{"id":34449,"date":"2024-11-07T03:44:00","date_gmt":"2024-11-07T09:44:00","guid":{"rendered":"https:\/\/ustower.net\/?p=34449"},"modified":"2024-11-07T04:46:38","modified_gmt":"2024-11-07T10:46:38","slug":"what-trumps-victory-could-mean-for-the-future-of-abortion-rights","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=34449","title":{"rendered":"What Trump&#8217;s victory could mean for the future of abortion rights"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">President-elect Donald Trump\u2019s victory in an election in which&nbsp;<a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/abortion-ballot-issue-states-drives-votes-rcna176436\" target=\"_blank\" rel=\"noreferrer noopener\">abortion rights were a heavy focus<\/a>&nbsp;raises major questions about what might come next for abortion access in the U.S.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">During the final stages of his campaign, Trump said he thought states should determine their own abortion policies. But his&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trumps-many-abortion-positions-timeline-rcna146601\" target=\"_blank\" rel=\"noreferrer noopener\">position on the issue has varied widely<\/a>&nbsp;\u2014&nbsp;in a March interview, he signaled&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/trump-signals-support-15-week-abortion-ban-rcna144213\" target=\"_blank\" rel=\"noreferrer noopener\">support for a nationwide ban<\/a>&nbsp;on abortions after 15 weeks\u2019 gestation, and as president, he supported&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/house-passes-late-term-abortion-ban-pushed-gop-n807286\" target=\"_blank\" rel=\"noreferrer noopener\">a House bill<\/a>&nbsp;that would have banned abortion nationwide after 20 weeks. During his 2016 campaign, Trump pledged to appoint Supreme Court justices who could help overturn Roe v. Wade. As president, he accomplished that goal and&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-was-able-kill-roe-v-wade-rcna84897\" target=\"_blank\" rel=\"noreferrer noopener\">has at times boasted about it<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Meanwhile, Vice President-elect JD Vance has suggested that he would&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/womens-health\/jd-vance-abortion-stance-rcna162086\" target=\"_blank\" rel=\"noreferrer noopener\">support a national law limiting abortion<\/a>. More recently, he adopted Trump\u2019s stance of letting states decide.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Trump campaign didn\u2019t respond to a request for comment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Because of those inconsistencies, policy experts said, there\u2019s no clear road map for the future of abortion in a&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/live-blog\/presidential-election-trump-harris-2024-live-updates-rcna178894\" target=\"_blank\" rel=\"noreferrer noopener\">second Trump administration<\/a>&nbsp;\u2014 though they offered some theories.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A national abortion ban, if approved by Congress, would override state-level protections, including the&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/abortion-rights-ballot-measures-pass-7-states-fail-3-others-rcna178718\" target=\"_blank\" rel=\"noreferrer noopener\">seven ballot measures that passed Tuesday<\/a>. But even if Republicans&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/battle-control-house-democrats-republican-government-rcna178981\" target=\"_blank\" rel=\"noreferrer noopener\">win control of the House<\/a>, as well, that kind of federal restriction is unlikely, four experts said. Trump has said&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/trump-says-wont-sign-federal-abortion-ban-dodging-veto-questions-rcna170536\" target=\"_blank\" rel=\"noreferrer noopener\">he wouldn\u2019t sign such a ban<\/a>. (He has declined to say, however, whether he would veto one if it landed on his desk.)&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">More likely, experts suggested, are efforts to restrict access to abortion pills, especially when they are administered through telehealth or delivered by mail. Medication abortions accounted for 63% of all abortions in the country last year,&nbsp;<a href=\"https:\/\/www.guttmacher.org\/2024\/03\/medication-abortion-accounted-63-all-us-abortions-2023-increase-53-2020#:~:text=Medication%20Abortion%20Accounted%20for%2063,53%25%20in%202020%20%7C%20Guttmacher%20Institute\" target=\"_blank\" rel=\"noreferrer noopener\">according to a March study by the Guttmacher Institute<\/a>, a research organization that supports abortion access.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe threats to medication abortion is what we\u2019re going to be watching most closely, especially in the first months and year of his administration,\u201d said Amy Friedrich-Karnik, director for federal policy at the Guttmacher Institute.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tuesday\u2019s election results signaled continuing public support for abortion rights overall. Ballot measures to protect abortion access passed&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/abortion-rights-ballot-measures-pass-7-states-fail-3-others-rcna178718\" target=\"_blank\" rel=\"noreferrer noopener\">in seven of 10 states<\/a>;&nbsp;in Arizona and Missouri, those victories overturned existing restrictions, while the five other states that passed such initiatives didn\u2019t previously restrict abortion.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In Florida, an abortion-rights measure got 57% of the vote but failed because state law required at least 60%. South Dakota and Nebraska, meanwhile, were the first two states since the Supreme Court\u2019s Dobbs decision in 2022 where majorities of voters rejected proposed constitutional amendments to protect abortion access. (An\u00a0<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/abortion-ads-nebraska-health-alert-controversy-rcna177845\" target=\"_blank\" rel=\"noreferrer noopener\">opposing ballot initiative in Nebraska<\/a>, which passed, may have confused some voters there, Friedrich-Karnik said.)