{"id":30100,"date":"2024-07-25T06:54:00","date_gmt":"2024-07-25T11:54:00","guid":{"rendered":"https:\/\/ustower.net\/?p=30100"},"modified":"2024-07-25T20:59:07","modified_gmt":"2024-07-26T01:59:07","slug":"new-york-tells-supreme-court-to-toss-missouris-longshot-bid-to-block-trumps-sentence","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=30100","title":{"rendered":"New York tells Supreme Court to toss Missouri\u2019s longshot bid to block Trump\u2019s sentence\u00a0"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">New York urged the Supreme Court on Wednesday to toss Missouri\u2019s long-shot lawsuit that seeks to block former President Trump\u2019s forthcoming criminal sentence, telling the justices they have no jurisdiction.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">After Trump was&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4682289-trump-hush-money-trial-verdict\/\"><u>convicted in Manhattan<\/u><\/a>&nbsp;on 34 counts of falsifying business records, Missouri Attorney General Andrew Bailey (R) went straight to&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4753747-missouri-sues-new-york-trump-conviction\/\"><u>the nation\u2019s highest court<\/u><\/a>,&nbsp;saying the prosecution infringed upon the constitutional rights of Missouri voters and electors. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">By suing New York directly, Bailey is attempting to invoke the Supreme Court\u2019s exclusive and original jurisdiction to hear disputes between two states.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But in a&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22O159\/319733\/20240724191733354_22O159_NY Brief in Opposition.pdf\"><u>48-page response<\/u><\/a>&nbsp;filed by New York Attorney General&nbsp;<a href=\"https:\/\/thehill.com\/people\/letitia-james\/\"><u>Letitia James\u2019s\u2002<\/u><\/a>(D) office on Wednesday, the state told the Supreme Court to reject the effort on multiple grounds, saying it was based on \u201cbare assertions of bad faith.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cMissouri\u2019s suit is based entirely on an ongoing criminal case between the Manhattan DA and former President Trump and does not present an actual controversy between sovereign States,\u201d James\u2019s office wrote.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cMoreover, former President Trump has already raised, and the New York state courts are already adjudicating, the same issues Missouri seeks to raise,\u201d the response continued. \u201cAnd Missouri\u2019s claims are patently meritless.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A New York jury&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4682289-trump-hush-money-trial-verdict\/\"><u>convicted Trump<\/u><\/a>&nbsp;in May of falsifying business records with an intent to unlawfully influence the 2016 presidential election by disguising reimbursements to his then-fixer, Michael Cohen, as a legal retainer.&nbsp;The payments came after Cohen sent&nbsp;porn star&nbsp;<a href=\"https:\/\/thehill.com\/people\/stormy-daniels\/\"><u>Stormy Daniels\u2002<\/u><\/a>$130,000 to stay quiet about an alleged affair with Trump in the lead-up to his election.<br><br>Trump denies any affair and has vowed to appeal his criminal conviction, the first ever for a former U.S. president. His sentencing is set for Sept. 18.<br><br>Missouri\u2019s lawsuit seeks to block the sentence and Trump\u2019s gag order until after November\u2019s election, when he is hoping to earn a second White House term.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The suit accuses New York of violating Missourians\u2019 First Amendment rights and interfering with the presidential election in the state.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It forced James to defend the historic criminal prosecution of Trump by Manhattan District Attorney Alvin Bragg (D).
