{"id":39838,"date":"2025-03-17T15:05:00","date_gmt":"2025-03-17T20:05:00","guid":{"rendered":"https:\/\/ustower.net\/?p=39838"},"modified":"2025-03-17T22:08:33","modified_gmt":"2025-03-18T03:08:33","slug":"white-house-denies-violating-judges-order-with-venezuela-deportations","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=39838","title":{"rendered":"White House denies violating judge\u2019s order with Venezuela deportations"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump administration used Alien Enemies Act to deport about 250 alleged gang members to El Salvador<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The White House has denied allegations that it engaged in a \u201ca blatant violation\u201d of a judge\u2019s order by deporting about&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/16\/deportation-alleged-gang-members-el-salvador\">250 Venezuelan alleged gang members\u2002<\/a>to El Salvador on Saturday, with the US border czar appearing to contradict the denial on Monday by declaring: \u201cI don\u2019t care what the judges think.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The US district judge James E Boasberg has scheduled a hearing for Monday afternoon to demand an explanation about why his Saturday&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/16\/trump-administration-briefing-judge-halts-bid-to-use-18th-century-wartime-act-for-deportations\">order<\/a>&nbsp;temporarily blocking the deportation flights had apparently been ignored.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\">Trump administration<\/a>&nbsp;had ordered at least some of the deportations using the&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/16\/alien-enemies-act-explainer-can-trump-apply-a-wartime-law-to-deport-gang-members\">Alien Enemies Act<\/a>, a law from 1798 that is meant to be used during wartime. The president quietly invoked the law on Friday and progressive groups almost immediately sued to stop it.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">On Saturday, during a court hearing over the case, Boasberg added a&nbsp;<a href=\"https:\/\/apnews.com\/live\/donald-trump-news-updates-3-17-2025?utm_source=copy&amp;utm_medium=share\">verbal order<\/a>&nbsp;that any flights that had already departed with Venezuelan immigrants using the Alien Enemies Act turn around and return to the US.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThis is something that you need to make sure is complied with immediately,\u201d he told the justice department, according to the&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/immigration\/2025\/03\/15\/trump-alien-enemies-venezuela-migrants-deportations\/\">Washington Post<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">At that point (about 6.51pm ET, according to&nbsp;<a href=\"https:\/\/www.axios.com\/2025\/03\/16\/trump-white-house-defy-judge-deport-venezuelans\">Axios<\/a>), both flights were off the Yucat\u00e1n peninsula, according to flight paths&nbsp;<a href=\"https:\/\/x.com\/thcartwright\/status\/1901043693269680301\">posted on X<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Later on Saturday night, however, El Salvador\u2019s president, Nayib Bukele,&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/16\/deportation-alleged-gang-members-el-salvador\">confirmed<\/a>&nbsp;that the planes had landed in his country and the alleged gang members were in custody, posting on social media,&nbsp;<a href=\"https:\/\/x.com\/nayibbukele\/status\/1901238762614517965\">\u201cOopsie \u2026 too late\u201d<\/a>&nbsp;above a news article about the judge\u2019s order to turn the planes around.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">White House officials insisted that the migrants were no longer in US territory when the judge issued his order, claiming that it therefore did not apply.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The administration \u201cdid not \u2018refuse to comply\u2019 with a court order\u201d,&nbsp;<a href=\"https:\/\/x.com\/PressSec\/status\/1901584664906682833\">said<\/a>&nbsp;the White House press secretary, Karoline Leavitt, in a statement on Monday.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">She also argued, however, that the order itself did not need to be followed in the first place.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe order, which had no lawful basis, was issued after terrorist TdA aliens had already been removed from US territory,\u201d Leavitt said. \u201cThe written order and the administration\u2019s actions do not conflict.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cAs the supreme court has repeatedly made clear \u2013 federal courts generally have no jurisdiction over the president\u2019s conduct of foreign affairs, his authorities under the Alien Enemies Act, and his core Article II powers to remove foreign alien terrorists from US soil and repel a declared invasion.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cA single judge in a single city cannot direct the movements of an aircraft carrying foreign alien terrorists who were physically expelled from US soil.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Other Trump administration officials, who have not been named, echoed similar statements to&nbsp;<a href=\"https:\/\/www.axios.com\/2025\/03\/16\/trump-white-house-defy-judge-deport-venezuelans\">Axios<\/a>&nbsp;about the ruling coming too late, claiming that the administration did not defy the judge as the planes were \u201calready outside of US airspace\u201d and therefore arguing that the order was \u201cnot applicable\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In a court filing on Monday, lawyers for the administration said that the judge\u2019s oral order was \u201cnot enforceable\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/abcnews.go.com\/US\/trump-admin-ignores-judges-order-bring-deportation-planes\/story?id=119857181\">ABC News<\/a>&nbsp;also reported that the administration cited \u201coperational\u201d and \u201cnational security\u201d reasons that the planes needed to land, and that the two planes took off during the hearing on Saturday.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">When asked by a reporter on Sunday whether the administration violated the judge\u2019s orders, Donald Trump&nbsp;<a href=\"https:\/\/x.com\/trtworld\/status\/1901631103682949384\">said<\/a>: \u201cI don\u2019t know, you have to speak to the lawyers about that.