{"id":12466,"date":"2023-05-28T04:35:52","date_gmt":"2023-05-28T09:35:52","guid":{"rendered":"https:\/\/ustower.net\/?p=12466"},"modified":"2023-05-28T04:35:56","modified_gmt":"2023-05-28T09:35:56","slug":"judge-rules-colorado-student-cannot-wear-a-sash-with-mexican-and-american-flags-during-graduation","status":"publish","type":"post","link":"https:\/\/ustower.net\/?p=12466","title":{"rendered":"Judge rules Colorado student cannot wear a sash with Mexican and American flags during graduation"},"content":{"rendered":"\n<p>A federal judge has ruled for a Colorado school district after a student sued to wear a sash reflecting the Mexican and American flags at graduation Saturday.<\/p>\n\n\n\n<p>The lawsuit said the district violated Naomi Pe\u00f1a Villasano\u2019s \u201cconstitutionally protected right to free speech.\u201d Mexican American Legal Defense and Educational Fund attorneys, representing Villasano, also sought a temporary restraining order to allow Villasano to wear the sash at the May 27 ceremony while the court considered their claims.<\/p>\n\n\n\n<p>But Judge Nina Y. Wang on Friday denied that motion.<\/p>\n\n\n\n<p>According to the order, Garfield County School District 16, in the western part of the state, had indicated that sashes or cords worn during graduation typically represent membership in a nationally recognized organization; other distinctions such as class honors; future military service; or \u201cregalia that is part of a Native American or Pacific Islander tribe.\u201d Additionally, the school district\u2019s policy says \u201c(i)t is appropriate\u201d to decorate a cap with the \u201cflag of a country as recognized by the United Nations,\u201d the order said.<\/p>\n\n\n\n<p>In her ruling, Wang said that a student wearing regalia at graduation sends a message that the school approves, so it \u201cqualifies as school-sponsored speech, at least for the duration of the ceremony.\u201d The district insisted that standardized attire was required to create a message of unity, a concern that the judge deemed legitimate.<\/p>\n\n\n\n<p>The judge also pointed out that the district\u2019s policy would have permitted Villasano to reproduce the design of the sash on her graduation cap, and would have allowed her to wear the sash before and after the ceremony.<\/p>\n\n\n\n<p>\u201cWhile Naomi may prefer to wear the sash during the graduation ceremony, the Court respectfully agrees with the School District and concludes that Naomi will not suffer irreparable injury by having to express her culture in a form other than the sash,\u201d Wang wrote.<\/p>\n\n\n\n<p>CNN has reached out to attorneys for Garfield County School District 16 and Villasano\u2019s attorneys with the Mexican American Legal Defense and Educational Fund for comment.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.cnn.com\/2023\/05\/27\/us\/colorado-student-graduation-mexican-american-flag\/index.html\">CNN<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge has ruled for a Colorado school district after a student sued to wear a sash reflecting the Mexican and American flags at graduation Saturday.
