{"id":39387,"date":"2025-03-06T16:53:00","date_gmt":"2025-03-06T22:53:00","guid":{"rendered":"https:\/\/ustower.net\/?p=39387"},"modified":"2025-03-06T21:15:05","modified_gmt":"2025-03-07T03:15:05","slug":"court-rules-trumps-firing-of-labor-board-official-illegal-saying-president-is-not-a-king","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=39387","title":{"rendered":"Court rules Trump\u2019s firing of labor board official illegal, saying president is not a king"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">Judge orders reinstatement of Gwynne Wilcox to National Labor Relations Board after her removal by US president<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A federal court ruled that Donald Trump\u2019s&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/28\/gwynne-wilcox-trump-labor-board\">abrupt firing<\/a>&nbsp;of a former senior official at the top US labor watchdog was illegal, and&nbsp;<a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/Opinions.pl?2025\">ordered<\/a>&nbsp;that she be reinstated.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Gwynne Wilcox was the first member of the National Labor Relations Board to be removed by a US president since the board\u2019s inception in 1935.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The framers of the US constitution \u201cmade clear that no one in our system of government was meant to be king \u2013 the President included \u2013 and not just in name only\u201d, the judge Beryl A Howell, wrote in the&nbsp;<a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/Opinions.pl?2025\">ruling<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Howell presided over the hearing held on Wednesday on a motion for summary judgment in the District of Columbia. \u201cThe President does not have the authority to terminate members of the National Labor Relations Board at will, and his attempt to fire plaintiff from her position on the Board was a blatant violation of the law,\u201d she wrote.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cA president who touts an image of himself as a \u2018king\u2019 or a \u2018dictator,\u2019 perhaps as his vision of effective leadership, fundamentally misapprehends the role under Article II of the US Constitution,\u201d wrote Howell.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Article II of the US Constitution&nbsp;<a href=\"https:\/\/constitution.congress.gov\/constitution\/article-2\/\">outlines<\/a>&nbsp;the executive powers and responsibilities of the president. Howell continued, \u201cin our constitutional order, the president is tasked to be a conscientious custodian of the law, albeit an energetic one, to take care of effectuating his enumerated duties, including the laws enacted by the Congress and as interpreted by the Judiciary\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Wilcox&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/feb\/05\/gwynne-wilcox-nlrb-lawsuit-trump\">filed the lawsuit early last month<\/a>, alleging her removal was a \u201cblatant violation\u201d of the National Labor Relations Act, which stipulates that members of the board can only be removed for negligence or misconduct. Her removal left the board with only two members, lacking the quorum of at least three members required to rule on cases.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cI\u2019m ready to get back to work,\u201d said Wilcox after the hearing in a&nbsp;<a href=\"https:\/\/www.facebook.com\/aflcio\">speech<\/a>&nbsp;outside the courthouse today. \u201cIt\u2019s not just about me, but I\u2019m glad to be the face of this fight.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Her attorney, Deepak Gupta, noted this was the beginning of a long fight.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Wilcox was&nbsp;<a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1181\/vote_118_1_00215.htm\">confirmed<\/a>&nbsp;by the Senate in September 2023, and set to serve until August 2028. She sought a declaratory judgment ruling her removal unlawful and an injunction to permit her to complete her appointed term.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The White House has defended her removal, and that of the NLRB general counsel, claiming that \u201cthese were far-left appointees with radical records of upending longstanding labor law, and they have no place as senior appointees in the Trump administration\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">During the hearing, Howell noted that in court, the Trump administration claimed the law prohibiting removal of board members was unconstitutional.
