{"id":26687,"date":"2024-04-30T04:03:54","date_gmt":"2024-04-30T09:03:54","guid":{"rendered":"https:\/\/ustower.net\/?p=26687"},"modified":"2024-04-30T04:04:00","modified_gmt":"2024-04-30T09:04:00","slug":"att-verizon-t-mobile-hit-with-200m-fcc-fine-for-sharing-user-location-data-without-consent","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=26687","title":{"rendered":"AT&amp;T, Verizon, T-Mobile hit with $200M FCC fine for sharing user location data without consent"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">The Federal Communications Commission (FCC) issued a fine totaling $200 million to the nation\u2019s four largest mobile carriers after concluding an investigation that found the companies illegally shared access to customers\u2019 location data, the agency said Monday. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">T-Mobile received the biggest fine of $80 million, along with a $12 million fine for its subsidiary, Sprint, that the company acquired in 2020. AT&amp;T was fined more than $57 million and Verizon was fined almost $7 million, according to the&nbsp;<a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-402213A1.pdf\"><u>agency\u2019s announcement<\/u><\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The fines follow initial&nbsp;<a href=\"https:\/\/thehill.com\/policy\/technology\/480953-fcc-says-wireless-carriers-violated-federal-law-by-selling-location-data\/\"><u>allegations by the FCC<\/u><\/a>&nbsp;in 2020 under the Trump administration of wireless carriers violating laws by not protecting users\u2019 location data. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The mobile carriers pushed back on the allegations and said they intend to challenge the fine. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The FCC said the agency\u2019s enforcement bureau\u2019s investigation into the carriers found that each of them sold access to their customers\u2019 location information to \u201caggregators\u201d that went on to resell access to the information to third-party location-based service providers.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The FCC said the carriers \u201cattempted to offload\u201d their obligation to obtain customer consent to others, which led to not obtaining customer consent. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Mobile carriers are legally required to take reasonable measures to protect certain customer information, including location information, according to the FCC. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The FCC said the \u201cinitial failure\u201d compounded when the carriers continued to sell access to location information without taking reasonable measures to protect it after they were made aware that safeguards were ineffective. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cOur communications providers have access to some of the most sensitive information about us. These carriers failed to protect the information entrusted to them. Here, we are talking about some of the most sensitive data in their possession: customers\u2019 real-time location information, revealing where they go and who they are,\u201d FCC Chair&nbsp;<a href=\"https:\/\/thehill.com\/people\/jessica-rosenworcel\/\"><u>Jessica Rosenworcel\u2002<\/u><\/a>said in a statement. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAs we resolve these cases \u2013 which were first proposed by the last Administration \u2013 the Commission remains committed to holding all carriers accountable and making sure they fulfill their obligations to their customers as stewards of this most private data,\u201d she added. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">All mobile carriers fined said they intend to appeal the decision. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThe FCC order lacks both legal and factual merit. It unfairly holds us responsible for another company\u2019s violation of our contractual requirements to obtain consent, ignores the immediate steps we took to address that company\u2019s failures, and perversely punishes us for supporting life-saving location services like emergency medical alerts and roadside assistance that the FCC itself previously encouraged.&nbsp; We expect to appeal the order after conducting a legal review,\u201d an AT&amp;T spokesperson said in a statement. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A T-Mobile spokesperson also challenged the allegations and called the fine \u201cexcessive.\u201d &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThis industry-wide third-party aggregator location-based services program was discontinued more than five years ago after we took steps to ensure that critical services like roadside assistance, fraud protection and emergency response would not be disrupted. We take our responsibility to keep customer data secure very seriously and have always supported the FCC\u2019s commitment to protecting consumers, but this decision is wrong, and the fine is excessive. We intend to challenge it,\u201d the spokesperson said. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">A spokesperson for Verizon did not immediately respond to a request for comment from The Hill, but&nbsp;<a href=\"https:\/\/www.cnn.com\/2024\/04\/29\/tech\/fcc-fines-att-verizon-200-million\/index.html\"><u>told CNN in a statement<\/u><\/a>&nbsp;it also intends to challenge the agency\u2019s order. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cWhen one bad actor gained unauthorized access to information relating to a very small number of customers, we quickly and proactively cut off the fraudster, shut down the program, and worked to ensure this couldn\u2019t happen again.
