{"id":22222,"date":"2024-01-04T19:18:00","date_gmt":"2024-01-05T01:18:00","guid":{"rendered":"https:\/\/ustower.net\/?p=22222"},"modified":"2024-01-04T19:18:08","modified_gmt":"2024-01-05T01:18:08","slug":"national-labor-relations-board-issues-complaint-against-spacex","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=22222","title":{"rendered":"National Labor Relations Board issues complaint against SpaceX"},"content":{"rendered":"\n<p class=\"has-medium-font-size\">The National Labor Relations Board (NLRB) filed a complaint Wednesday accusing SpaceX, Elon Musk\u2019s rocket company, of unlawfully firing eight former employees who drafted and circulated an open letter detailing workplace concerns.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The letter,&nbsp;<a href=\"https:\/\/www.theverge.com\/2022\/6\/16\/23170228\/spacex-elon-musk-internal-open-letter-behavior\"><u>circulated in 2022<\/u><\/a>, criticized Musk\u2019s actions and the allegations of sexual harassment against him, claiming they were negatively contributing to the company\u2019s reputation. The letter also said the company was failing to live up to its \u201cNo Asshole\u201d policy and its policy against sexual harassment.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The letter, whose authorship was not known at the time it was first reported, called on SpaceX to \u201cpublicly address and condemn Elon\u2019s harmful Twitter behavior,\u201d to \u201chold all leadership equally accountable\u201d for bad behavior, and to \u201cclearly define what exactly is intended by SpaceX\u2019s \u2018no-asshole\u2019 and \u2018zero tolerance\u2019 policies and enforce them consistently.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The NLRB on Wednesday alleged an employer at SpaceX told other staff that the open letter was the reason the eight former employees were discharged from their positions. The NLRB also alleged the employer discouraged participation in the open letter and restricted distribution of the letter, even threatening discharge \u201cif employees engaged in protected concerted activities.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In the complaint, according to the NLRB press release, the agency claimed the employer at SpaceX \u201cinterrogated other employees\u201d about the letter and told them not to discuss those interviews. The SpaceX employer also \u201ccreated an impression of surveillance,\u201d including by \u201creading and showing screenshots of communications between employees,\u201d the NLRB said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The NLRB is seeking a settlement ahead of a scheduled hearing on March 5 this year. The complaint comes at the end of an investigation and is not a decision from the board, the NLRB said.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The NLRB general counsel said it was seeking reinstatement and back pay for the employees.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Anne Shayer, an attorney who represented the eight former SpaceX employees in filing unfair labor practice charges against the company, praised the complaint, writing in a statement, \u201cThe NLRB has spoken: SpaceX violated our clients\u2019 workplace rights. This kind of flagrant violation of the law cannot be allowed to go unchecked. We look forward to trial.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cAt SpaceX the rockets may be reusable but the people who build them are treated as expendable. I am hopeful these charges will hold SpaceX and its leadership accountable for their long history of mistreating workers and stifling discourse,\u201d&nbsp;<a href=\"https:\/\/www.lieffcabraser.com\/2024\/01\/lieff-cabraser-and-co-counsel-announce-nlrb-issues-complaint-against-spacex\/\"><u>said Paige Holland-Thielen<\/u><\/a>, one of the employees who brought the case.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Another charging party, Tom Moline, said, \u201cI had no doubt that the NLRB would recognize SpaceX\u2019s actions for what they were: feeble attempts to punish, intimidate, and silence me and hundreds of other workers who simply sought to improve workplace conditions and address the toxic culture set by&nbsp;<a href=\"https:\/\/thehill.com\/people\/elon-musk\/\"><u>Elon Musk,<\/u><\/a>&nbsp;enforced by Gwynne Shotwell, and enabled by all levels of SpaceX leadership.
