{"id":23076,"date":"2024-01-25T04:58:05","date_gmt":"2024-01-25T10:58:05","guid":{"rendered":"https:\/\/ustower.net\/?p=23076"},"modified":"2024-01-25T04:58:10","modified_gmt":"2024-01-25T10:58:10","slug":"abbott-doubles-down-on-border-invasion-declaration-after-supreme-court-blow","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=23076","title":{"rendered":"Abbott doubles down on border \u2018invasion\u2019 declaration after Supreme Court blow"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">Texas Gov.&nbsp;<a href=\"https:\/\/thehill.com\/people\/greg-abbott\/\"><u>Greg Abbott\u2002<\/u><\/a>(R) on Wednesday accused the federal government of breaking the compact with the states following a Supreme Court ruling on Monday that cleared the way for the Border Patrol to remove razor wire installed by Texas along the U.S.-Mexico border.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In a statement, Abbott said, \u201c<a href=\"https:\/\/thehill.com\/people\/joe-biden\/\"><u>President Biden\u2002<\/u><\/a>has refused to enforce [immigration] laws and has even violated them.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">It\u2019s the latest escalation in a legal and political standoff between Texas and the federal government, though Abbott stopped short of announcing any specific measures.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">He has been pushing constitutional boundaries on state versus federal jurisdiction of border and immigration enforcement for the better part of two years; his legal team, including state Attorney General Ken Paxton, first publicly toyed with the idea of formally declaring a border \u201cinvasion\u201d in April 2022.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In that November, Abbott wrote Biden invoking a state\u2019s constitutional right to wage war when invaded, but he only made his&nbsp;<a href=\"https:\/\/twitter.com\/GregAbbott_TX\/status\/1704640256429985863\"><u>official invasion declaration public<\/u><\/a>&nbsp;in September.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Since then, the governor has methodically increased the border enforcement roles of the Texas Department of Public Safety and the Texas National Guard, citing the constitutional authority for a state to defend itself against invasion.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThat authority is the supreme law of the land and supersedes any federal statutes to the&nbsp;contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border,\u201d wrote Abbott.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Texas\u2019s actions have precipitated several legal battles surrounding Operation Lone Star, Abbott\u2019s initiative to take greater control over immigration enforcement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Though the Supreme Court this week&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4422203-supreme-court-southern-border-texas-razor-wire-doj\/\"><u>allowed federal officials<\/u><\/a>&nbsp;\u2014 namely, the Border Patrol \u2014 to remove razor wire installed by Texas, that order did not affect other flashpoints in the uneasy relationship between feds and state agents.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Earlier this month, Texas officials took over a public park on the shores of the Rio Grande in Eagle Pass, using Texas National Guard troops to block the Border Patrol from accessing the park.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Texas Democratic&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/state-watch\/4427211-texas-democrat-biden-seize-control-texas-national-guard\/\"><u>Rep. Joaquin Castro was the first to call<\/u><\/a>&nbsp;for a federalization of the Texas National Guard, which as a military unit is ultimately under the command of President Biden as commander-in-chief.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Rep.
