{"id":24757,"date":"2024-03-12T00:08:36","date_gmt":"2024-03-12T05:08:36","guid":{"rendered":"https:\/\/ustower.net\/?p=24757"},"modified":"2024-03-12T00:08:41","modified_gmt":"2024-03-12T05:08:41","slug":"florida-dont-say-gay-law-upheld-after-settlement-in-federal-court","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=24757","title":{"rendered":"Florida \u2018Don\u2019t Say Gay\u2019 law upheld after settlement in federal court"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">The state of Florida settled a multi-year suit Monday against the&nbsp;<a href=\"https:\/\/thehill.com\/changing-america\/respect\/equality\/3543536-floridas-dont-say-gay-law-takes-effect-today-its-impact-is-already-being-felt\/\" target=\"_blank\" rel=\"noreferrer noopener\">so-called \u201cDon\u2019t Say Gay\u201d law<\/a>, which limits how LGBTQ topics can be discussed and presented in schools.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The settlement agreement clarifies language of the 2022 Parental Rights in Education Act, keeping it in place but toning down what LGBTQ advocates in the state warned could illegally limit their rights.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Gov.&nbsp;<a href=\"https:\/\/thehill.com\/people\/ron-desantis\/\">Ron DeSantis\u2019s&nbsp;<\/a>(R-Fla.) office celebrated the settlement as a victory for his policy agenda.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWe fought hard to ensure this law couldn\u2019t be maligned in court, as it was in the public arena by the media and large corporate actors,\u201d state general counsel Ryan Newman said in a statement. \u201cWe are victorious, and Florida\u2019s classrooms will remain a safe place under the Parental Rights in Education Act.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The law prevented educators from discussing LGBTQ topics with elementary students and was&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/thehill.com\/homenews\/education\/3986256-expansion-of-dont-say-gay-passes-florida-senate-heads-to-desantiss-desk\/\" target=\"_blank\">later expanded to<\/a>&nbsp;high school students, raising concerns over censorship and civil liberties due to its vague language. Multiple LGBTQ rights groups&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.npr.org\/2022\/04\/01\/1090211332\/dont-say-gay-law-florida-lawsuit-desantis\" target=\"_blank\">sued the state<\/a>&nbsp;over the bill when it was signed into law.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The law sparked widespread backlash for DeSantis, including&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/thehill.com\/business\/3935602-why-ron-desantis-is-fighting-with-disney\/\" target=\"_blank\">starting a feud with Disney<\/a>&nbsp;that ultimately led to a legal fight over regulation.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A federal court ruled last month that the remaining two plaintiffs&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/news.wfsu.org\/state-news\/2023-02-16\/another-challenge-to-floridas-dont-say-gay-law-has-been-thrown-out\" target=\"_blank\">did not have the standing<\/a>&nbsp;to continue to sue, leading to a settlement Monday that fixes the concerns about vague language.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Florida Department of Education agreed to send a memo to Florida school districts specifying that the law does not completely ban all discussion of LGBTQ topics and figures in classrooms, and requires strict neutrality on the discussion of sexuality and gender identity.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Plaintiff Cecile Houry&nbsp;<a href=\"https:\/\/www.tampabay.com\/news\/education\/2024\/03\/11\/florida-settles-lawsuit-over-parental-rights-law-will-clarify-vague-wording\/\" target=\"_blank\" rel=\"noreferrer noopener\">told the Tampa Bay Times<\/a>&nbsp;the settlement avoids another multi-year appeals process and improves the state of the law.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cIt\u2019s going to make a huge difference because the law was so vague that people stayed away from everything,\u201d Houry said. \u201cHere it really defines what is not allowed, and everything else that is allowed.
