In reality, lab delays are creating nightmares for innocent people"},"content":{"rendered":"\n<p>Backlogs of months and even years have emerged thanks to issues including poor funding, low pay, a flood of requests from attorneys and families and the Covid pandemic.<\/p>\n\n\n\n<p>On 7 April, 2022,&nbsp;<a href=\"https:\/\/www.independent.co.uk\/topic\/colorado\"><u>Colorado<\/u><\/a>&nbsp;mechanic Derrick Groves was driving home and glanced down at his phone for an incoming call, causing him to lose control of his Tesla . The car went skidding over a highway embankment and down a small hill. But that wasn\u2019t when things really got out of control.<\/p>\n\n\n\n<p>Fort Collins police arrived on scene and grilled Mr Groves about whether he had been drinking or using drugs. He hadn\u2019t. He submitted to a blood test on scene, knowing it wouldn\u2019t turn up any evidence of intoxication. Still, an officer wrote in a report that \u201cI observed Groves had blood-shot, glassy eyes, and his pupils appeared to be different sizes,&#8221; and Mr Groves was charged with a DUI.<\/p>\n\n\n\n<p>The charges related to the stop weren\u2019t dropped until mid-August 2023 \u2014 16 months later \u2014 when blood results came back from a state lab showing the driver hadn\u2019t been intoxicated. During that time period, Mr Groves had to shell out money for a lawyer, saw his job prospects imperiled, and lived with the confounding experience of facing charges for something he knew he didn\u2019t do.<\/p>\n\n\n\n<p>\u201cWe could scream as loud as we wanted that this officer made a false arrest, but until they saw blood results, the prosecutor was not going to release him,\u201d Mr Groves\u2019s attorney, Matthew A Haltzman, tells&nbsp;<em>The Independent<\/em>. \u201cThere are more Derrick Groveses out there. It happens all the time as blood results take longer and longer to come back in Colorado. We\u2019re seeing this as a huge problem. It\u2019s not a potential problem. It\u2019s a real problem happening right now.\u201d<\/p>\n\n\n\n<p>The state, which once had two different labs processing blood results \u2014 a state-run facility and a contractor \u2014 is now down to one, according to Mr Haltzman. That\u2019s doubled the time it takes to get results back, from an average of about eight weeks to nearly four months.<\/p>\n\n\n\n<p>It\u2019s even worse for ballistic evidence, with the state crime lab taking an average of about a year to return results, according to an&nbsp;<a href=\"https:\/\/www.denver7.com\/news\/investigations\/backlog-at-colorados-crime-lab-poses-a-public-safety-threat\"><u>investigation from Denver7<\/u><\/a>.<\/p>\n\n\n\n<p>And it\u2019s part of a nationwide problem. Forensic evidence is often the near-magical linchpin of police TV shows like&nbsp;<a href=\"https:\/\/www.independent.co.uk\/topic\/csi\"><em>CSI&nbsp;<\/em><\/a>and&nbsp;<em>Law and Order<\/em>, but in the real world, it\u2019s functioning as the opposite. Delays at forensic labs now cause lengthy backlogs that hinder criminal cases, leave rape kits untested for years, and, in many cases, prevent justice from being enacted at all.<\/p>\n\n\n\n<p>\u201cThe problem with backlogs is across the board,\u201d Dr Tammy Bracewell, associate professor of Criminal Justice at Texas A&amp;M University-Central Texas, tells&nbsp;<em>The Independent<\/em>. \u201cYou\u2019re going to find it in any state you look at.\u201d<\/p>\n\n\n\n<p>Indeed, cities and states across the country are struggling. The Mississippi State Forensics Laboratory&nbsp;<a href=\"https:\/\/www.clarionledger.com\/story\/news\/2022\/11\/17\/mississippi-crime-labs-funding-backlogs-reach-critical-level\/69654692007\/\"><u>has an eight-year backlog of drug tests<\/u><\/a>, and a 15-year backlog of firearms tests. In Tennessee, a rape kit&nbsp;<a href=\"https:\/\/www.actionnews5.com\/2022\/09\/13\/henderson-rape-charge-sheds-light-rape-kit-processing-delay-west-tennessee\/\"><u>often takes 33 to 49 weeks<\/u><\/a>&nbsp;to analyse at the state\u2019s crime lab in Jackson. In Louisiana, homicide cases sometimes&nbsp;<a href=\"https:\/\/www.fox8live.com\/2022\/05\/26\/zurik-dna-backlog-delaying-justice-some-families\/\"><u>take as long as two years<\/u><\/a>&nbsp;to return DNA samples.<\/p>\n\n\n\n<p>Covid shutdowns and the surge in violent crime during the pandemic exacerbated problems, but big-picture challenges \u2013 increased drug use, poor funding, low pay, a flood of requests from attorneys and families \u2013 predate the coronavirus.<\/p>\n\n\n\n<p>\u201cMore crime creates more samples. If you take drugs, for example, the fentanyl has just really blown up. Meth and fentanyl cases, if you look at the fentanyl cases, it has impacted every lab that does controlled substances,\u201d Kevin Lothridge, deputy executive director of the Global Forensic and Justice Center at Florida International University, tells&nbsp;<em>The Independent<\/em>.<\/p>\n\n\n\n<p>\u201cDuring the pandemic, there was an increase in domestic violence as well as sexual assault. That evidence ends up in the crime laboratory,\u201d he adds. \u201cNot only that \u2014 we\u2019re looking to reduce the historic backlog of things like sexual assault kits. You have historic cases and current cases being run at the same time.