{"id":25567,"date":"2024-04-02T00:35:53","date_gmt":"2024-04-02T05:35:53","guid":{"rendered":"https:\/\/ustower.net\/?p=25567"},"modified":"2024-04-02T00:37:40","modified_gmt":"2024-04-02T05:37:40","slug":"squatters-occupy-500k-home-mistakenly-built-on-wrong-lot-and-now-developer-is-suing-lands-true-owner","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=25567","title":{"rendered":"Squatters occupy $500K home mistakenly built on wrong lot, and now developer is suing land&#8217;s true owner"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>A legal battle is unfolding over a half-million dollar home accidentally built on a landowner&#8217;s property<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"has-medium-font-size\">A Hawaii property owner is getting sued after finding out a&nbsp;<a href=\"https:\/\/www.foxnews.com\/us\/queens-squatters-flee-1-million-home-stand-off-homeowner-visit-vigilantes-report\"><u>half-million dollar house<\/u><\/a>&nbsp;was accidentally built on her land.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The legal quagmire has&nbsp;<a href=\"https:\/\/www.foxnews.com\/us\/want-house-back-washington-homeowner-lives-van-deadbeat-tenant-lists-house-airbnb\"><u>attracted squatters<\/u><\/a>&nbsp;to the house, according to a neighbor who spoke to local news.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;You already make a mistake, and then you build on my land without my permission. And then now you\u2019re suing me for it,&#8221; Reynolds told the&nbsp;<a href=\"https:\/\/nypost.com\/2024\/03\/28\/us-news\/500k-hawaiian-home-built-on-wrong-plot-overrun-by-squatters-as-developer-sues-owner\/\"><u>New York Post<\/u><\/a>. &#8220;I was so mad. I was so mad that day \u2026 that\u2019s a really big mistake to make.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In 2018, Annaleine Reynolds, known as Anne, purchased a vacant, one-acre lot in Hawaiian Paradise Park on the Big Island for around $22,500 at a county tax auction, according to court documents. Reynolds, who lives in California and works as a relationship coach, planned to eventually move and host meditative healing women&#8217;s retreats on the lot, but was shocked to find out from a real estate broker last year that a $500,000 three-bedroom house was built and sold on her property by accident,&nbsp;<a href=\"https:\/\/www.hawaiinewsnow.com\/2024\/03\/27\/are-you-kidding-me-property-owner-stunned-after-500000-house-built-wrong-lot\/\"><u>Hawaii News Now reported<\/u><\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Keaau Development Partnership, LLC hired PJ&#8217;s Construction to build around a dozen homes on properties the developer bought in a subdivision of the Big Island&#8217;s Puna district, the&nbsp;<a href=\"https:\/\/apnews.com\/article\/hawaii-house-wrong-lot-legal-fight-b3681c1ab06cb8efdf31dea40bc56a56\"><u>Associated Press<\/u><\/a>&nbsp;reported. The developer is now suing Reynolds and PJ&#8217;s Construction, among others involved in the home&#8217;s development.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;It would set a dangerous precedent, if you could go on to someone else\u2019s land, build anything you want, and then sue that individual for the value of it,&#8221; said James DiPasquale, an attorney for Reynolds.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Reynolds rejected an offer from the developer for a&nbsp;<a href=\"https:\/\/www.foxnews.com\/category\/us\/personal-freedoms\/property\"><u>neighboring property<\/u><\/a>&nbsp;to resolve the dispute. She told Hawaii News Now she bought the lot for its &#8220;sacredness.&#8221;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But Peter Olson, an attorney representing the developer, said the plots are nearly identical after Reynolds declined the offer.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;My client believes [Reynolds is] trying to exploit PJ Construction\u2019s mistake in order to get money from my client and the other parties,&#8221; Olson told AP.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In an email, Olson told Fox News his client also found Reynold&#8217;s statements about her spiritual connection to the lot to be &#8220;disingenuous.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;My client finds Ms. Reynolds\u2019s statements about her \u2018spiritual\u2019 \/ \u2018energy\u2019 connection to the lot in question to be disingenuous, cultural appropriation \/ culturally insensitive, and offensive,&#8221; Olson said.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">However, Olson added that his client&#8217;s primary claim was with PJ&#8217;s Construction. He said under &#8220;unjust enrichment,&#8221; his client is entitled to recovery &#8220;if it conferred a benefit on Ms. Reynolds.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;The appreciation in the value of her property constitutes a legal benefit to her, and that retention of all that benefit would be unjust because my client spent $300,000 for the construction and Ms. Reynolds got a free house,&#8221; Olson said.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But DiPasquale said his client undertook an unnecessary &#8220;burden&#8221; through this experience.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;Our client, Anne Reynolds, did not ask for this house, nor does she deserve the burden it brings,&#8221; DiPasquale told Fox News in a statement. &#8220;She&#8217;s been thrust into a legal battle through no fault of her own, and we will do everything we can to hold them accountable.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">An attorney for PJ&#8217;s Construction told Hawaii News Now the developers didn&#8217;t want to hire surveyors for the process, but Olson told Fox News Keaau Development Partnership disputes this claim.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">When asked about&nbsp;<a href=\"https:\/\/www.foxnews.com\/media\/handyman-turned-squatter-hunter-atlanta-squatter-crisis-terrorist-act-calls-national-guard\"><u>the squatters<\/u><\/a>, Reynolds&#8217; attorney said it is unclear when they entered the home, or if they are still there.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;There was poop on the floor, in the hallway bathroom and on the toilet seat,&#8221; Reynolds told the Post after visiting the&nbsp;<a href=\"https:\/\/www.foxnews.com\/media\/squatters-sue-good-samaritan-trash-property-he-allowed-temporary-free-stays\"><u>trashed home<\/u><\/a>&nbsp;in February. &#8220;I was shocked.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Reynolds told the Post the experience has already taken an emotional toll and made her&nbsp;<a href=\"https:\/\/www.foxbusiness.com\/economy\/rising-property-taxes-housing-market-killer\"><u>property taxes skyrocket<\/u><\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;It\u2019s affected my ability to work,&#8221; Reynolds said. &#8220;Who can in their right mind have peace? You need to have a peaceful mind in order to work in the kind of job that I do. It\u2019s like a cloud over my head everywhere I go.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;I\u2019m the one who was injured in this whole fiasco and then after that, they sue me,&#8221; she said. &#8220;I feel like a criminal.
