{"id":34869,"date":"2024-11-18T03:12:04","date_gmt":"2024-11-18T09:12:04","guid":{"rendered":"https:\/\/ustower.net\/?p=34869"},"modified":"2024-11-18T03:12:26","modified_gmt":"2024-11-18T09:12:26","slug":"speaker-mike-johnson-leaves-the-door-open-to-recess-appointments","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=34869","title":{"rendered":"Speaker Mike Johnson leaves the door open to recess appointments"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">House Speaker Mike Johnson on Sunday left the door open to adjourning Congress so President-elect Donald Trump can appoint his Cabinet nominees outside of the usual Senate confirmation process if necessary.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWe\u2019re in a time of very divided government and a very partisan atmosphere in Washington. I wish it were not. I wish the Senate would simply do its job of advise and consent and allow the president to put the persons in his Cabinet of his choosing. But if this thing bogs down, it would be a great detriment to the country, to the American people,\u201d Johnson, R-La., told \u201cFox News Sunday\u201d in response to a question about whether he\u2019d be willing to let Trump use the recess appointment process, rather than the traditional Senate confirmation process for certain nominees.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A&nbsp;recess&nbsp;appointment&nbsp;occurs when a president unilaterally bypasses the Senate\u2019s responsibility to confirm Cabinet nominees and appoints them to the job during a period when both the House and Senate are not in session for at least 10 days.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Johnson said Sunday, \u201cWe\u2019ll evaluate all that at the appropriate time, and we\u2019ll make the appropriate decision. There may be a function for that. We\u2019ll have to see how it plays out.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">He added, \u201cI\u2019m sympathetic to all these arguments. As I said, we\u2019ll have to see how this develops. I am very hopeful, very hopeful, that the Senate will do its job, and that is, provide its advice and consent and move these nominees along.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">To allow the recess appointment process to take place, the House and Senate would have to both vote to adjourn for a period of at least 10 days, which would either require them to agree unanimously to do so, or would require both chambers to vote on a concurrent resolution to adjourn for a specific amount of time.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Both chambers usually gavel in for pro forma sessions even during times of recess specifically to prevent the president from making recess appointments and bypassing congressional approval.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">President Barack Obama once tried to use recess appointments and&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/supreme-court-rebukes-obama-on-recess-appointments\/2014\/06\/26\/e5e4fefa-e831-11e3-a86b-362fd5443d19_story.html\" target=\"_blank\" rel=\"noreferrer noopener\">was rebuked by the Supreme Court<\/a>, which said in 2014 that recesses needed to be 10 days or longer for recess appointments to be legal.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Johnson isn\u2019t the only Trump ally who has left the door open to using a recess appointment to confirm Trump\u2019s Cabinet picks.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Also on Sunday, Oklahoma GOP Sen. Markwayne Mullin told NBC News\u2019 \u201cMeet the Press\u201d that confirming some of Trump\u2019s picks would be a \u201cvery difficult\u201d process, and thus recess appointments would be a \u201clast resort.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cIt\u2019d be the absolute last resort,\u201d Mullin said. \u201cBut if that\u2019s what we have to do to get the confirmation through, then absolutely, let\u2019s do it. But I would say that would be last option.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">House Minority Leader Hakeem Jeffries, D-N.Y., said Sunday that Democrats would try to push against GOP efforts to make recess appointments, telling NBC News\u2019 \u201cMeet the Press\u201d that if Republicans try to bypass the usual Senate confirmation process, \u201cwe will work very closely with our Senate Democratic colleagues. I have great trust and respect in [Senate Majority] Leader Chuck Schumer and [Senate Judiciary Committee Chairman] Dick Durbin to make sure that no end runs can be done.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">On Sunday, Johnson also spoke about Trump\u2019s pick for attorney general, GOP former Rep. Matt Gaetz.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Gaetz is under scrutiny after he resigned from the House last week in the wake of his nomination to Trump\u2019s Cabinet.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">While serving in Congress, he was the subject of an investigation by the House Ethics Committee into allegations that he had sex with a 17-year-old girl. Gaetz has repeatedly denied the allegations, but senators on both sides of the aisle&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/majority-senate-republicans-doubt-matt-gaetz-confirm-attorney-general-rcna180464\" target=\"_blank\" rel=\"noreferrer noopener\">have called for the committee<\/a><a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/majority-senate-republicans-doubt-matt-gaetz-confirm-attorney-general-rcna180464\" target=\"_blank\" rel=\"noreferrer noopener\">\u2019<\/a><a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/majority-senate-republicans-doubt-matt-gaetz-confirm-attorney-general-rcna180464\" target=\"_blank\" rel=\"noreferrer noopener\">s report to be released publicly<\/a>&nbsp;or shared with them privately ahead of his confirmation vote.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Johnson had previously advocated against the release of the report and on Sunday told CNN, \u201cWhat I have said with regard to the report is that it should not come out, and why, because Matt Gaetz resigned from Congress. He is no longer a member. There\u2019s a very important protocol and tradition and rule that we maintain that the House Ethics Committee\u2019s jurisdiction does not extend to nonmembers of Congress.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">He added that senators will \u201chave a rigorous review and vetting process in the Senate, but they don\u2019t need to rely upon a report or a draft report, a rough draft report that was prepared by the Ethics Committee for its very limited purposes.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Johnson also said that he has not spoken to the president-elect about the ethics report.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cI have literally not discussed one word about the ethics report, not once, and I\u2019ve been with him quite a bit this week,\u201d Johnson said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/mike-johnson-leaves-door-open-recess-appointments-trump-cabinet-rcna180540\">nbcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>House Speaker Mike Johnson on Sunday left the door open to adjourning Congress so President-elect Donald Trump can appoint his Cabinet nominees outside of the usual Senate confirmation process if necessary. \u201cWe\u2019re in a time of very divided government and a very partisan atmosphere in Washington.
