{"id":37013,"date":"2025-01-09T20:15:00","date_gmt":"2025-01-10T02:15:00","guid":{"rendered":"https:\/\/ustower.net\/?p=37013"},"modified":"2025-01-09T21:02:07","modified_gmt":"2025-01-10T03:02:07","slug":"supreme-court-refuses-trumps-request-to-block-fridays-criminal-sentencing","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=37013","title":{"rendered":"Supreme Court refuses Trump\u2019s request to block Friday\u2019s criminal sentencing\u00a0"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">The Supreme Court in a 5-4 decision on Thursday refused President-elect Trump\u2019s request to halt his criminal sentencing, now just hours away, closing off Trump\u2019s last remaining pathway to avoid receiving his punishment for his 34-count felony conviction in New York.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">On Friday morning, Trump\u2019s hush money sentencing will secure his status as the first felon to assume the presidency. Trump can attend virtually, as Judge&nbsp;<a href=\"https:\/\/thehill.com\/people\/juan-merchan\/\"><u>Juan Merchan\u2002<\/u><\/a>is slated to hand down an unconditional discharge, a rare alternative to prison or probation that has no strings attached.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Chief Justice&nbsp;<a href=\"https:\/\/thehill.com\/people\/john-roberts\/\"><u>John Roberts\u2002<\/u><\/a>and Justice&nbsp;<a href=\"https:\/\/thehill.com\/people\/amy-coney-barrett\/\"><u>Amy Coney Barrett\u2002<\/u><\/a>joined with the court\u2019s three liberals to deny Trump\u2019s request.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Four of the court\u2019s conservatives, Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh, dissented.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Among other reasons, the&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/010925zr_2d8f.pdf\"><u>court in its order<\/u><\/a>&nbsp;indicated it was denying Trump\u2019s request because \u201cthe alleged evidentiary violations at President-Elect Trump\u2019s state-court trial can be addressed in the ordinary course on appeal.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cSecond, the burden that sentencing will impose on the President-Elect\u2019s responsibilities is relatively insubstantial in light of the trial court\u2019s stated intent to impose a sentence of \u2018unconditional discharge\u2019 after a brief virtual hearing,\u201d the order continued.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Speaking at a previously scheduled event at Mar-a-Lago minutes later, Trump said he read the court\u2019s order and highlighted how it noted his future appellate options.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cI read it, and I thought it was a fair decision, actually,\u201d Trump said. \u201cSo I\u2019ll do my little thing tomorrow. They can have fun with their political opponent.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Manhattan district attorney\u2019s office declined to comment on the decision.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Supreme Court\u2019s denial of Trump\u2019s emergency application caps his extensive efforts to stave off his sentencing.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">When a jury convicted him on 34 felonies in May, the proceeding was originally set for July. After the Supreme Court handed down its ruling carving out immunity for former presidents, however, Trump managed to effect multiple delays, eventually pushing the proceeding until after the election.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Once his political victory was secured, Trump re-upped his efforts and began advancing new arguments that, as president-elect, he should be immediately afforded the protections given to a sitting Oval Office occupant.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Merchan rejected both immunity arguments and days ago scheduled Trump\u2019s sentencing for Friday, stressing a desire for finality in the trial proceedings before the case likely freezes upon Trump\u2019s inauguration.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">This week, Trump\u2019s attorney filed a flurry of appeals even as Merchan signaled he would impose no punishment. The sentencing would still have the effect of officially labeling Trump a convicted felon.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe prospect of imposing sentence on President Trump just before he assumes Office as the 47th President raises the specter of other possible restrictions on liberty, such as travel, reporting requirements, registration, probationary requirements, and others\u2014all of which would be constitutionally intolerable under the doctrine of Presidential immunity,\u201d attorney D.
