{"id":38779,"date":"2025-02-20T17:33:00","date_gmt":"2025-02-20T23:33:00","guid":{"rendered":"https:\/\/ustower.net\/?p=38779"},"modified":"2025-02-20T20:34:27","modified_gmt":"2025-02-21T02:34:27","slug":"noem-ends-protections-from-deportations-for-haitians","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=38779","title":{"rendered":"Noem ends protections from deportations for Haitians"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">The Department of Homeland Security (DHS) on Thursday moved to end deportation protections for Haitians in the U.S., likely teeing up legal challenges.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The memo seeks to end temporary protected status (TPS) for Haitians, which allows those unable to return to their country due to unrest or a natural disaster to remain in the U.S. without fear of deportation.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The directive from Homeland Security Secretary&nbsp;<a href=\"https:\/\/thehill.com\/people\/kristi-noem\/\"><u>Kristi Noem\u2002<\/u><\/a>would end the status for some 520,000 Haitians in the U.S.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Much like with an earlier directive that&nbsp;<a href=\"https:\/\/thehill.com\/policy\/national-security\/5113199-venezuelan-migrants-deportation-protections\/\"><u>\u201cvacated\u201d TPS for Venezuelans<\/u><\/a>, DHS purported to take the same action with regard to Haitians, blaming the prior administration for&nbsp;<a href=\"https:\/\/thehill.com\/latino\/4745949-biden-immigration-tps-haiti-mayorkas\/mlite\/\"><u>renewing the protections<\/u><\/a>&nbsp;in June.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201c[Former President]&nbsp;<a href=\"https:\/\/thehill.com\/people\/joe-biden\/\"><u>Biden\u2002<\/u><\/a>and [former Homeland Security Secretary Alejandro] Mayorkas attempted to tie the hands of the Trump administration by extending Haiti\u2019s Temporary Protected Status by 18 months\u2014far longer than justified or necessary,\u201d DHS said in a statement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWe are returning integrity to the TPS system, which has been abused and exploited by illegal aliens for decades.&nbsp;<a href=\"https:\/\/thehill.com\/people\/donald-trump\/\"><u>President Trump\u2002<\/u><\/a>and Secretary Noem are returning TPS to its original status: temporary.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">DHS pointed to the evolution of TPS for Haitians, which was first ignited in 2010, and about 57,000 registered for TPS the following year.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Haitians were first designated for TPS following a devastating 7.0 magnitude earthquake.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">However, the status was renewed under the Biden administration amid civil unrest after the assassination of Haitian President Jovenel Mo\u00efse in 2021.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">DHS was sued Thursday in two different lawsuits challenging the stripping of TPS protections for Venezuelans.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The method to strip TPS was the same for both groups, meaning Noem\u2019s actions on Haiti would likely face similar legal challenges.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe Secretary\u2019s actions are illegal for multiple reasons. At the outset, DHS has no authority to \u2018vacate\u2019 a prior TPS extension. The TPS statute tightly regulates the conditions under which TPS decisions can be made, setting time periods and other procedural rules that must be followed for both extensions and terminations,\u201d the National TPS Alliance wrote in its suit.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">It also said Noem\u2019s decision was based on her view that TPS is illegal, despite the creation of the status under law.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cNeither their disdain for TPS nor the Secretary\u2019s decision can nullify a statute,\u201d they wrote.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/thehill.com\/homenews\/administration\/5156280-dhs-revokes-haitian-temporary-protected-status\/\">thehill<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Department of Homeland Security (DHS) on Thursday moved to end deportation protections for Haitians in the U.S., likely teeing up legal challenges.
