{"id":19731,"date":"2023-11-01T03:48:34","date_gmt":"2023-11-01T08:48:34","guid":{"rendered":"https:\/\/ustower.net\/?p=19731"},"modified":"2023-11-01T03:48:38","modified_gmt":"2023-11-01T08:48:38","slug":"child-marriage-is-still-legal-in-most-of-the-u-s-heres-why","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=19731","title":{"rendered":"Child marriage is still legal in most of the U.S. Here\u2019s why."},"content":{"rendered":"\n<p class=\"has-medium-font-size\">At age 14, Genevieve Meyer began spending time with a neighbor to get a break from her hectic home life. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Her relationship with the neighbor, a 42-year-old divorced father of two, soon turned sexual. Meyer\u2019s mother eventually found out,&nbsp;and she called the police. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">But she&nbsp;believed that Meyer had \u201cruined this man\u2019s life\u201d by seducing him, according to Meyer, and the neighbor and Meyer\u2019s mother ultimately decided&nbsp;that he&nbsp;and the teen would get married so that any criminal charges would be dropped. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In return, Meyer\u2019s mother would get a cut from the profits of the neighbor\u2019s&nbsp;tree-trimming business. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Meyer, now 43, was shocked when her mother told her about the deal.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cMy immediate response was&nbsp;14-year-olds don\u2019t&nbsp;get married,\u201d Meyer said.&nbsp;\u201cBut I was wrong.\u201d &nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Thousands of children and teens&nbsp;are legally wed&nbsp;in the United States each year:&nbsp;almost 300,000 minors got married between 2000 and 2018, according to&nbsp;<a href=\"https:\/\/www.unchainedatlast.org\/united-states-child-marriage-problem-study-findings-april-2021\/\"><u>one 2021 study<\/u><\/a>&nbsp;by Unchained at Last, a nonprofit that&nbsp;helps women and girls get out of forced marriages. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">The nonprofit calculated these numbers using&nbsp;marriage certificate<a href=\"https:\/\/www.jahonline.org\/article\/S1054-139X(21)00341-4\/fulltext\"><u>\u2002data.<\/u><\/a>&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Most of those minors&nbsp;were&nbsp;16 and 17 years old&nbsp;at the time they were wed, but&nbsp;children as young as 10&nbsp;have been&nbsp;forced into marriage, according to&nbsp;<a href=\"https:\/\/www.unchainedatlast.org\/laws-to-end-child-marriage\/\"><u>Unchained at Last<\/u><\/a>. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&nbsp;Girls are far more likely than boys to be married before the age of 18. Out of all the minors that married between 2000 and 2018, 86 percent were girls and 14 percent were boys, per the nonprofit.&nbsp;Most of those girls married&nbsp;adult men. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThis is happening every day,\u201d said Fraidy Reiss, found&nbsp;of Unchained at Last. \u201cAnd some of the reasons are because of these outdated, archaic and dangerous laws that encourage this.\u201d&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Marrying before the age of 18 was legal in all 50 states until 2017. Since then, 10 states have passed legislation banning the practice. &nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In 2018,&nbsp;<a href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/article\/delaware-becomes-first-state-to-ban-child-marriage\/\"><u>Delaware<\/u><\/a>&nbsp;passed legislation raising the minimum age to marry to 18, becoming the first state to ban child marriage.&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">It was followed shortly by&nbsp;<a href=\"https:\/\/nj.gov\/governor\/news\/news\/562018\/approved\/20180622b_child_marriage_ban.shtml\"><u>New Jersey<\/u><\/a>,&nbsp;and since then Pennsylvania, Minnesota, Rhode Island, New York, Massachusetts, Vermont, Connecticut and most recently&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/jul\/12\/michigan-child-marriage-law-signed\"><u>Michigan<\/u><\/a>&nbsp;have also raised the minimum age to legally wed to 18. &nbsp;&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">More than half of U.S. states&nbsp;still allow for 16- and 17-year-olds to get married with parental consent, however,&nbsp;according to&nbsp;<a href=\"http:\/\/chrome-extension\/\/bdfcnmeidppjeaggnmidamkiddifkdib\/viewer.html?file=https:\/\/www.tahirih.org\/wp-content\/uploads\/2022\/11\/November-2022-State-Statutory-Compilation-1.pdf\"><u>Tahirih Justice Center<\/u><\/a>, a nonprofit that works to protect women and girls facing gender-based violence. &nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">On top of that, 10 states allow children younger than 16 to get married with judicial approval, according to the center, while&nbsp;four will drop the minimum age for marriage&nbsp;if a girl is pregnant. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">And eight states \u2014 including California and Washington \u2014 have no age floor for marriage, according to the center. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Legal loopholes at the federal&nbsp;level allow for child marriage to continue as well. &nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">For example, there is no minimum age requirement to petition for a foreign spouse or fianc\u00e9&nbsp;visa, according to the&nbsp;<a href=\"#:~:text=to learn more.-,U.S. Sponsor Minimum Age Requirement,864 or I-864EZ).\"><u>U.S. State Department<\/u><\/a>.&nbsp; &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">As a result, Reiss said, many young girls in the United States are used to help older men living abroad to obtain a visa. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">And while some&nbsp;states have adopted laws to make it harder for minors to marry,&nbsp;passing those laws can be challenging. