{"id":31314,"date":"2024-08-23T12:34:00","date_gmt":"2024-08-23T17:34:00","guid":{"rendered":"https:\/\/ustower.net\/?p=31314"},"modified":"2024-08-23T22:28:21","modified_gmt":"2024-08-24T03:28:21","slug":"ohio-judge-strikes-down-parts-of-states-6-week-abortion-ban","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=31314","title":{"rendered":"Ohio judge strikes down parts of state&#8217;s 6-week abortion ban"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">A judge on Friday temporarily blocked parts of Ohio&#8217;s six-week abortion ban.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Franklin County Court of Common Pleas put a hold on several laws that force abortion patients to wait a minimum of 24 hours after receiving state-mandated information in person before accessing abortion care.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">According to the ACLU of Ohio, this is the first ruling on the merits of a ballot measure that amended the Ohio constitution to establish &#8220;an individual right to one&#8217;s own reproductive medical treatment, including but not limited to abortion.&#8221;<a href=\"https:\/\/abcnews.go.com\/Health\/ohio-vote-issue-1-impact-abortion-access-state\/story?id=104661230\"><\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Much of the ban was rendered unconstitutional after the amendment went into effect in December 2023, Ohio&#8217;s Attorney General Dave Yost, said earlier this year.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Judge David C. Young&nbsp;<a href=\"https:\/\/www.acluohio.org\/sites\/default\/files\/2024.08.23_pi_opinion_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>&nbsp;that the ban&#8217;s requirements do not advance patient health and violate the reproductive rights guaranteed by the amendment.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">&#8220;This is a historic victory for abortion patients and for all Ohio voters who voiced support for the constitutional amendment to protect reproductive freedom and bodily autonomy,&#8221; Jessie Hill, cooperating attorney for the ACLU of Ohio. &#8220;It&#8217;s clear that the newly amended Ohio Constitution works as the voters intend: to protect the fundamental right to abortion and to forbid the state from infringing on it except when necessary to protect the health of a pregnant person.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The statement continued, &#8220;This decision is the first step in removing unnecessary barriers to care. We celebrate this ruling and will push forward to make this injunction permanent.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In a&nbsp;<a href=\"https:\/\/www.ohioattorneygeneral.gov\/Media\/News-Releases\/August-2024\/Statement-from-Ohio-Attorney-General-s-Office-on-t\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>, Bethany McCorkle, the attorney general&#8217;s communications director, said the office would be appealing the ruling.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">&#8220;We have heard the voices of the people and recognize that reproductive rights are now protected in our Constitution,&#8221; McCorkle&#8217;s statement read. &#8220;However, we respectfully disagree with the court&#8217;s decision that requiring doctors to obtain informed consent and wait 24 hours prior to an abortion constitute a burden. These are essential safety features designed to ensure that women receive proper care and make voluntary decisions.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Abortions are now banned at 22 weeks&#8217; gestation or later, according to the&nbsp;<a href=\"https:\/\/states.guttmacher.org\/policies\/ohio\/abortion-policies\" target=\"_blank\" rel=\"noreferrer noopener\">Guttmacher Institute<\/a>, a research group that studies sexual and reproductive rights.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">However, lawmakers have tried to maintain other parts of the ban, including reporting requirements and a 24-hour waiting period before an abortion can be administered. Those are&nbsp;<a href=\"https:\/\/www.aclu.org\/press-releases\/ohio-abortion-providers-file-lawsuit-challenging-24-hour-waiting-period-and-other-abortion-restrictions\" target=\"_blank\" rel=\"noreferrer noopener\">challenges<\/a>&nbsp;that abortion rights supporters say often prevent patients from receiving the procedure at all.