{"id":33095,"date":"2024-10-07T14:42:00","date_gmt":"2024-10-07T19:42:00","guid":{"rendered":"https:\/\/ustower.net\/?p=33095"},"modified":"2024-10-31T21:19:33","modified_gmt":"2024-11-01T02:19:33","slug":"georgia-supreme-court-reinstates-abortion-ban-amid-legal-battle","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=33095","title":{"rendered":"Georgia Supreme Court reinstates abortion ban amid legal battle"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">Georgia&#8217;s Supreme Court on Monday reinstated the&nbsp;<a href=\"https:\/\/www.axios.com\/2023\/10\/24\/georgia-abortion-ban-supreme-court-state-law\"><u>state&#8217;s ban<\/u><\/a>&nbsp;on&nbsp;<a href=\"https:\/\/www.axios.com\/health\/axios-explains-abortion\"><u>abortions<\/u><\/a>&nbsp;after about six weeks of pregnancy.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>The big picture:&nbsp;<\/strong>The&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/25194479-ga-sct-order-10724\"><u>ruling<\/u><\/a>, which goes into effect Monday, comes one week after&nbsp;<a href=\"https:\/\/www.axios.com\/local\/atlanta\/2024\/09\/30\/georgia-abortion-ban-judge-ruling\"><u>a lower court<\/u><\/a>&nbsp;struck down the ban and allowed abortions to legally take place until about 22 weeks of pregnancy.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">The six-week ban will remain in place indefinitely while the state&#8217;s appeal proceeds through Georgia&#8217;s high court.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Catch up quick:&nbsp;<\/strong>Fulton County Superior Judge Robert McBurney&nbsp;<a href=\"https:\/\/www.axios.com\/local\/atlanta\/2024\/09\/30\/georgia-abortion-ban-judge-ruling\"><u>struck down<\/u><\/a>&nbsp;the ban last Monday, ruling that it violates the state Constitution.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">McBurney had also\u00a0<a href=\"https:\/\/www.axios.com\/2022\/11\/15\/judge-strike-down-georgia-abortion-ban\"><u>struck the law down<\/u><\/a>\u00a0in 2022, but the Georgia Supreme Court last year\u00a0<a href=\"https:\/\/www.axios.com\/2023\/10\/24\/georgia-abortion-ban-supreme-court-state-law\"><u>overturned<\/u><\/a>\u00a0that ruling, allowing the law to remain in effect and sending the underlying lawsuit back to the lower court.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Context:<\/strong>&nbsp;The&nbsp;<a href=\"https:\/\/www.axios.com\/local\/atlanta\/2022\/05\/04\/georgia-abortion-law-explained\"><u>state law<\/u><\/a>, which took&nbsp;<a href=\"https:\/\/www.axios.com\/2022\/07\/20\/georgia-abortion-ban-roe-wade\"><u>effect<\/u><\/a>&nbsp;in 2022, prohibits abortions from the time cardiac activity is detected in an embryo \u2014 generally at about six weeks, which is before many people know that they are pregnant.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>What they&#8217;re saying:&nbsp;<\/strong>Monica Simpson, executive director of SisterSong Women of Color Reproductive Justice Collaborative and the plaintiff in the case, called it &#8220;disappointing but not surprising.&#8221;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">She said, &#8220;It&#8217;s shameful to use our bodies for political gain instead of advocating for the safety and health of all Georgians.&#8221;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Georgia&#8217;s Republican Attorney General Chris Carr in a statement commended the high court &#8220;for granting our request to allow the LIFE Act to once again take effect, and we will continue to defend the laws and the Constitution of the State of Georgia.&#8221;<\/li>\n\n\n\n<li class=\"has-medium-font-size\">The office of Georgia Gov.