<a href=\"https:\/\/www.facebook.com\/sharer\/sharer.php?u=https:\/\/www.today.com\/video\/amendments-to-protect-abortion-rights-pass-in-7-of-10-states-223695941729\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><a href=\"https:\/\/twitter.com\/intent\/tweet?text=undefined&amp;via=nbcnews&amp;url=https:\/\/www.today.com\/video\/amendments-to-protect-abortion-rights-pass-in-7-of-10-states-223695941729&amp;original_referer=https:\/\/www.today.com\/video\/amendments-to-protect-abortion-rights-pass-in-7-of-10-states-223695941729\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><a href=\"mailto:?subject=Amendments%20to%20protect%20abortion%20rights%20pass%20in%207%20of%2010%20states&amp;body=https:\/\/www.today.com\/video\/amendments-to-protect-abortion-rights-pass-in-7-of-10-states-223695941729\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Given those outcomes, as well as past voter support for abortion rights, many Republican senators might be wary of supporting a federal ban, experts say.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cRepublican politicians have been running away from their staunch anti-abortion policies for the past two years because of how popular, it is clear, that abortion access is,\u201d said Katie O\u2019Connor, senior director of federal abortion policy at the National Women\u2019s Law Center.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But several experts described other paths to abortion restrictions that wouldn\u2019t necessarily involve Congress.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">One option is via Trump\u2019s appointees to the Food and Drug Administration. Those leaders could try to get the agency to roll back certain changes made from 2016 to 2021 (in three presidential administrations, including Trump\u2019s) that expanded access to the abortion medication mifepristone. That could include reinstituting a requirement that abortion pills be dispensed in person. The FDA\u2019s new leaders could also try to rescind the licensing of the drug.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Another path is for Trump appointees to the Justice Department to choose not to defend abortion pill access when legal challenges arise. Although the Supreme Court&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/abortion-pill-access-still-face-challenges-supreme-court-decision-rcna157053\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed a case<\/a>&nbsp;in June that sought to restrict access to mifepristone, the attorneys general of Idaho, Kansas and Missouri filed a similar suit last month.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Both cases were filed in a federal court in Amarillo, Texas, where&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/federal-courts-make-harder-judge-shop-was-done-abortion-pill-case-rcna143060\" target=\"_blank\" rel=\"noreferrer noopener\">the sole judge, Matthew Kacsmaryk, is a Trump appointee<\/a>. Kacsmaryk previously ruled to&nbsp;<a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/abortion-pill-case-texas-judge-halts-access-mifepristone-rcna72117\" target=\"_blank\" rel=\"noreferrer noopener\">suspend the FDA\u2019s approval of the mifepristone<\/a>, a decision higher courts overruled. But if Kacsmaryk rules the same way again, legal experts said, Trump\u2019s Justice Department could choose not to appeal, thereby allowing the ruling to take effect.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Another option for Trump\u2019s Justice Department: threaten to enforce the Comstock Act, an 1873 law that prohibits mailing and receiving &#8220;obscene&#8221; materials and those designed or intended to procure an abortion.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A broad interpretation of the Comstock Act might allow the Justice Department to hold people criminally liable for administering surgical and medication abortions, since it could be argued that the law doesn\u2019t allow distribution of abortion pills or medical equipment used in abortion procedures. The penalty for violating the act is up to five years in prison.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAll it takes is one person in the DOJ or some zealous U.S. attorney to threaten a clinic with criminal sanction under the Comstock Act, and that could potentially cause a tremendous chill among health care providers that are providing abortion,\u201d said Wendy Parmet, director of the Center for Health Policy and Law at Northeastern University in Boston.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Justice Department could also use the Comstock Act to threaten legal action against the manufacturers of abortion pills.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">However, O\u2019Connor said she doesn\u2019t foresee those strategies\u2019 being successful.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAny attempts to misuse that law to ban abortion nationwide, whether that\u2019s banning medication abortion or all abortions nationwide, would be met with really fierce opposition, both politically and legally,\u201d she said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Friedrich-Karnik said that at the very least, Trump could reinstate some of the policies implemented during his previous administration that made abortions harder to obtain, like a rule prohibiting providers who receive certain federal grant money from referring patients for abortion care.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cA lot of the policies that were in place in the first Trump administration that were then dismantled by the Biden administration \u2014 we would expect all those policies to come back,\u201d she said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/www.nbcnews.com\/health\/womens-health\/abortion-rights-under-trump-rcna178998\">nbcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President-elect Donald Trump\u2019s victory in an election in which&nbsp;abortion rights were a heavy focus&nbsp;raises major questions about what might come next for abortion access in the U.S.&nbsp; During the final stages of his campaign, Trump said he thought states should determine their own abortion policies.
