{"id":34178,"date":"2024-11-01T04:51:09","date_gmt":"2024-11-01T09:51:09","guid":{"rendered":"https:\/\/ustower.net\/?p=34178"},"modified":"2024-11-01T04:51:12","modified_gmt":"2024-11-01T09:51:12","slug":"mcdonalds-faces-proposed-class-action-lawsuit-over-e-coli-outbreak","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=34178","title":{"rendered":"McDonald&#8217;s faces proposed class action lawsuit over E. coli outbreak"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">A proposed class action lawsuit was filed Tuesday against McDonald\u2019s, the latest litigation over the&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/cdc-says-slivered-onions-are-likely-cause-mcdonalds-e-coli-infections-rcna177777\">E. coli outbreak<\/a>&nbsp;linked to the fast-food chain\u2019s Quarter Pounders.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The complaint, which needs court certification to proceed as a class action, seeks damages exceeding $5 million for customers across the country who purchased contaminated Quarter Pounders. It alleges that McDonald\u2019s failed to properly disclose that there was a risk of E. coli associated with its menu items.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cMcDonald\u2019s has a responsibility to source its products that it is going to serve other people from safe facilities,\u201d said Roy Willey, the attorney representing the plaintiffs. \u201cIn the event that they cannot guarantee that, then they have a responsibility to warn, \u2018perhaps this product may be dangerous.\u2019\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">No \u201creasonable consumer\u201d would pay for Quarter Pounders if they knew they were contaminated with a pathogen, Willey added.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cMcDonald&#8217;s has a responsibility to step up, reimburse people and do better,\u201d he said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The lawsuit was filed on behalf of Amanda McCray of Chicago and William Michael Kraft of Davie, Florida \u2014 customers who purchased Quarter Pounders earlier this month and then experienced \u201cmany of the symptoms associated with E. coli infection,\u201d according to the complaint, which did not specify how ill they became.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">McDonald\u2019s declined to comment Wednesday on the lawsuit, which was filed in the Northern District of Illinois. The chain, headquartered in Chicago, has apologized to customers and&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=HZqTUqfY_iw\">vowed to regain their trust<\/a>&nbsp;following the outbreak.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThe issue appears to be contained to a particular ingredient and geography, and we remain very confident that any contaminated product related to this outbreak has been removed from our supply chain and is out of all McDonald\u2019s restaurants,\u201d McDonald\u2019s North America chief supply chain officer Cesar Pi\u00f1a&nbsp;<a href=\"https:\/\/corporate.mcdonalds.com\/corpmcd\/our-stories\/article\/always-putting-food-safety-first.html\">said in a statement on Sunday,<\/a>&nbsp;adding that testing of Quarter Pounder beef patties showed no detection of E. coli.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Both McDonald\u2019s and the&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/cdc-says-slivered-onions-are-likely-cause-mcdonalds-e-coli-infections-rcna177777\">Centers for Disease Control and Prevention<\/a>&nbsp;have said that the most likely source of the contamination&nbsp;<a href=\"https:\/\/corporate.mcdonalds.com\/corpmcd\/our-stories\/article\/always-putting-food-safety-first.html\">appears to be<\/a>&nbsp;slivered onions that came from one supplier, Taylor Farms, and were served on Quarter Pounders. McDonald\u2019s has removed the onions from its restaurants.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Taylor Farms has said it is working with the CDC and the Food and Drug Administration and has voluntarily recalled the onions.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">At least 90 people across 13 states have been sickened with E. coli following meals at McDonald\u2019s, and one person has died,&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/cdc-says-slivered-onions-are-likely-cause-mcdonalds-e-coli-infections-rcna177777\">according to the CDC<\/a>. There have been at least 27 hospitalizations, including a&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/mcdonalds-e-coli-teen-battles-kidney-failure-rcna177676\">teenager battling kidney failure\u2002<\/a>after developing hemolytic uremic syndrome, a rare and potentially life-threatening complication.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Typical symptoms from E. coli infections include stomach cramps, diarrhea and vomiting,&nbsp;<a href=\"https:\/\/www.cdc.gov\/ecoli\/outbreaks\/e-coli-O157.html\">the CDC says<\/a>. Most people who get sick recover without treatment within a week. Those younger than 5 and older than 65, as well as anyone with a compromised immune system, are at risk of more serious illness.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The proposed class action lawsuit is at least the&nbsp;<a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/woman-suing-mcdonalds-describes-e-coli-symptoms-rcna177140\">third suit related to the E. coli outbreak.\u2002<\/a>A Nebraska woman and a Colorado man each filed injury lawsuits against McDonald\u2019s earlier this month. Both had to go to the emergency room for their illnesses, according to the complaints.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The plaintiffs in Tuesday\u2019s suit allege that McDonald\u2019s breached its duty to provide products that are safe for consumption and alleges the company engaged in \u201cfraudulent, unfair, deceptive, misleading, and\/or unlawful conduct stemming from its omissions surrounding the risk of E. coli contamination affecting the Products.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">McDonald\u2019s declined to respond to the suit\u2019s allegations.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Willey said he has received \u201ca lot\u201d of calls from people looking to join the class action suit and he expects the number represented to grow.
