{"id":25443,"date":"2024-03-29T04:51:33","date_gmt":"2024-03-29T09:51:33","guid":{"rendered":"https:\/\/ustower.net\/?p=25443"},"modified":"2024-03-29T04:51:41","modified_gmt":"2024-03-29T09:51:41","slug":"texas-womans-prison-sentence-for-attempting-to-vote-illegally-is-thrown-out","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=25443","title":{"rendered":"Texas woman&#8217;s prison sentence for attempting to vote illegally is thrown out"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">A Texas appeals court tossed out a woman&#8217;s five-year prison sentence for&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/elections\/texas-woman-sentenced-five-years-trying-vote-gets-new-appeal-n1262691\">voting illegally<\/a>&nbsp;Thursday, ending a yearslong saga that garnered national attention.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Crystal Mason was&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/texas-woman-gets-5-years-prison-voting-illegally-n861516\">sentenced<\/a>&nbsp;in 2018 to five years in prison after she testified she did not know that she was ineligible to vote because she was convicted of tax fraud in 2011. She cast a provisional ballot in the 2016 presidential election with the help of a poll worker.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In Thursday&#8217;s ruling to overturn Mason&#8217;s sentence, Second District Appeals Court Justice Wade Birdwell wrote that &#8220;finding Mason to be not credible \u2014 and disbelieving her protestation of actual knowledge \u2014 does not suffice as proof of guilt.&#8221;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Mason had testified that when she was in prison, she was not informed that she could not vote upon her release, Birdwell detailed. She also &#8220;emphatically denied&#8221; having read the provisional ballot&#8217;s affirmations detailing felon voting restrictions, testifying that she did not know she was not allowed to cast a ballot because she was on supervised release from prison, according to Birdwell.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Mason&#8217;s ballot was not counted when officials determined that she was ineligible to vote because of her 2011 conviction, the ruling said<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;In the end, the State\u2019s primary evidence was that Mason read the words on the affidavit,&#8221; Birdwell said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&#8220;But even if she had read them, they are not sufficient \u2014 even in the context of the rest of the evidence in this case \u2014 to prove beyond a reasonable doubt that she actually knew that being on supervised release after having served her entire federal sentence of incarceration made her ineligible to vote by casting a provisional ballot when she did so,&#8221; he added.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Court of Criminal Appeals announced in 2021 that it would consider an appeal from Mason, who was out of prison on an appeal bond.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Her 2018 sentence drew national attention, and critics have&nbsp;<a href=\"https:\/\/www.nbcdfw.com\/news\/local\/dozens-rally-to-keep-election-violation-defendant-out-of-prison\/2439795\/\">rallied<\/a>&nbsp;against the lower court&#8217;s decision.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/www.nbcnews.com\/politics\/elections\/texas-womans-prison-sentence-attempting-vote-illegally-thrown-rcna145573\">Nbcnews<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Texas appeals court tossed out a woman&#8217;s five-year prison sentence for&nbsp;voting illegally&nbsp;Thursday, ending a yearslong saga that garnered national attention.
