{"id":35237,"date":"2024-11-28T02:35:00","date_gmt":"2024-11-28T08:35:00","guid":{"rendered":"https:\/\/ustower.net\/?p=35237"},"modified":"2024-11-28T02:06:33","modified_gmt":"2024-11-28T08:06:33","slug":"ohio-attorney-general-appeals-ruling-striking-down-statewide-abortion-ban","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=35237","title":{"rendered":"Ohio attorney general appeals ruling striking down statewide abortion ban"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">COLUMBUS, Ohio &#8212;&nbsp;Ohio&#8217;s attorney general will appeal a ruling that&nbsp;<a href=\"https:\/\/apnews.com\/article\/ohio-abortion-ban-ruling-e83ad0f1af11ded06d73d900bb240a04\">struck down<\/a>&nbsp;the most far-reaching of the state&#8217;s laws restricting&nbsp;<a href=\"https:\/\/apnews.com\/hub\/abortion\">abortion<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A county judge in October determined that last year\u2019s voter-approved amendment enshrining reproductive rights effectively made the so-called heartbeat law unconstitutional. The law banning most abortions once cardiac activity is detected \u2014&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-laws-government-and-politics-health-77c9ba98c4f4ab46fdbd5bcc47b5b938\">as early as six weeks<\/a>&nbsp;into pregnancy, before many women know they\u2019re pregnant \u2014 had been paused pending&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-ohio-voter-amendment-ff78c39a3919af7c41a2ce3fe4df9738\">the challenge<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Republican Attorney General Dave Yost on Friday filed a notice of appeal with the court. His office said there are provisions in the law that aren&#8217;t addressed in the constitutional amendment.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cIt is up to the courts to determine how conflicts between those two documents are resolved,&#8221; said Bethany McCorkle, a spokesperson for Yost.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Yost acknowledged in earlier court filings that the amendment rendered the Ohio ban unconstitutional, but sought to maintain other elements of&nbsp;<a href=\"https:\/\/apnews.com\/article\/0b1deb8c1f5d41d8ab4c9e32446a55ce\">the 2019 law<\/a>, including certain notification and reporting provisions.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Hamilton County Common Pleas Judge Christian Jenkins said in his ruling that retaining those provisions would have subjected doctors who perform abortions to felony criminal charges, fines, license suspensions or revocations, and civil claims of wrongful death \u2014 and required patients to make two in-person visits to their provider, wait 24 hours for the procedure and have their abortion recorded and reported.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/abcnews.go.com\/US\/wireStory\/ohio-attorney-general-appeals-ruling-striking-statewide-abortion-116283126\">abcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>COLUMBUS, Ohio &#8212;&nbsp;Ohio&#8217;s attorney general will appeal a ruling that&nbsp;struck down&nbsp;the most far-reaching of the state&#8217;s laws restricting&nbsp;abortion.