\u201d He added: \u201cI can tell you this, these were bad people.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.reuters.com\/world\/us\/us-removes-hundreds-alleged-venezuelan-gang-members-under-now-blocked-authority-2025-03-16\/\">Reuters<\/a>&nbsp;reported that the Trump administration stated in a court filing on Sunday that \u201csome\u201d of the Venezuelans had already been removed from the US before the judge\u2019s order, but did not provide any further details.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/www.nytimes.com\/2025\/03\/16\/us\/constitutional-crisis.html?partner=slack&amp;smid=sl-share\">New York Times<\/a>&nbsp;noted that the filing implied that the government had other legal grounds for the deportations of the Venezuelans, other than the use of the Alien Enemies Act that was blocked by the judge.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The American Civil Liberties Union and Democracy Forward, which sued to stop the use of the act, added in a court filing on Monday that they believe that the government&nbsp;<a href=\"#block-67d82d028f08053850a262f9\">violated the court order , calling the administration\u2019s actions<\/a>&nbsp;a \u201cblatant violation of the court\u2019s order\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The rights groups&nbsp;<a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2025\/03\/AEA-Plaintiffs-Response-to-Govts-Notice.pdf\">asked the judge<\/a>&nbsp;to compel the administration to clarify whether any flights departed after the judge\u2019s orders, and to provide more information on the flight timings.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">On Monday morning,&nbsp;<a href=\"#block-67d83ba28f08fe269a7ebc89\">Boasberg scheduled a 4pm hearing<\/a>&nbsp;for the&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\">Trump administration<\/a>&nbsp;to explain if they defied his order.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Later on Monday morning, Tom Homan, Trump\u2019s \u201cborder czar\u201d, told reporters: \u201cBy the time the order came, the plane was already over international waters, with a plane full of terrorists and significant public safety threats.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">He added: \u201cTo turn the plane around over international waters\u201d and \u201ccome back with terrorists back to the United States, that\u2019s not what this president promised the American people\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">He followed up the remarks in an appearance on Fox and Friends, where&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/administration\/5198604-border-czar-trump-deportation\/\">according to the Hill<\/a>&nbsp;he said: \u201cI don\u2019t care what the judges think. I don\u2019t care.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">He repeated his claim that the flight was \u201calready in international waters\u201d but also questioned why the judge would want \u201cterrorists returned to the United States\u201d: \u201cLook, President Trump, by proclamation, invoked the authorities of the Alien Enemies Act, which he has a right to do, and it\u2019s a gamechanger.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Georgetown law professor Steve Vladeck&nbsp;<a href=\"https:\/\/bsky.app\/profile\/stevevladeck.bsky.social\/post\/3lkjhtgfmz22p\">criticised<\/a>&nbsp;the administration\u2019s argument that it was too late to act once the planes had left the US. He argued on social media that \u201ca federal court\u2019s jurisdiction does not stop at the water\u2019s edge\u201d but rather, \u201cthe question is whether the defendants are subject to the court order, not where the conduct being challenged takes place\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Vladeck also told the&nbsp;<a href=\"https:\/\/apnews.com\/article\/trump-venezuela-el-salvador-immigration-dd4f61999f85c4dd8bcaba7d4fc7c9af\">Associated Press<\/a>&nbsp;that although the judge\u2019s verbal directive to turn around the planes was not technically part of his final written order, nevertheless the Trump administration clearly violated the \u201cspirit\u201d of it.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Peter Markowitz, a Cardozo Law School professor and immigration enforcement expert,&nbsp;<a href=\"https:\/\/www.reuters.com\/world\/us\/us-removes-hundreds-alleged-venezuelan-gang-members-under-now-blocked-authority-2025-03-16\/\">told Reuters\u2002<\/a>that he believed the Trump administration\u2019s actions \u201cmost certainly violate\u201d the court\u2019s order.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/16\/alien-enemies-act-explainer-can-trump-apply-a-wartime-law-to-deport-gang-members\"><\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In a statement on Monday, the Democratic senators Alex Padilla, Cory Booker, Dick Durbin and Peter Welch condemned Trump\u2019s invocation of the Alien Enemies Act.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cLet\u2019s be clear: we are not at war, and immigrants are not invading our country,\u201d they said. \u201cFurthermore, courts determine whether people have broken the law \u2013 not a president acting alone, and not immigration agents picking and choosing who gets imprisoned or deported.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The deportations may not be the only instance of the White House directly violating a court order, after&nbsp;<a href=\"https:\/\/www.nytimes.com\/2025\/03\/16\/us\/brown-university-rasha-alawieh-professor-deported.html?smid=url-share\">the administration reportedly deported Dr Rasha Alawieh<\/a>, a kidney transplant specialist and Brown University professor, despite a court order temporarily blocking her expulsion.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Citing her attorney and court documents, the New York Times reported that the 34-year-old Lebanese citizen \u2013 who had a valid US visa \u2013 was detained on Thursday upon returning to the US after visiting family in Lebanon. A federal judge had reportedly ordered the government to provide the court with 48 hours\u2019 notice before deporting Alawieh, but she was reportedly put on a flight to Paris anyway.
