{"id":28483,"date":"2024-06-16T03:54:24","date_gmt":"2024-06-16T08:54:24","guid":{"rendered":"https:\/\/ustower.net\/?p=28483"},"modified":"2024-06-16T03:54:28","modified_gmt":"2024-06-16T08:54:28","slug":"missouri-abortion-ban-wasnt-about-lawmakers-imposing-religious-beliefs-judge-says","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=28483","title":{"rendered":"Missouri abortion ban wasn&#8217;t about lawmakers imposing religious beliefs, judge says"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">A judge in Missouri says lawmakers who passed a restrictive abortion ban were not trying to impose their religious beliefs on everyone in the state, rejecting a case filed by more than a dozen Christian, Jewish and Unitarian Universalist leaders who support abortion rights.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The groups&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-politics-health-missouri-state-government-legal-proceedings-05d21a1234877ffcd358ad74bebe4472\">sought a permanent injunction<\/a>&nbsp;last year barring Missouri from enforcing its abortion law and a declaration that provisions violate the state Constitution.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">One section of the statute at issue reads: \u201cIn recognition that Almighty God is the author of life, that all men and women are \u2018endowed by their Creator with certain unalienable Rights, that among those are Life.\u2019\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Judge Jason Sengheiser said in his ruling Friday that there is similar language in the preamble to the Missouri Constitution, which expresses \u201cprofound reverence for the Supreme Ruler of the Universe.\u201d The rest of the challenged provisions contain no explicit religious language, he said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWhile the determination that life begins at conception may run counter to some religious beliefs, it is not itself necessarily a religious belief,\u201d Sengheiser wrote. \u201cAs such, it does not prevent all men and women from worshipping Almighty God or not worshipping according to the dictates of their own consciences.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Americans United for Separation of Church&nbsp;&amp;&nbsp;State and the National Women\u2019s Law Center, who sued on behalf of the religious leaders, responded in a joint statement that they were considering their legal options.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cMissouri\u2019s abortion ban is a direct attack on the separation of church and state, religious freedom and reproductive freedom,&#8221; the statement said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Attorneys for the state have&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-lawsuit-religious-leaders-missouri-c0332a5d0d0a5671afcd7e6640a15f7d\">countered<\/a>&nbsp;that just because some supporters of the law oppose abortion on religious grounds doesn\u2019t mean that the law forces their beliefs on anyone else.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Sengheiser added that the state has historically sought to restrict and criminalize abortion, citing statutes that are more than a century old. \u201cEssentially, the only thing that changed is that Roe was reversed, opening the door to this further regulation,&#8221; he said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Within minutes of the 2022 Supreme Court decision, then-Attorney General Eric Schmitt and Gov. Mike Parson, both Republicans, filed paperwork to immediately&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-us-supreme-court-missouri-government-and-politics-7bb5798bae32c3f15abad3a10941dfb5\">enact a 2019 law<\/a>&nbsp;prohibiting abortions \u201cexcept in cases of medical emergency.\u201d That law contained a provision making it effective only if Roe v. Wade was overturned.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The law makes it a felony punishable by five to 15 years in prison to perform or induce an abortion. Medical professionals who do so also could lose their licenses. The law says that women who undergo abortions cannot be prosecuted.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Missouri already had some of the nation\u2019s more restrictive abortion laws and had seen a significant decline in the number of abortions performed, with residents instead traveling to clinics just across the state line in Illinois and Kansas.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/abcnews.go.com\/US\/wireStory\/judge-rejects-religious-leaders-challenge-missouri-abortion-ban-111157417\">abcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A judge in Missouri says lawmakers who passed a restrictive abortion ban were not trying to impose their religious beliefs on everyone in the state, rejecting a case filed by more than a dozen Christian, Jewish and Unitarian Universalist leaders who support abortion rights.
