Students for Fair Admissions (SFFA) filed a lawsuit against the military academy West Point Tuesday alleging that the school is violating the Fifth Amendment\u2019s equal protection clause by using race-based admissions policies.<\/p>\n\n\n\n

The Supreme Court ruled<\/u><\/a> against Harvard and the University of North Carolina in June in a 6-3 decision, arguing that a \u201cstudent must be treated based on his or her experiences as an individual\u2014not on the basis of race.\u201d SFFA, who represented the plaintiffs in the previous cases, sued<\/u><\/a> the military academy, arguing that the Supreme Court\u2019s decision should apply to all schools. <\/p>\n\n\n\n

\u201cOver the years, courts have been mindful of the military\u2019s unique role in our nation\u2019s life and the distinctive considerations that come with it,\u201d Edward Blum, president of SFFA said<\/u><\/a> in a press release. \u201cHowever, no level of deference justifies these polarizing and disliked racial classifications and preferences in admissions to West Point or any of our service academies.\u201d<\/p>\n\n\n\n

The lawsuit argues that instead of basing admissions on \u201cobjective metrics and leadership potential\u201d the academy\u2019s administrators had instead opted for discriminating on the basis of race. It notes the school\u2019s \u201cbenchmarks\u201d for the amount of students in each class that should be made up of  \u201cAfrican Americans,\u201d \u201cHispanics,\u201d and \u201cAsians.\u201d<\/p>\n\n\n\n

\u201cBecause skin color can be\u2014and often is\u2014a decisive factor for successful applicants who are chosen from those congressional nominee pools, it is equally dispositive for the other qualified nominees who are turned away,\u201d SFFA argues. \u201cPut differently, because race is a \u2018positive\u2019 factor for some West Point applicants, it is necessarily a \u2018negative\u2019 factor for others.\u201d<\/p>\n\n\n\n

SFFA criticized the military\u2019s justification for the racial quotas, saying that these kinds of policies insinuate that all minorities think alike. The lawsuit also dismissed the academy\u2019s claim that these policies were needed in order to gain legitimacy in a \u201cdiverse nation,\u201d noting that a country\u2019s military should not be considered trustworthy only because of its racial make up.<\/p>\n\n\n\n

The lawsuit asks that the court issue a \u201cdeclaratory judgment that West Point\u2019s use of race in admissions is unconstitutional under the Fifth Amendment\u201d and that it grant a preliminary injunction barring the academy from enforcing the policy while the lawsuit goes through the court system.<\/p>\n\n\n\n

\u201cBecause the U.S. Supreme Court\u2019s recent opinion in the SFFA cases expressly forbids all institutions of higher education from using race in admissions decisions, it must follow that the U. S. military higher education institutions must end their race-based policies as well,\u201d Blum said.<\/p>\n\n\n\n

West Point did not immediately respond to the Daily Caller News Foundation\u2019s request for comment.<\/p>\n\n\n\n
