Traynor on Monday&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ndd.65290\/gov.uscourts.ndd.65290.35.0_1.pdf\"><u>granted<\/u><\/a>&nbsp;Kansas, alongside 18 other states, a stay regarding a&nbsp;<a href=\"https:\/\/thehill.com\/latino\/4639985-biden-obamacare-dreamers-affordable-care-act-daca\/\"><u>final rule from<\/u><\/a>&nbsp;the&nbsp;<a href=\"https:\/\/thehill.com\/people\/joe-biden\/\"><u>Biden\u2002<\/u><\/a>administration allowing some Dreamers access to the ACA marketplace, according to court documents. He also granted Kansas and the other states a preliminary injunction barring the federal government \u201cenforcing the Final Rule against\u201d them.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In May, the Biden administration&nbsp;<a href=\"https:\/\/thehill.com\/latino\/4639985-biden-obamacare-dreamers-affordable-care-act-daca\/\"><u>announced the final rule<\/u><\/a>, from the Centers for Medicare and Medicaid Services (CMS) that would let active recipients of Deferred Action for Childhood Arrivals (DACA) enroll in a qualified or basic health plan under the ACA, as well as forms of financial assistance.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">DACA recipients have been considered not \u201clawfully present\u201d when it comes to health care law due to prior CMS rules, resulting in some recipients to fall out of coverage.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe authority granted to CMS by the ACA is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term \u201clawfully present,\u201d Traynor said in his Monday ruling.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A leader of those&nbsp;<a href=\"https:\/\/www.ag.ks.gov\/Home\/Components\/News\/News\/136\/1292\"><u>opposed to the final rule in the case<\/u><\/a>, Kansas Attorney General&nbsp;<a href=\"https:\/\/thehill.com\/people\/kris-kobach\/\"><u>Kris Kobach\u2002<\/u><\/a>(R), celebrated the ruling in a statement Monday.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThis decision is a big win for the rule of law,\u201d Kobach said. \u201cCongress never intended that illegal aliens should receive Obamacare benefits. Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws.
