{"id":29386,"date":"2024-07-08T16:19:00","date_gmt":"2024-07-08T21:19:00","guid":{"rendered":"https:\/\/ustower.net\/?p=29386"},"modified":"2024-07-08T21:33:15","modified_gmt":"2024-07-09T02:33:15","slug":"judge-rules-missouri-attorney-general-has-no-right-to-medical-records-of-transgender-minors","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=29386","title":{"rendered":"Judge rules Missouri Attorney General has no right to medical records of transgender minors"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>In one of four cases between a provider of gender-affirming care and the Missouri Attorney General, a judge has ruled that Missouri\u2019s consumer protection law does not authorize Andrew Bailey\u2019s sweeping demands for unredacted records.<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">A St. Louis judge on Friday determined Missouri Attorney General Andrew Bailey has no right to access unredacted private health information of transgender children treated at the Washington University Transgender Center at St. Louis Children\u2019s Hospital.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">St. Louis Circuit Court Judge Joseph Whyte ruled that Washington University does not have to provide the unredacted medical records sought by the attorney general\u2019s office as part of his investigation into the clinic\u2019s practices.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Whyte found that the health information sought in Bailey\u2019s demands is protected, and the data is not relevant to an investigation under the Missouri Merchandising Practices Act, which is the state\u2019s consumer protection law.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A third layer of protection for the information, the judge ruled, is the Health Information Portability and Accountability Act, or HIPAA, which prohibits the disclosure of personal health information without authorization.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The attorney general\u2019s demands \u201care not specific and limited in scope to the extent reasonably practicable in light of the purpose for which the information is sought, and respondent has not shown that de-identified information could not be reasonably used for the purpose for which it is sought,\u201d Whyte wrote.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Bailey&nbsp;<a href=\"https:\/\/missouriindependent.com\/2023\/02\/09\/missouri-agencies-launch-investigation-into-health-center-for-transgender-youth\/\">began looking into gender-affirming care<\/a>&nbsp;at the Washington University Transgender Center in March 2023 after the center\u2019s former case manager Jamie Reed provided an affidavit alleging rushed treatment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The attorney general\u2019s office sent civil investigative demands, which are similar to subpoenas, for health records to Washington University and other providers of gender-affirming care to minors, and four facilities filed suit against his requests for information.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Washington University, according to Friday\u2019s ruling, responded to Bailey\u2019s demand and gave him redacted records.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">One of Bailey\u2019s demands was for the university to, \u201cidentify all clients to whom you have provided your services. For each client, describe your services, the dates you provided your services, the amounts clients, their insurance or other third-party payors paid for these services and any contracts related to these services.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The attorney general\u2019s office also wanted \u201caccess to all electronic health records of clients,\u201d according to the judgment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Bailey said the redacted records were insufficient and asked the court to force Washington University to produce the documents in full. His reasoning for needing the information, though, was outside the bounds of the Missouri Merchandising Practices Act, Whyte determined.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Whyte recalled the attorney general arguing that he was looking into fraudulent billing of insurance and alleged that redactions removed communications about \u201cred flag tracking\u201d and patients who had discontinued treatment. That wasn\u2019t a sufficient argument, Whyte ruled.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The judge wrote that the Missouri Merchandising Practices Act does not require \u201cblind obedience to the attorney general\u2019s civil investigative demands,\u201d noting one section of the law that specifically exempts privileged material.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Whyte is also&nbsp;<a href=\"https:\/\/missouriindependent.com\/2024\/06\/18\/planned-parenthood-vows-to-fight-missouri-ag-push-for-transgender-youth-medical-records\/\">presiding over a similar case<\/a>&nbsp;involving demands for records from the St. Louis-based branch of Planned Parenthood, though in that case no records have been turned over to the attorney general at all.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Two other cases over Bailey\u2019s access to medical records are playing out across the state in Jackson County, where Circuit Court Judge Joel Fahnestock ordered Kansas City\u2019s Planned Parenthood organization and Children\u2019s Mercy Hospital to produce requested documents<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Planned Parenthood appealed in February, and the judge\u2019s order is placed on hold until after appeal.