\u201d<\/p>\n\n\n\n<p>These delays can stop or altogether foil criminal cases, and have devastating impacts on the individuals counting on evidence. As&nbsp;<em>The Independent&nbsp;<\/em><a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/murder-jessie-marie-twilight-crooks-kentucky-b2259450.html\"><u>reported<\/u><\/a>&nbsp;earlier this year, police in Kentucky have been waiting for years for the results of DNA testing from 2021 in the disappearance of Twilight Crooks, itself a cold case from 2001 only given new life by the advent of forensic techniques.<\/p>\n\n\n\n<p>\u201cThere are a million things that run through your mind,\u201d her father Bobby said of the disappearance. \u201cWho would have done it? Why would they have done it? There are no answers. We don\u2019t have any answers.\u201d<\/p>\n\n\n\n<p>In 2015, Washington state representative Gina Mosbrucker began working to tackle the state\u2019s backlog of roughly 10,000 rape kits. \u201cThey were found in backrooms of law enforcement agencies, college campuses, and hospitals,\u201d she tells&nbsp;<em>The Independent<\/em>.<\/p>\n\n\n\n<p>The pile-up was the result of a number of factors, from poor handling of evidence and record-keeping, to officials not believing victims of sexual assault. The extent of the problem, and the nature of sexual violence itself, made the issue an urgent one for the Republican legislator.<\/p>\n\n\n\n<p>\u201cRape is serial crime by nature,\u201d she says. \u201cIt\u2019s usually not just one.\u201d<\/p>\n\n\n\n<p>Working with colleagues across the aisle, Ms Mosbrucker was able to&nbsp;<a href=\"https:\/\/www.yakimaherald.com\/news\/local\/bill-to-address-sexual-assault-kit-backlog-clears-washington-state-house\/article_999aebee-4232-11e9-ad42-7f9ed83db17f.html\"><u>pass reforms that increased funding for testing<\/u><\/a>, provided trauma-informed care training in hospitals, and sent some kits to outside labs to speed up analysis, helping get the backlog down to a few hundred remaining kits. \u201cWe don\u2019t ever want to end up here again,\u201d she adds.<\/p>\n\n\n\n<p>Effective forensic testing can also serve as a check on police abuse.<\/p>\n\n\n\n<p>As&nbsp;<em>The Independent&nbsp;<\/em>has reported, DNA evidence&nbsp;<a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/death-row-innocent-capital-punishment-b1933748.html\"><u>is often a key part of exonerations<\/u><\/a>&nbsp;on death row, freeing inmates from wrongful arrests made decades ago.<\/p>\n\n\n\n<p>Jason Haferman, the officer who pulled over Mr Graves in Colorado, has been accused of making numerous false arrests for DUIs. A CBS News Colorado&nbsp;<a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/fort-collins-police-officer-jason-haferman-administrative-leave-internal-investigation\/\"><u>investigation<\/u><\/a>&nbsp;found he made at least nine arrests in 2021 and 2022 where forensic testing later showed the individual didn\u2019t have any drugs or alcohol in their system, a rate of false arrest far exceeding that of all the mistaken charges made by the rest of the Fort Collins police as a whole.<\/p>\n\n\n\n<p>In one case, in December 2021, a set of mistaken DUI charges caused a man named Harris Elias to nearly lose custody of his 15-year-old son.<\/p>\n\n\n\n<p>\u201cKnowing that I couldn\u2019t even drive with my own kid and there was zero evidence that I violated any law\u2026 it made me feel six inches tall,\u201d he&nbsp;<a href=\"https:\/\/www.thedailybeast.com\/how-dui-arrests-by-police-officer-jason-haferman-of-fort-collins-unleashed-chaos\"><u>told&nbsp;<\/u><em>The Daily Beast<\/em><\/a>. \u201cBy far, the thing that doesn\u2019t go away from this case is the child abuse aspect of it. It is the ultimate way to hurt someone who has spent the last 15 years as a single dad.\u201d<\/p>\n\n\n\n<p>In December, Mr Haferman resigned from the police, amid an&nbsp;<a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/fort-collins-police-officer-jason-haferman-resigns-faulty-arrests\/\"><u>internal investigation<\/u><\/a>&nbsp;that was about to lead to his firing. He showed \u201ca pattern of performance that did not meet the training and standards we require for our officers,\u201d Fort Collins police chief Jeff Swoboda&nbsp;<a href=\"https:\/\/www.westword.com\/news\/fort-collins-officer-jason-haferman-resigns-after-dui-arrest-controversy-15627090\"><u>said<\/u><\/a>&nbsp;in a video message at the time. \u201cThis officer let our community down and that hurts,\u201d he added.<\/p>\n\n\n\n<p>Mr Groves, the mechanic who crashed his Tesla, plans to sue the former Fort Collins officer for his mistaken arrest.<\/p>\n\n\n\n<p><em>The Independent&nbsp;<\/em>contacted a number linked to Mr Haferman on public records for comment, but did not receive a reply.<\/p>\n\n\n\n<p>It\u2019s urgent that lawmakers don\u2019t fall victim to the \u201cCSI effect\u201d \u2014 the Hollywood-influenced perception that forensic evidence is always analysed quickly and effectively \u2014 according to Kevin Lothridge of Florida International University. Rather, fixing the US\u2019s patchwork system of local and state crime labs will take persistent investment. And even then, crime labs might never catch up with crime in the real world.<\/p>\n\n\n\n<p>\u201cEvery case is a priority,\u201d he says. \u201cIf everything is a rush, you\u2019re never going to meet all the rush cases.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/crime-labe-dna-testing-delay-b2311251.html\">independent.co.uk<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Backlogs of months and even years have emerged thanks to issues including poor funding, low pay, a flood of requests from attorneys and families and the Covid pandemic.
