{"id":21683,"date":"2023-12-21T05:24:59","date_gmt":"2023-12-21T11:24:59","guid":{"rendered":"https:\/\/ustower.net\/?p=21683"},"modified":"2023-12-21T05:25:03","modified_gmt":"2023-12-21T11:25:03","slug":"u-s-bank-fined-36-million-for-freezing-unemployment-debit-cards-during-covid-19-pandemic","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=21683","title":{"rendered":"U.S. Bank fined $36 million for freezing unemployment debit cards during Covid-19 pandemic"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">U.S. Bank, the nation\u2019s fifth-largest bank, has been fined nearly $36 million by federal regulators for violating consumer protection laws.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The bank froze access to hundreds of thousands of prepaid debit cards used to distribute unemployment insurance benefits during the Covid-19 pandemic.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">U.S. Bank was fined an additional $15 million by the Office of the Comptroller of the Currency.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">WASHINGTON \u2014 The&nbsp;<a href=\"https:\/\/www.cnbc.com\/2023\/12\/11\/wells-fargo-mortgage-lenders-probed-over-racial-discrimination.html\"><u>Consumer Financial Protection Bureau<\/u><\/a>&nbsp;on Tuesday announced it has fined&nbsp;<a href=\"https:\/\/www.cnbc.com\/quotes\/USB\/\"><u>U.S. Bank<\/u><\/a>&nbsp;nearly $21 million for cutting off access to&nbsp;<a href=\"https:\/\/www.cnbc.com\/2023\/11\/22\/what-to-know-about-jobless-benefits-as-job-market-cools.html\"><u>unemployment insurance benefits<\/u><\/a>&nbsp;during the height of the Covid-19 pandemic. The Office of the Comptroller of the Currency imposed an additional&nbsp;<a href=\"https:\/\/www.occ.treas.gov\/news-issuances\/news-releases\/2023\/nr-occ-2023-141.html\"><u>$15 million penalty<\/u><\/a>&nbsp;on the bank over the same practices.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cU.S. Bank blocked access to accounts and demanded burdensome paperwork in order for consumers to regain access to their frozen benefits,\u201d CFPB Director&nbsp;<a href=\"https:\/\/www.cnbc.com\/2023\/07\/20\/cfpb-chief-sets-regulatory-agenda-on-junk-fees-medical-debt-and-ai.html\"><u>Rohit Chopra<\/u><\/a>&nbsp;said in a statement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The fifth-largest commercial bank in the country, U.S. Bank administered prepaid debit cards to distribute unemployment insurance benefits through its ReliaCard program.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">But starting in the summer of 2020, when&nbsp;<a href=\"https:\/\/www.bls.gov\/cps\/effects-of-the-coronavirus-covid-19-pandemic.htm\"><u>unemployment rose close to 15%<\/u><\/a>, the bank froze tens of thousands of accounts due to suspected fraud. It then failed to provide a reliable method for consumers with frozen cards to regain access to their benefit money, the CFPB said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">As part of the settlement, the bank did not admit or deny wrongdoing.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Between March 2020 and July 2021, states issued&nbsp;<a href=\"https:\/\/www.cnbc.com\/2021\/09\/02\/pandemics-794-billion-unemployment-benefits-were-historic-heres-why.html\"><u>$794 billion in combined state and federal unemployment benefits<\/u><\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The demand for the prepaid cards \u201cgrew nearly 4000%,\u201d during the pandemic, Cheryl Leamon, a representative for U.S. Bank, told CNBC.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWhile a small portion of cardholders were affected due to extended holds, we prevented fraud of over $375 million and returned to the states hundreds of millions in additional funds sent to questionable accounts,\u201d Leamon said. The bank has since made enhancements to the ReliaCard program, Leamon added.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Users who had their&nbsp;<a href=\"https:\/\/www.consumerfinance.gov\/enforcement\/actions\/us-bank-national-association-prepaid-cards-2023\/\"><u>accounts frozen<\/u><\/a>&nbsp;between August 2020 and March 2021 waited an average of a few weeks to a month or more to regain access to benefits because U.S. Bank did not provide an easy method to verify identities.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The $15 million OCC portion of the fine was related to alleged unfair practices under the Federal Trade Commission Act.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">U.S. Bank also violated the Consumer Financial Protection Act and failed to immediately investigate alleged unauthorized electronic fund transfers under the EFT Act, according to the CFPB.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Consumers were unable to access the funds that had been reported as unauthorized, because the bank incorrectly required additional written confirmation about the transactions and did not dispense provisional credits without it.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cU.S. Bank must comply with the law, and the CFPB and OCC are making the bank pay for its conduct,\u201d Chopra said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Under a consent order, U.S. Bank will provide $5.7 million in redress to consumers and pay a $15 million civil money penalty.
