{"id":39990,"date":"2025-03-20T15:29:00","date_gmt":"2025-03-20T20:29:00","guid":{"rendered":"https:\/\/ustower.net\/?p=39990"},"modified":"2025-03-20T22:56:16","modified_gmt":"2025-03-21T03:56:16","slug":"gaza-protesters-sue-ucla-for-civil-rights-violations-after-brutal-attack-in-2024","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=39990","title":{"rendered":"Gaza protesters sue UCLA for civil rights violations after \u2018brutal attack\u2019 in 2024"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">Over 30 demonstrators accuse campus officials and police of wrongful arrests and negligence during demonstrations<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">More than 30 pro-Palestinian protesters at the University of California, Los Angeles (UCLA) sued campus officials and several law enforcement agencies, alleging civil rights violations, wrongful arrests and excessive force during&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/us-campus-protests\">demonstrations last year<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A lawsuit filed on Wednesday in Los Angeles superior court outlines the violence and significant injuries that UCLA Palestine Solidarity Encampment members experienced at the hands of police and counterprotesters from April to June of 2024.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/peoplevucla.com\/complaint\">complaint<\/a>&nbsp;accuses UCLA, the country\u2019s top-ranked public university, of negligence during counterprotesters\u2019 \u201cbrutal mob assault\u201d&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/commentisfree\/article\/2024\/may\/06\/ucla-protester-mob-attack\">against the encampment<\/a>&nbsp;on 30 April as officials failed to intervene. The&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/investigations\/2024\/05\/11\/ucla-protests-police-inaction-fights\/\">Washington Post<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.nytimes.com\/interactive\/2024\/05\/03\/us\/ucla-protests-encampment-violence.html\">New York Times<\/a>&nbsp;documented how law enforcement allowed hours of unchecked violence against pro-Palestinian demonstrators who, along with college activists across the US, had set up Gaza solidarity camps.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">No counterprotesters were arrested that night even though officers witnessed the attacks, which were \u201cbroadcast live to millions\u201d, the suit says: \u201cMob members violently assaulted protesters \u2026 breaking their bones, sexually assaulting them, burning their eyes with chemical munitions, punching them, hitting them with metal rods, poles, and boards, and hurling incendiary devices into the peaceful encampment.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/06\/university-california-antisemitism-gaza-israel\"><\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThis was four-plus hours of unmitigated violence while UCLA private security stood sometimes feet away and did nothing to protect the faculty, students and community members protesting genocide,\u201d said Thomas Harvey, a lawyer for the plaintiffs.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">On 1 May, the following day, UCLA asked the Los Angeles police department (LAPD) and&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/california\">California<\/a>&nbsp;highway patrol (CHP) to \u201cforcibly remove people expressing pro-Palestinian views\u201d, with officers hurling flashbangs, shooting projectiles at people\u2019s faces, beating and body-slamming protesters and arresting more than 200 of them, the suit says; protesters were still seeking medical attention from counterprotesters\u2019 attacks when police raided.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The suit alleges \u201csystemic anti-Palestinian bias\u201d at UCLA. The plaintiffs include students, faculty, legal observers, journalists and community supporters at the encampment. One is an unnamed Palestinian student who on 30 April was threatened with rape by counterprotesters and sprayed with chemical munitions, reminding her of scenes from her upbringing of \u201cillegal Zionist settlers storming the<strong>&nbsp;<\/strong>homes of Palestinians while the Israeli military stood by and watched or even facilitated\u201d, says the suit.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Binyamin Moryosef, a Jewish, Israeli-American undergraduate plaintiff, says he was \u201cviolently grabbed\u201d and zip-tied by police during a 10 June gathering even though officers hadn\u2019t ordered dispersal. Another Palestinian-American student also alleged he faced excessive force and suffered<strong>&nbsp;<\/strong>long-term shoulder injuries when he was detained that day.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Moryosef, a fourth-year English major, criticized the university for the \u201csilencing of Jewish voices that criticize Israel by erasing them from discussion\u201d at a press briefing on Thursday, saying: \u201cI\u2019ve been struggling to finish my final years here due to the stress and uncertainty surrounding whether I\u2019ll be further punished for practicing my first amendment rights.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Afnan Khawaja, a student plaintiff who recently graduated, said UCLA \u201cabandoned us to the chaos\u201d during the attacks by counterprotesters, telling reporters: \u201cThen they expected us to return to classrooms, as if trauma could be erased with coursework and syllabus \u2026 What is freedom of speech if students cannot speak their mind?\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The defendants include the UC regents, several UCLA administrators, LAPD, CHP and more than a dozen people lawyers have identified as counterprotesters.