{"id":24038,"date":"2024-02-22T03:57:37","date_gmt":"2024-02-22T09:57:37","guid":{"rendered":"https:\/\/ustower.net\/?p=24038"},"modified":"2024-02-22T03:57:42","modified_gmt":"2024-02-22T09:57:42","slug":"speeding-seattle-officer-who-struck-and-killed-student-will-not-face-charges","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=24038","title":{"rendered":"Speeding Seattle officer who struck and killed student will not face charges"},"content":{"rendered":"\n<p class=\"has-medium-font-size\"><strong>Death of Jaahnavi Kandula, 23, from India, ignited outrage after fellow officer was recorded making \u2018appalling\u2019 remarks about case<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Prosecutors in Washington state said on Wednesday they will not file felony charges against a&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/seattle\">Seattle<\/a>&nbsp;police officer who struck and killed a graduate student from India while responding to an overdose call \u2013 a case that attracted widespread attention after another officer was recorded making callous remarks about it.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Officer Kevin Dave was driving 74mph (119km\/h) on a street with a 25mph (40km\/h) speed limit in a police SUV before he hit 23-year-old Jaahnavi Kandula in a crosswalk on 23 January 2023.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In a memo to the Seattle police department on Wednesday, the King county prosecutor\u2019s office noted that Dave had on his emergency lights, that other pedestrians reported hearing his siren, and that Kandula appeared to try to run across the intersection after seeing his vehicle approaching. She might also have been wearing wireless earbuds that could have diminished her hearing, they noted.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">For those reasons, a felony charge of vehicular homicide was not warranted. \u201cThere is insufficient evidence to prove beyond a reasonable doubt that Officer Dave was consciously disregarding safety,\u201d the memo said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It remains possible that city prosecutors could file lesser charges, such as negligent driving. Tim Robinson, a spokesperson for the Seattle city attorney\u2019s office, said Wednesday that the case had not been referred to it for possible misdemeanor prosecution, and the Seattle police department did not immediately respond to an emailed inquiry about whether it might refer the case to that office.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Kandula\u2019s death ignited outrage, especially after a recording from another officer\u2019s body-worn camera surfaced last September, in which that officer laughed and suggested that Kandula\u2019s life had \u201climited value\u201d and the city should \u201cjust write a check\u201d.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Diplomats from India as well as local protesters sought an investigation. The city\u2019s civilian watchdog, the Office of Police Accountability, found last month that the comments by officer Daniel Auderer \u2013 the vice-president of the Seattle Police Officers Guild \u2013 damaged the department\u2019s reputation and undermined public trust on a scale that is difficult to measure.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Seattle police chief Adrian Diaz is weighing Auderer\u2019s punishment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The comments were \u201cderogatory, contemptuous and inhumane\u201d, wrote Gino Betts Jr, director of the accountability office.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In a statement to the office, Auderer acknowledged that his remarks \u2013 made during a call with Mike Solan, the police union\u2019s president \u2013 sounded callous, but that they were intended to mock a legal system that would try to put a value on Kandula\u2019s life.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">King county prosecutor Leesa Manion called Kandula\u2019s death heartbreaking, but she said Auderer\u2019s \u201cappalling\u201d comments did not change the legal analysis of whether Dave should be charged.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cIt is the Office of Police Accountability that bears the responsibility of disciplinary investigation and proceedings relating to officer Auderer\u2019s comment,\u201d rather than the prosecutor\u2019s office, Manion said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The Seattle Police Officers Guild did not immediately respond to an email seeking comment. The union has said the comments were \u201chighly insensitive\u201d but also taken out of context.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Kandula was from Andhra Pradesh, in India\u2019s southern coastal region. Relatives told the Seattle Times that Kandula came to Seattle so she could one day support her mother back home in India.
