{"id":3017,"date":"2023-01-01T04:48:28","date_gmt":"2023-01-01T10:48:28","guid":{"rendered":"https:\/\/ustower.net\/?p=3017"},"modified":"2023-03-14T02:55:02","modified_gmt":"2023-03-14T07:55:02","slug":"federal-appeals-court-backs-florida-school-district-that-blocked-transgender-student-from-using-boys-bathroom","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=3017","title":{"rendered":"<strong>Federal appeals court backs Florida school district that blocked transgender student from using boys bathroom<\/strong>"},"content":{"rendered":"<p>A federal appeals court has ruled in favor of a\u00a0Florida school district\u2019s\u00a0policy that separates school bathrooms by biological sex.<br \/>\nThe 11th U.S. Circuit Court of Appeals announced its 7-4 decision on Friday, ruling that the St. Johns County\u00a0School Board\u00a0did not discriminate against transgender students based on sex, or violate federal civil rights law by requiring transgender students to use gender-neutral bathrooms or bathrooms matching their biological sex.<br \/>\nThe court\u2019s decision was split down party lines, with seven justices appointed by Republican presidents siding with the school district and four justices appointed by Democratic presidents siding with Drew Adams, a biological female, who sued the district in 2017 after not being allowed to use the boys restroom.<br \/>\nA three-judge panel from the appeals court previously sided with Adams in 2020, but the full appeals court decided to take up the case.<br \/>\nGender-neutral public restroom sign. She said the district\u2019s policy does not violate the law because it\u2019s based on\u00a0biological sex, not gender identity.<br \/>\nJudge Jill Pryor\u00a0wrote in a dissenting opinion that the interest of protecting privacy is not absolute and must coexist alongside fundamental principles of equality, specifically where exclusion implies inferiority.<\/p>\n<p>Multiple states have banned transgender student athletes from participating on the teams that align with their gender identity.\u00a0(AP Photo\/Samuel Metz, File)<br \/>\nTwo other federal appeals courts have ruled that transgender students can use bathrooms that accord with their identities.<br \/>\nFriday&#8217;s decision increases the likelihood that the\u00a0U.S. Supreme Court\u00a0will take up the issue.<\/p>\n<p>A protester voices support for the promotion of transgender ideology in schools during a pro-transgender march.\u00a0(Mark Kerrison\/In Pictures via Getty Images)<br \/>\n&#8220;This is an aberrant ruling that contradicts the rulings of every other circuit to consider the question across the country,&#8221; Tara Borelli, a spokesperson for LGBT advocacy group Lambda Legal who provided aid to Adams, told Fox News Digital in a statement. &#8220;It is also lengthy.