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The so-called &#8220;heartbeat bill&#8221; was signed into law in 2019 by Gov. Mike DeWine and prevents abortions from performed once fetal cardiac activity can be defected, which typically occurs at about six weeks&#8217; gestation &#8212; before many women know they&#8217;re pregnant.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The ban has no exceptions for rape or incest. The&nbsp;<a href=\"https:\/\/www.ohioattorneygeneral.gov\/Files\/Briefing-Room\/News-Releases\/Heartbeat-Law-Explainer.aspx#:~:text=The%20statute%20contains%20three%20exceptions,cases%20of%20an%20ectopic%20pregnancy.\" target=\"_blank\" rel=\"noreferrer noopener\">only exceptions<\/a>&nbsp;are cases of ectopic pregnancies and to prevent the mother&#8217;s death or impairment of a major bodily function.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A federal judge blocked the ban in 2019 but it was reinstated just hours after the Supreme Court decision to overturn Roe.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In September 2022, an Ohio lower court granted a&nbsp;<a href=\"https:\/\/www.aclu.org\/press-releases\/ohio-lower-court-blocks-six-week-abortion-ban-restoring-reproductive-rights-across\" target=\"_blank\" rel=\"noreferrer noopener\">temporary restraining order<\/a>&nbsp;before granting a&nbsp;<a href=\"https:\/\/www.daytondailynews.com\/local\/abortion-services-to-resume-early-next-week-in-dayton-area\/MHXHGDKVLJFBHANHEFTP3NAYPU\/\" target=\"_blank\" rel=\"noreferrer noopener\">preliminary injunction<\/a>&nbsp;a few weeks later. In December 2023, the state&#8217;s Supreme Court&nbsp;<a href=\"https:\/\/ohiocapitaljournal.com\/2023\/12\/20\/after-ohio-supreme-court-dismisses-anti-abortion-arguments-advocates-work-to-unveil-total-abortion-ban\/\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed the state&#8217;s appeal<\/a>&nbsp;and sent the case back to the lower courts.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Since the&nbsp;<a href=\"https:\/\/abcnews.go.com\/Politics\/supreme-court-overturns-roe-wade-landmark-case-abortion\/story?id=85160781\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court overturned Roe v. Wade<\/a>&nbsp;in June 2022, 14 states have ceased nearly all abortion services, according to an ABC News tally, while three states &#8212; Florida, Georgia and South Carolina &#8212; all have six-week bans in place.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/abcnews.go.com\/US\/fighting-lives-women-impact-abortion-restrictions-post-roe\/story?id=105563174\"><\/a>Following the court&#8217;s decision, six states aside from Ohio have had abortion-related questions on the ballot and, each time,\u00a0<a href=\"https:\/\/abcnews.go.com\/Politics\/voters-decided-abortion-questions-election-day\/story?id=92684192\" target=\"_blank\" rel=\"noreferrer noopener\">voters have sided with abortion rights supporters<\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In an August 2022 primary, Kansas became the first state to let voters decide on abortion since the Supreme Court&#8217;s ruling, and residents&nbsp;<a href=\"https:\/\/abcnews.go.com\/Politics\/kansas-voters-preserve-abortion-access-high-turnout-primary\/story?id=87750829\" target=\"_blank\" rel=\"noreferrer noopener\">struck down a proposal<\/a>&nbsp;to remove the right to abortion from the state&#8217;s constitution.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Three states &#8212; California, Michigan and Vermont &#8212; voted to strengthen rights and two states &#8212; Kentucky and Montana \u2013 voted against further limiting rights.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">It&#8217;s unclear how many states will have abortion-related ballot questions in the November 2024 election but, so far, 10 states have abortion-related state constitutional amendments on the ballot, according to&nbsp;<a href=\"https:\/\/www.kff.org\/womens-health-policy\/dashboard\/ballot-tracker-status-of-abortion-related-state-constitutional-amendment-measures\/\" target=\"_blank\" rel=\"noreferrer noopener\">KFF<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/abcnews.go.com\/Health\/ohio-judge-strikes-parts-states-6-week-abortion\/story?id=110396171\">abcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A judge on Friday temporarily blocked parts of Ohio&#8217;s six-week abortion ban.
