{"id":19728,"date":"2023-11-01T03:43:56","date_gmt":"2023-11-01T08:43:56","guid":{"rendered":"https:\/\/ustower.net\/?p=19728"},"modified":"2023-11-01T03:44:00","modified_gmt":"2023-11-01T08:44:00","slug":"former-white-house-lawyer-predicts-trump-will-be-jailed-for-violating-gag-order","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=19728","title":{"rendered":"Former White House lawyer predicts Trump will be jailed for violating gag order"},"content":{"rendered":"\n<p class=\"has-medium-font-size wp-block-paragraph\">Former White House lawyer&nbsp;<a href=\"https:\/\/thehill.com\/people\/ty-cobb\/\"><u>Ty Cobb\u2002<\/u><\/a>said he believes former&nbsp;<a href=\"https:\/\/thehill.com\/people\/donald-trump\/\"><u>President Trump\u2002<\/u><\/a>will be sent to jail if he violates a partial gag order in his federal election interference case, after the order&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4282835-judge-chutkan-reinstated-restrictions-on-trumps-public-statements-in-election-interference-trial\/\"><u>was reinstated Sunday<\/u><\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The gag order prevents Trump from disparaging court staff or witnesses in the case. He was fined $15,000 earlier this month after&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4274713-ny-judge-trump-violated-gag-order\/\"><u>violating a more limited order<\/u><\/a>&nbsp;in his New York civil fraud trial twice.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cWell, the New York judge fined him $10,000,\u201d Cobb said in a&nbsp;<a href=\"https:\/\/www.mediaite.com\/crime\/ex-trump-white-house-lawyer-shocks-erin-burnett-by-predicting-trump-will-be-sent-to-jail-for-violating-gag-order-thatll-be-an-incredible-thing\/\"><u>CNN interview Monday<\/u><\/a>, referring to Trump\u2019s second fine. \u201cThat\u2019s in a civil case. That\u2019s not as consequential as Judge Chutkan\u2019s case.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cI think she\u2019ll come in with a much heavier penalty, and ultimately, I think he\u2019ll spend a night or a weekend in jail,\u201d he said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Judge&nbsp;<a href=\"https:\/\/thehill.com\/people\/tanya-chutkan\/\"><u>Tanya Chutkan\u2002<\/u><\/a>is overseeing the case that alleges the former president conspired to overturn the results of the 2020 election. It will to&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4174750-trump-federal-jan-6-case-set-for-trial-in-march-2024\/\"><u>go to trial<\/u><\/a>&nbsp;in March.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cAs the court has explained, the First Amendment rights of participants in criminal proceedings must yield, when necessary, to the orderly administration of justice \u2014 a principle reflected in Supreme Court precedent,\u201d Chutkan wrote in the partial gag order.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump has frequently disparaged Chutkan, Justice Department special counsel&nbsp;<a href=\"https:\/\/thehill.com\/people\/jack-smith\/\"><u>Jack Smith\u2002<\/u><\/a>and potential witnesses with insulting nicknames and other digs \u2014 including calling Chutkan a \u201cTrump hating\u201d judge and Smith \u201cderanged.\u201d That behavior would likely have to stop in order to follow the order.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Cobb, who worked under the Trump administration, said a brief stint in jail is a likely outcome.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cI think it\u2019ll take that to stop him,\u201d he said.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump has&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4283002-trump-vows-to-appeal-reimposed-gag-order-it-will-not-stand\/\"><u>vowed to appeal the order<\/u><\/a>, but Chutkan said Sunday that it will still be in effect pending that appeal.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThis order, according to many legal scholars, is unthinkable! It illegally and unconstitutionally takes away my First Amendment Right of Free Speech, in the middle of my campaign for President, where I am leading against BOTH Parties in the Polls,\u201d he&nbsp;<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/111322079015303492\"><u>wrote on Truth Social overnight Monday<\/u><\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cFew can believe this is happening, but I will appeal.
