{"id":36024,"date":"2024-12-17T13:03:00","date_gmt":"2024-12-17T19:03:00","guid":{"rendered":"https:\/\/ustower.net\/?p=36024"},"modified":"2024-12-17T20:02:11","modified_gmt":"2024-12-18T02:02:11","slug":"us-violating-law-to-fund-israel-despite-alleged-human-rights-abuses-lawsuit-says","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=36024","title":{"rendered":"US violating law to fund Israel despite alleged human rights abuses, lawsuit says"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">Suit claims state department is deliberately bypassing the Leahy Law by failing to sanction Israeli units accused of widespread atrocities in Palestinian territories<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The state department is facing a new lawsuit brought by Palestinians and Palestinian Americans accusing the agency of deliberately circumventing a decades-old US human rights law to continue funding&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/israel\">Israeli<\/a>&nbsp;military units accused of widespread atrocities in the occupied&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/palestinian-territories\">Palestinian territories<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The lawsuit, which was filed on Tuesday, marks the first time that victims of alleged human rights abuses are challenging the state department\u2019s failure to ever sanction an Israeli security unit under the Leahy Law, a 1990s-era law that prohibits&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/us-military\">US military<\/a>&nbsp;assistance to forces credibly implicated in gross human rights violations.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The plaintiffs include Amal Gaza<strong>,&nbsp;<\/strong>a pseudonym for a mathematics teacher from Gaza who has lost 20 family members; Shawan Jabarin, the director of the Palestinian human rights group Al-Haq, who endured six years of arbitrary detention in the West Bank; and Ahmed Moor, a Palestinian American with relatives in Gaza who have been repeatedly displaced by the ongoing Israeli offensive. (Moor has&nbsp;<a href=\"https:\/\/www.theguardian.com\/profile\/ahmed-moor\">written<\/a>&nbsp;opinion pieces for the Guardian.) Along with two other plaintiffs, they are demanding judicial intervention to force the US to comply with the law.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">With the death toll in Gaza since last October reportedly approaching 45,000 and humanitarian aid to the territory severely restricted, the legal challenge represents an attempt to force the administration to implement a law that has been seen as effective in helping the US to stem human rights violations by foreign military units in central America, Colombia, Nepal, and other countries.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Leahy Law was designed to prohibit foreign governments from providing US assistance to any security forces that the US identifies as being ineligible due to a gross violation of human rights. But, as one former state official told the Guardian earlier this year: \u201cThe rules were different for&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/israel\">Israel<\/a>.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The lawsuit was filed in&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/washington-dc\">Washington DC<\/a>&nbsp;district court.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Also taking part in the suit is Said Assali, a Palestinian American who had six family members killed in airstrikes in Gaza since the bombardments and incursions from Israel began last year.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cI\u2019ve had &#8230; immediate relatives, cousins and other family that have been murdered in Israeli airstrikes,\u201d Assali told the Guardian. \u201cAs an American, this is a clear violation of our laws, and it is violations the state department is carrying out actively and aggressively \u2013 and it\u2019s using our tax dollars.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The complaint hones in on a litany of alleged violations committed by Israeli military units with US support, including torture, prolonged detention without charge, forced disappearance, and what the plaintiffs describe as actions amounting to genocide in Gaza.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It references findings by international judicial bodies like the International Criminal Court that culminated in arrest warrants for the Israeli prime minister, Benjamin Netanyahu, and the former Israeli defense minister Yoav Gallant \u2013 findings that were rejected by the US. It also points to pre-7 October cases that led to investigations under the Leahy Law that were ultimately&nbsp;<a href=\"https:\/\/www.justsecurity.org\/98521\/netzah-yehuda-leahy-law\/\">dismissed by Secretary of State Antony Blinken<\/a>, such as the&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2022\/oct\/11\/family-of-palestinian-omar-abdalmajeed-asad-died-in-israeli-detention-rejects-claim-about-deal\">2022 death of 78-year-old Omar As\u2019ad<\/a>&nbsp;in the West Bank.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The state department declined to comment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2024\/jan\/18\/us-supply-weapons-israel-alleged-abuses-human-rights\">Guardian investigation<\/a>&nbsp;published in January found that top US officials had quietly reviewed more than a dozen incidents of alleged gross violations of human rights by Israeli security forces since 2020, but implemented special bureaucratic measures that have ultimately preserved access to US weapons for the allegedly responsible units. The investigation found that special mechanisms have been used over the last few years to shield Israel even as other allies\u2019 military units who receive US support \u2013 including, sources say, Ukraine \u2013 have privately been sanctioned and faced consequences for committing human rights violations.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In April, Reuters reported that some senior US officials&nbsp;<a href=\"https:\/\/www.reuters.com\/world\/middle-east\/some-us-officials-say-internal-memo-israel-may-be-violating-international-law-2024-04-27\/\">privately voiced their doubts<\/a>&nbsp;to Blinken about Israel\u2019s assurances that it was using US-supplied weapons in accordance with international humanitarian law. That same month, a&nbsp;<a href=\"https:\/\/www.politico.com\/newsletters\/national-security-daily\/2024\/05\/07\/more-resignations-over-israel-and-a-failed-policy-00156536\">coalition of 185 lawyers<\/a>&nbsp;in both the Biden administration and private sector argued that they believe Israel\u2019s military actions likely violate US humanitarian laws, a claim later repeated by&nbsp;<a href=\"https:\/\/www.politico.com\/newsletters\/national-security-daily\/2024\/11\/18\/fresh-protest-in-white-house-on-bidens-israel-policy-00183727\">20 White House staffers who dissented<\/a>&nbsp;in November.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The plaintiffs are represented by Dawn, a human rights advocacy group founded by Jamal Khashoggi, the Washington Post journalist murdered by Saudi Arabian agents.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThis is a historic effort to right the wrong of the state department\u2019s decades of refusal to obey the law requiring it to restrict military aid to abusive military units in Israel,\u201d said Sarah Leah Whitson, Dawn\u2019s executive director.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">She added: \u201cWhat the state department is asking the world to believe is that no Israeli unit has ever committed a gross violation of human rights. This flies in the face of mountains of human rights reports and journalistic investigations. It flies in the face of the state department\u2019s own human rights reports.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Despite a barrage of internal and external pressure, the&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/biden-administration\">Biden administration<\/a>&nbsp;has consistently&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/10\/09\/readout-of-president-joe-bidens-call-with-prime-minister-netanyahu-of-israel-9\/\">maintained its \u201cironclad\u201d support<\/a>&nbsp;for Israel. A state department panel recommended months ago&nbsp;<a href=\"https:\/\/www.propublica.org\/article\/israel-gaza-blinken-leahy-sanctions-human-rights-violations\">that Blinken block US aid<\/a>&nbsp;to several Israeli military and police units accused of serious human rights abuses, but the secretary of state has yet to act.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Biden for his part has long rejected calls to limit military support to Israel, other than&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2024\/09\/17\/remarks-by-vice-president-harris-in-a-conversation-with-the-national-association-of-black-journalists-philadelphia-pa\/\">once pausing a planned shipment<\/a>&nbsp;of 2,000lbs bombs. Congress has also rebuffed efforts to cut off aid, including a&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/nov\/20\/bernie-sanders-israel-gaza-resolution\">resolution<\/a>&nbsp;to block additional arms sales to Israel introduced by Bernie Sanders in November.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Assali himself acknowledges the uphill climb in challenging the United States government on Israel policy.
