{"id":36277,"date":"2024-12-23T18:27:00","date_gmt":"2024-12-24T00:27:00","guid":{"rendered":"https:\/\/ustower.net\/?p=36277"},"modified":"2024-12-23T21:34:18","modified_gmt":"2024-12-24T03:34:18","slug":"mixed-ruling-leaves-missouri-abortion-rights-in-limbo-despite-ballot-measure","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=36277","title":{"rendered":"Mixed ruling leaves Missouri abortion rights in limbo despite ballot measure"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">Judge said state\u2019s ban \u2018clearly contrary\u2019 to recently passed constitutional amendment but left other laws in place<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">More than two months after Missouri residents voted to add abortion rights into their state constitution and overturn the state\u2019s ban on the procedure, abortions have not yet resumed in&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/missouri\">Missouri<\/a>&nbsp;\u2013 and it\u2019s not clear when they will, according to a key Planned Parenthood official in the region.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The day after the election,&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/06\/missouri-abortion-rights-amendment\">Missouri Planned Parenthood affiliates filed a lawsuit<\/a>&nbsp;asking the court to eliminate a slew of abortion restrictions that, the affiliates said, made it impossible to perform the procedure. On Friday evening, the Jackson county circuit court judge Jerri Zhang ruled that several restrictions, including the state\u2019s near-total ban, were \u201cclearly contrary\u201d to the state\u2019s new constitutional amendment and could not be enforced.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">However, Zhang left other laws in place, including a requirement that abortion clinics be licensed by the&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/missouri\">Missouri<\/a>&nbsp;department of health and senior services. In order to obtain that license, clinics must have extra-large hallways and rooms. Planned Parenthood called those rules \u201cmedically unnecessary\u201d in court papers and said that many of its facilities do not meet those standards.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">As long as they are in place, Emily Wale, president of Planned Parenthood Great Plains, which operates in Missouri, is not sure when her clinics will be able to start performing abortions. The organization is now weighing its legal options \u2013 as it may ask Zhang to re-examine her ruling, go to a higher court seeking relief or attempt to apply for a license from the state.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe misperception people may have now is that we could just apply and reopen our doors,\u201d Wale said. But, she added: \u201cIt was so weaponized when we had to get licensure from the state. The state would delay. They would force us to litigate to get a license.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Two Planned Parenthood abortion clinics had to stop providing the procedure back in 2018 \u2013 years before the US supreme court overturned Roe v Wade in 2022 and allowed Missouri to ban almost all abortions \u2013 because the clinics could not come to licensing agreements with the Missouri state government.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Voters in seven states passed pro-abortion rights ballot measures in November, but abortion rights activists are now in the process of making those measures\u2019 promises real. Because the measures do not automatically strike down abortion restrictions, advocates are now hoping that lawsuits or new legislation may be used to do so. In Arizona, the state\u2019s attorney general, Kris Mayes, a Democrat,&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/03\/arizona-abortion-ban\">has agreed not to enforce<\/a>&nbsp;the state\u2019s 15-week abortion ban while litigation over Arizona\u2019s pro-abortion rights ballot measure plays out.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Unlike Arizona, however, Missouri\u2019s state government is dominated by Republicans. Despite voters\u2019 support for abortion rights, state lawmakers have already&nbsp;<a href=\"https:\/\/www.kansascity.com\/news\/politics-government\/article296568974.html\">filed at least 11 anti-abortion bills<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cI would have been more surprised if they hadn\u2019t,\u201d Mallory Schwarz, executive director of&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/abortion\">Abortion<\/a>&nbsp;Action Missouri, told the Guardian ahead of Friday\u2019s ruling. \u201cBut we have an opportunity to look forward. A big goal will be making sure people have access to accurate information, because part of what they\u2019re doing with all of these new attacks is trying to scare people. We know that fear and confusion itself is a barrier to care.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Zhang\u2019s mixed ruling has already left patients confused, according to Wale.
