Rulings Act, the legislation from Rep.&nbsp;<a href=\"https:\/\/thehill.com\/people\/darrell-issa\/\"><u>Darrell Issa\u2002<\/u><\/a>(R-Calif.) would limit judges to providing relief only to parties directly involved in the suit.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The bill passed in an 219-213 vote.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">It would&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/house\/5211685-house-republicans-federal-judges\/\"><u>bar district court judges<\/u><\/a>&nbsp;from issuing nationwide injunctions, even when the matter has an impact across the country \u2014 undercutting numerous lawsuits challenging Trump\u2019s directives.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cSince President Trump has returned to office, left-leaning activists have cooperated with ideological judges who they have sought out to take their cases and weaponize nationwide injunctions to stall dozens of lawful executive actions and initiatives,\u201d Issa said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThese sweeping injunctions represent judicial activism at the worst.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">To Democrats, however, a recent string of Trump losses in court reflects not rogue judges but rather the lawlessness of his actions.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cMy colleagues on the other side of the aisle want you to believe that somehow these nationwide injunctions being issued by courts across the country against Donald Trump\u2019s illegal and unconstitutional actions are unfair,\u201d Rep.&nbsp;<a href=\"https:\/\/thehill.com\/people\/pramila-jayapal\/\"><u>Pramila Jayapal\u2002<\/u><\/a>(D-Wash.) said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cHere\u2019s the message: If you don\u2019t like the injunctions, don\u2019t do illegal, unconstitutional stuff. That simple.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Both chambers have introduced bills to curb nationwide injunctions, but Republicans&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5232755-trump-administration-courts-restrict\/\"><u>picked up the mantle<\/u><\/a>&nbsp;this year after U.S. District Court James Boasberg temporarily barred the Trump administration from deporting Venezuelans to a Salvadoran prison under the Alien Enemies Act.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump has called for the judge\u2019s impeachment while other GOP voices have complained about the ability of one judge to hamstring a White House policy from being implemented across the country.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">But Democrats argue the injunctions properly protect from harm those across the country even if they are not directly involved in the suit.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Many have cited Trump\u2019s order attempting to block birthright citizenship for those not born to citizen parents. Judges appointed by presidents of both parties struck down the order, finding it violated the constitution\u2019s guarantee of citizenship for all born in the U.S.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Democrats argue it makes no sense that the parents of each child would need to sue individually.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cNationwide injunctions play an essential role in protecting our democracy and holding the political branches accountable. Without them, millions of people could be harmed by these illegal or unconstitutional government policies,\u201d Jayapal said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Judges have increasingly issued nationwide injunctions over the last 25 years, a trend accompanied by growing scrutiny of their legitimacy.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Judges issued six nationwide injunctions during President George W. Bush\u2019s administration, according to an analysis published in the&nbsp;<a href=\"https:\/\/harvardlawreview.org\/print\/vol-137\/district-court-reform-nationwide-injunctions\/\"><u>Harvard Law Review<\/u><\/a>. The number doubled to 12 during the Obama administration before skyrocketing to 64 during Trump\u2019s first term.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">During the Biden administration, the number of nationwide injunctions fell back to 14, a figure that has already been surpassed in a matter of weeks in the second Trump administration.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cJudges are asserting this authority by themselves, and it\u2019s an outrageous abuse of public trust and judicial power and opened the Pandora\u2019s box that threatens the constitutional order,\u201d said Rep. Tom McClintock (R-Calif).<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe congress is elected to make law. The president is elected to enforce it. The judiciary is appointed for the sole purpose of resolving cases and controversies brought to it by individual injured parties.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">But Democrats say that Trump \u2014 who has already issued more than 100 executive orders during his second term \u2014 has far surpassed his predecessors in seeking to shape policy through executive orders beyond the scope of his powers and crafting illegal policy.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cFederal judges have issued at least 68 court orders that block or pause the administration\u2019s lawlessness to prevent irreparable harm in the country from his unconstitutional actions. The judges deciding here were appointed by five different presidents \u2014 both Democratic presidents and Republican presidents,\u201d said Rep. Jamie Raskin (Md.), the top Democrat on the House Judiciary Committee.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Sen. Chuck Grassley (R-Iowa) has introduced a similar bill in the Senate that would also limit judicial rulings to the parties directly involved in the case.
