Jean Carroll case"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">A federal appeals court on Thursday denied former President&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>\u2019s request to halt proceedings in the&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-trials-court-cases-2024-what-expect-rcna130465\" target=\"_blank\" rel=\"noreferrer noopener\">upcoming E. Jean Carroll defamation trial<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In a court filing last week, Trump\u2019s attorneys asked the 2nd U.S. Circuit Court of Appeals to delay the case for 90 days while he considered appealing the court\u2019s previous rejection of his efforts to use presidential immunity as a defense.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The appeals court&nbsp;<a href=\"https:\/\/www.courtlistener.com\/docket\/67625192\/151\/carroll-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied that request<\/a>&nbsp;on Thursday, allowing the trial to begin Jan. 16.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump&#8217;s request for a pause in the proceedings came after the appeals court unanimously ruled that the former president had<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/federal-appeals-court-denies-trumps-presidential-immunity-defense-e-je-rcna129521\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;waited too long<\/a>&nbsp;\u2014 three years \u2014 to raise his presidential immunity defense in the defamation trial.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump had argued that he couldn\u2019t be sued for remarks he made in 2019 about Carroll and the<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/jury-reaches-verdict-e-jean-carroll-rape-defamation-case-trump-rcna82778\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a0claims of sexual assault against him<\/a>\u00a0because he was president at the time. He also contended that his comments were related to his official duties as president because he needed to speak publicly about the accusations being false.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The court noted that while Carroll filed her defamation suit in November 2019, followed by Trump&#8217;s response in January 2020, he didn&#8217;t bring up the presidential immunity defense until January 2023. Allowing him to use that defense now&nbsp;would cause \u201cundue prejudice\u201d to Carroll, the judges said in their ruling.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The upcoming trial is the second one involving Trump and Carroll, a magazine writer who alleged Trump raped her in the mid-1990s and defamed her after she spoke out publicly with her accusations in 2019. Trump has repeatedly denied the allegations. A jury this year\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/jury-reaches-verdict-e-jean-carroll-rape-defamation-case-trump-rcna82778\" target=\"_blank\" rel=\"noreferrer noopener\">found Trump liable for sexual abuse and defamation<\/a>\u00a0and awarded Carroll $5 million in damages, a verdict Trump is appealing.<a href=\"https:\/\/www.facebook.com\/sharer\/sharer.php?u=https:\/\/www.nbcnews.com\/now\/video\/judge-dismisses-trump-s-countersuit-against-e-jean-carroll-190240325752\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><a href=\"https:\/\/twitter.com\/intent\/tweet?text=Judge%20dismisses%20Trump%27s%20countersuit%20against%20E.%20Jean%20Carroll&amp;via=nbcnews&amp;url=https:\/\/www.nbcnews.com\/now\/video\/judge-dismisses-trump-s-countersuit-against-e-jean-carroll-190240325752&amp;original_referer=https:\/\/www.nbcnews.com\/now\/video\/judge-dismisses-trump-s-countersuit-against-e-jean-carroll-190240325752\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><a href=\"mailto:?subject=Judge%20dismisses%20Trump%27s%20countersuit%20against%20E.%20Jean%20Carroll&amp;body=https:\/\/www.nbcnews.com\/now\/video\/judge-dismisses-trump-s-countersuit-against-e-jean-carroll-190240325752\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The second trial centers on remarks Trump made about Carroll during his presidency and after the $5 million verdict, including his disparaging comments against her such as calling her a&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-notifies-court-plans-appeal-5-million-carroll-verdict-rcna84052\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cwhack job.\u201d<\/a>&nbsp;The trial, which is expected to last three to five days, only focuses on what money damages Carroll is entitled to.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">U.S. District Judge Lewis Kaplan in June denied Trump\u2019s immunity argument, writing that presidential immunity is \u201cnot a \u2018get out of damages liability free\u2019 card.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump has also raised the presidential immunity argument in the election interference case brought against him by special counsel Jack Smith.&nbsp;U.S. District Judge Tanya Chutkan shot down his argument in that case, ruling this month that the former president was&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/judge-denies-two-trumps-motions-dismiss-federal-election-interference-rcna127720\" target=\"_blank\" rel=\"noreferrer noopener\">not immune<\/a>&nbsp;to the criminal charges. Trump, who has pleaded not guilty in the case, appealed the ruling to the federal appeals court in Washington, D.C.