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Stett Holbrook, a spokesperson for the UC president\u2019s office, said in an email on Thursday that the university was recently notified of the suit and was \u201ccurrently gathering additional information\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe University of California unequivocally rejects all forms of hate, harassment and discrimination. Violence of any kind has no place at UC,\u201d Holbrook continued. \u201cWe have instituted system-wide reforms to promote safety and combat harassment and discrimination on our campuses. Our focus remains to maintain a UC that is safe and welcoming to all.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The complaint was filed amid the Trump administration\u2019s aggressive crackdown on pro-Palestinian activists and colleges, including investigations into&nbsp;<a href=\"https:\/\/www.insidehighered.com\/news\/quick-takes\/2025\/03\/11\/education-dept-warns-60-colleges-under-investigations\">60 universities<\/a>&nbsp;for alleged \u201cantisemitic discrimination\u201d. The US justice department this week&nbsp;<a href=\"https:\/\/www.latimes.com\/california\/story\/2025-03-18\/trump-court-action-supports-jewish-students-in-ucla-of-antisemitism-case\">filed documents<\/a>&nbsp;supporting Jewish students who have sued UCLA for discrimination.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Trump administration also&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/07\/trump-administration-cancels-columbia-university-funding\">canceled $400m in grants<\/a>&nbsp;to Columbia University, saying it failed to stop antisemitism, despite the institution&nbsp;<a href=\"https:\/\/www.theguardian.com\/commentisfree\/article\/2024\/may\/04\/columbia-university-student-protest-gaza\">suspending pro-Palestinian student groups<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/aug\/17\/campus-protest-rules\">facilitating arrests<\/a>. Immigration authorities recently&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/18\/mahmoud-khalil-statement-columbia\">detained Mahmoud Khalil<\/a>, a Palestinian activist at Columbia, even though he is a lawful permanent resident&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/15\/universities-columbia-trump\">not accused of a crime<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Activists at UCLA and other campuses say universities have made protesters vulnerable to Trump\u2019s attacks through last year\u2019s mass arrests and disciplinary processes. Harvey said he hoped the lawsuit would pressure UCLA to \u201cshow some courage and defend against what undoubtedly will be real pressure from the Trump administration to demonize their students, who they know very well are not antisemitic, violent or a threat to anyone\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Harvey said the suit aimed to expose the truth of what happened on campus, protect free expression at UCLA and secure compensation for plaintiffs and punitive damages: \u201cEveryone should be extremely concerned that at one of the major universities in the world, people were allowed to come on campus and beat and maim and yell racial epithets at people for hours with no effort by anyone at UCLA to stop it \u2026 That\u2019s under a Democratic president and Democratic mayor at what many people would think is a liberal university.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Graeme Blair, a UCLA political science professor and plaintiff, said the university\u2019s handling of protests had derailed students\u2019 studies and careers,&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/may\/30\/ucla-student-pro-palestinian-protesters-threat\">delaying diplomas<\/a>, leaving some with ongoing disciplinary cases and lingering threats of prosecution, and carrying lasting mental health impacts.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cMany individuals experienced life-altering physical injuries, including broken bones, rubber bullet wounds, vision problems from chemical irritants used during the mob attack,\u201d said Blair, a member of Faculty for Justice in Palestine, who was arrested on 2 May after he formed a line with faculty in an effort to \u201cprotect UCLA students from police violence\u201d, says the suit.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Blair and others have been diagnosed with PTSD, he added: \u201cI see how hard it is for some [activists] to move through the world right now when they still hold these strong opinions about the genocide in Gaza and UCLA\u2019s unwillingness to&nbsp;<a href=\"https:\/\/dailybruin.com\/2025\/03\/18\/protesters-rally-on-day-1-of-uc-regents-meetings-to-denounce-israeli-airstrikes\">negotiate<\/a>&nbsp;with them about&nbsp;<a href=\"https:\/\/apnews.com\/article\/california-regents-university-divestment-israel-a10e121cfa68badab77efc65d8ea1925\">divestment<\/a>&nbsp;while also having these physical and mental scars.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">UC\u2019s president, Michael Drake, last year&nbsp;<a href=\"https:\/\/www.universityofcalifornia.edu\/press-room\/university-california-campus-guidelines-determining-disciplinary-actions\">said<\/a>&nbsp;campuses \u201csupport and protect nonviolent and lawful protests\u201d, and defended designating the Palestine encampment&nbsp;<a href=\"https:\/\/www.universityofcalifornia.edu\/press-room\/statement-uc-president-michael-v-drake-md-free-speech-and-campus-protests\">unlawful<\/a>&nbsp;, saying officials must act when \u201cexpression blocks the ability of students to learn or to express their own viewpoints\u201d or threatens safety.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/20\/ucla-gaza-protests\">theguardian<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Over 30 demonstrators accuse campus officials and police of wrongful arrests and negligence during demonstrations More than 30 pro-Palestinian protesters at the University of California, Los Angeles (UCLA) sued campus officials and several law enforcement agencies, alleging civil rights violations, wrongful arrests and excessive force during&nbsp;demonstrations last year.