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Legislation banning child marriage has struggled in some states due to backlash from both conservative and progressive voices.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Earlier this year, for instance, a bill that would have prohibited minors from getting married in&nbsp;<a href=\"https:\/\/apnews.com\/article\/child-marriage-west-virginia-bill-defeated-4d822a23b5ffd70f5370a36cc914cfb0\"><u>West Virginia<\/u><\/a>&nbsp;was rejected by Republicans&nbsp;in the state Senate.&nbsp;Some opponents of the bill argued&nbsp;that teen marriage was part of West Virginia\u2019s&nbsp;culture. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">West Virginia Sen. Mike Stuart (R) was among those who voted&nbsp;against&nbsp;the bill this&nbsp;past spring.&nbsp;He&nbsp;said that his mother was married when she was 16 and \u201csix months later, I came along. I\u2019m&nbsp;the luckiest guy in the world,\u201d according to The&nbsp;Associated Press. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/www.newsweek.com\/wyoming-ending-child-marriage-sparks-republican-outrage-1780501\"><u>Wyoming Republicans<\/u><\/a>, meanwhile, pushed back against state legislation raising the minimum age of marriage to 16 because&nbsp;they said it could limit&nbsp;parental rights and religious freedom. &nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In 2017, then New Jersey Governor&nbsp;<a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/new-jersey-chris-christie-child-marriage-ban-fails-religious-custom-a7735616.html\"><u>Chris Christie<\/u><\/a>&nbsp;(R) similarly vetoed a bill banning marriage for anyone under 18in the state&nbsp;because \u201cit would conflict with religious customs.\u201d &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThere is some perceived threat to religious freedom,\u201d said Ann Warner, interim CEO&nbsp;and president of the International Center for Research on Women, said of efforts to bar minors from legally marrying. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">She pushed back against that perception, however. \u201cWe are talking about human rights and human rights are not antithetical to religious&nbsp;freedom,\u201d&nbsp;she argued. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In California, in contrast,&nbsp;opposition to setting&nbsp;a minimum age for marriage&nbsp;has come from&nbsp;more&nbsp;<a href=\"https:\/\/www.newsweek.com\/california-child-marriage-ban-faces-opposition-planned-parenthood-1817362\"><u>progressive groups<\/u><\/a>, including Planned Parenthood, the American Civil Liberties Union and the Children\u2019s Law Center. &nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">These groups have contended that&nbsp;imposing an age requirement for marriage could lead to rollbacks&nbsp;of&nbsp;constitutional or reproductive rights. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">In 2017, the ACLU wrote in a letter of opposition to a&nbsp;California&nbsp;bill banning child marriage that the legislation \u201cunnecessarily and unduly intrudes on the fundamental rights of marriage with&nbsp;sufficient cause,\u201d according&nbsp;<a href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/article\/in-fight-over-child-marriage-laws-states-resist-calls-for-a-total-ban\/\"><u>to PBS.<\/u><\/a>&nbsp;&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Planned Parenthood Affiliates of California Spokesperson Jennifer Wonnacott said in a statement to The Hill that the organization \u201cstrongly supports protecting youth from abuse of all kinds and safeguarding their rights.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cWe have supported previous efforts to create safeguards against exploitation while working with authors to ensure those protections do not impede on the reproductive rights of minors and their ability to decide what is best for them, their health, and their lives,\u201d she added.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Warner pushed back against this argument as well, arguing that rather than being an exercise of young people\u2019s rights, marriages&nbsp;involving minors&nbsp;are&nbsp;being used as&nbsp;a guise for abuse and control of children.&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Minors&nbsp;need parental consent or judicial permission in order to&nbsp;get married,&nbsp;and many times children\u2019s voices aren\u2019t&nbsp;being heard as they stand before a clerk of the court or county registrar to&nbsp;be wed, she said. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cThis is not a youth right that is being exercised enthusiastically by young people,\u201d said Warner. \u201cThis is a loophole in the law that is being used to exploit young people under the guise of marriage.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">This was the case for Meyer, who said her mother gave her consent by signing something that \u201clooked like a permission slip\u201d and handing it to her daughter\u2019s soon-to-be husband. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Meyer&nbsp;and her former husband,&nbsp;who ultimately divorced&nbsp;when she was 22,&nbsp;got married in a Jackson, Miss.,&nbsp;courthouse when most of the staff were on their lunch break, she said.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\">She doesn\u2019t&nbsp;remember signing a marriage certificate,&nbsp;but&nbsp;does have a copy of it.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201cIt does have my little child\u2019s signature on it,&nbsp;so I must have&nbsp;at some point,\u201d she said. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><a href=\"https:\/\/thehill.com\/changing-america\/respect\/equality\/4283941-child-marriage-is-still-legal-in-most-of-the-u-s-heres-why\/\">Thehill<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>At age 14, Genevieve Meyer began spending time with a neighbor to get a break from her hectic home life. &nbsp;
