Texas filed a lawsuit Tuesday against General Motors (GM), alleging the company unlawfully collected drivers\u2019 data and sold it.<\/p>\n\n\n\n

Texas Attorney General Ken Paxton\u2002<\/u><\/a>(R) announced the legal action<\/u><\/a> Tuesday following an investigation<\/u><\/a> launched in June into several car manufacturers after allegations of collecting drivers\u2019 data surfaced. Paxton said the investigation revealed General Motors \u201cengaged in egregious business practices that violated Texans\u2019 privacy and broke the law.\u201d<\/p>\n\n\n\n

\u201cWe will hold them accountable,\u201d Paxton said in a statement<\/u><\/a>. \u201cCompanies are using invasive technology to violate the rights of our citizens in unthinkable ways. Millions of American drivers wanted to buy a car, not a comprehensive surveillance system that unlawfully records information about every drive they take and sells their data to any company willing to pay for it.\u201d<\/p>\n\n\n\n

Paxton\u2019s office said General Motors \u201cused technology installed in most 2015 model year or newer GM vehicles to collect, record, analyze, and transmit highly detailed driving data about each time a driver used their vehicle,\u201d according to the press release.<\/p>\n\n\n\n

The office said General Motors sold the data to \u201cseveral\u201d companies. The complaint alleged General Motors told the companies purchasing the data that their customers \u201chad consented to the collection, use, and sale of their Driving Data.\u201d<\/p>\n\n\n\n

The office said the car manufacturer \u201cdeceived many of its customers\u201d when it asked them to enroll in its products, including the OnStar Smart Driver. The office alleged customers were told their vehicle\u2019s safety features would be deactivated if they failed to enroll in certain products.<\/p>\n\n\n\n

\u201cUnbeknownst to customers, however, by enrolling in GM\u2019s products, they were \u2018agreeing\u2019 to General Motors\u2019 collection and sale of their data. Despite lengthy and convoluted disclosures, General Motors never informed its customers of its actual conduct \u2014 the systematic collection and sale of their highly detailed driving data,\u201d Paxton\u2019s office said.<\/p>\n\n\n\n

A General Motors spokesperson said in statement to The Hill that they are in contact with Paxton\u2019s office.<\/p>\n\n\n\n

\u201cWe\u2019ve been in discussions with the Attorney General\u2019s office and are reviewing the complaint. We share the desire to protect consumers\u2019 privacy,\u201d a General Motors spokesperson said in a statement. <\/p>\n\n\n\n
